TIiTREOF, AND F2EPEALING ORDINANCE N0. 26<
BE IT ORDAINED BY THE BOATS OF SUPERVISORS OF THE COUNTY OF IiAWAII:
Section 1, DEFLNITIONS. 'dJherever in this Ordinance the following terms ere
used, they shall base the meanings respectively ascribed to them in this se:etion.
(a) "Taxicab" shall mean and include any motor vahlcle designed to carry
seven passengers or less, operating Yor hire solely on call or demand
from a fixed stand within the geographical limits of the county of
Hawaii, and accepting a passenger or passengers with or without
baggage for tran'dportation beC4rdefi such points as may be directed
by the passenger or passengers, the charges for service being based
upon the distance traveled,. plus waiting time.
The term "taxicab" shall not include: (1) Sight-seeing buses,
(2) Buses employed solely for transporting school children or teachers,
(3) Hotel buses operated solely between steamship piers, alrplane terminals
or hotels, (4) Chartered buses, (5) Motor vehicles rented or hired on
a "U Drive" or "Drive-Yourself" basis,
'"(b) "Chief of Police" shall mean the chief of police ar the examiner of
chauffeurs of the county of Hawaii.
(c) "Passenger" The term "passenger" shall not include the operator of
the taxicab nor any child under the age of 5 years not occupying;
seating space.
Section 2. SUSFENSION AT~iD RF'VOCATION OF PETtbTITS. Any permit issued
pursuant to the provisions of this Ordinance may be auspen~led or revoked by
a court of competent jurisdiction; provided, however;. that the decisioh or

(d) Sightseeing tours shall not be affected by the provisions of this
ordinance.
Section 8. Posting of Rates of Fare. Schedules of the rates of fare
as provided in this ordinance shall be posted in a conspicuous place within each
taxicab so as to be readily visible to any passenger riding within such taxicab.
Such schedules shall be legibly printed in bold-type letters not less than three
thirty-seconds of an inch in height.
Section 9, PENALTIES. Any person violating any of the provisions of this
ordlnance, shall upon conviction thereof, be subject to a fine not eaceedi.ng five
hundred dollars or imprisonment for a period not eaceeding six months, or by
both such fine and imprisonment,
Section 10. REPEAT„ Ordinance No. ?_6 ;:nd all ordinances or parts of
ordinances in conflict with or in consistent with the provisions of this
ordinance are hereby repealed.
Section 11. This ordinance shall take effect sixty days from and eft,er the
date of its approval. `

(b) r'or each additional mile or fraction thereof', thirty-five cent;s (35¢);
provided, however, the taxi fares and charges for passengers from in-
coming boats or planes shall be charged each person, and not by the
entire taxicab, that is, a fare not exceeding 50¢.per passenger for
the first mile and 35¢ per passenger for each additional mile there-
after or a fraction thereof.
(e) Distance may be computed either Yrom teas stand to point of pick-
up, point oY pick-up to destination, or from deatittation to taxi
stand on return trip, whichever is greater.
(d) If within the city limits oY hilo five minute waiting time shall
be allowed all returning or round trip passengers without extra
charge. Visiting for a longer time may be charged at the rate

(e) For each taxicab hired for funerals, time not to eaceed two hours,
and used within the city limits, 2'are shall not eaceed $5.00 for

(f) For continuous driving by the hour, within the city limits, they fare
shall not exceed :5.00 an hour.
Section 7. RAT1~S OF Fi~R1;' OUTSIDE, CITY LIMITS OF HIIA. The rates of
fares and charges i'or taxicabs operating from n fixed stand outside the city
limits of iii to shall be as i'ollows:
(a) ror the first mile or fraction thereof, not more-than fifty cents,
(b) For each additional mile or fraction thereof, not exceeding 15 smiles,
thirty-five cents (35¢) per mile.
(c) The price for any trip from within the city limits of ri11o to any point
outside the city limits, or Prom any point outside oi' the city :Limits to
another point outside the city limits, when such distance exceeds 15
miles, or from a point outside the city limits to an.y point within the
city limits, when said distance exceeds 15 mile a, may be fixed lry agree-
ment between the taxi driver and the passenger, but in no event shall said
price exceed fifty cents (50¢) for the f'irst`mils and i'orty-five (45¢)

(c) No person shall be issued a driver's permit unless ho shows that his
sole occupation will be that of a taxicab driver.
(d) Every permit issued under this section shall e~ ire, unless otherwise
revoked or cancelled, one year after the issuance thereof and shall be
renewed on or bei'ore its expiration date upon re-examination; provided,
however, that the chief' of police may in his discretion waive eaamination
upon renewal of such permit.
Section 4. APPSAI. TO CIRCUIT NDGE. Any applicant who has been refused a
driver's permit after at least three examinations, or who has been refused any
eaamination, may appeal from such refusal to the circuit judge at chambers of
the third circuit court by riling his petition in such court within twfanty days
of the date of the rei'usal; provided, however, that the appeal shall not. operate
as a stay to the order or decision appealed from. 'i'he appeal shall be subject to
such procedure and rules as may be prescriped by the court and the decision of
the circuit judge shall be final.
Section 5. CRUISING PROHIBITID. No driver oi' a taxicab shall cruise in
search of patronage at any time. ror the purpose of this section the germ
"cruising" shall mean the movement or standing, when not engaged, of taxicabs,
over ar on the public streets of the city of kilo in search of or soliciting
prospective passengers; provided, however, that a driver of a taxicab, when
returning by the most direct route, after having discharged a passenger Or
passengers, to the garage or stand where said taxicab is regularly stationed,
may stop to pick up a passenger or passengers only if and when hailed by such
passenger or passengers i'or that purpose,
The provisions of this section shall not apply to taxicab drivers solicit-
ing patronage at any steamship wharf or airplane terminal.
Section 6. RATl.'S OF FiaRE WITHIN THE CITY LIMITS OF HIIA. The rates oP

shall not exceed the following:

Such permit shall be placed in „ prominent place within the i;axicab being driven

(b) No permit shall be issued to any person unless he saa~l:
(1) Have a reasonable knowledge oi' the traffic laws of the county oi'
Hawaii.
(2) Have a reasonably knrn~aledge oi' the locations of stireets, roads,
and highways, ena of important county and terrii;orial buildings
and places ~~~itttin the county of Hawaii,
(3) Be able to speak r:rd understand ther',nglish language well enough
to converse satisfactorily •mitn.Sttglish speaking, people; provided,
however, that the ?revisions or this paragraph shall not apply to
