AN ORDINANCE REPEALING ORDINANCE N0. 6 ;~IdOWN AS THE "BUILDING CODE"
AND ADOP'1'ING THE "UNIFOffi'!f BUILDING CODE, 1946 EDITION", BY REFERENCE,

BE I'~ ORDAIPIBD BY `PRE BOARD OF STJPERVISORS OF THE COUPS'1'Y OF HAuVAII:
Section 1. Crdinance No, 6, known as th® "Building Code",
is hereby repealed and in lieu thereof the "Uniform Building Code,
1946 Edition", and all subsequent revisions thereof, are hereby
in pursuance of Act 193 S.Q.H. 1947 enacted into an ordinance known
as the "Building Code" of the County oP Hawaii, except as hereinafter...;
provided: \~-
Ser_.tion 2. rJherever the word "state" or "city" is used in
the "TJniforn Building Code, 1946 Edition", it shall mean the ''County
oY Hawaii".
Section 3. In lieu of Section 301 (c) Chapter 3 of the
"TJniform Building Code, 1946 Edition", the following is hereby
substituted:
"(c): Flans and Specifications. Eactz application f'or a permit
shall be accompanied by two sets of plans and specifications.
"Exceptions. Plans and specif'icationa need not he
submitted for restoration of piaster, papering, paintings
or small and unimportant work when the small anu unimportant
work shall not exceed ~;~2b0.00."
Section 4. In lieTZ of the third sentence of the first
paragraph of Section 302 (a) of the "Uniform Building Code, 1946
F'dition", the following; is hereby substituted:
"Tf the Building Official is satisfied that the work
described in an application for permit and the plans filed
therewith conform co the requirements of this Code and
other pertinent laws and ordinances, he shall prior to
issuing a permi~: therefore require the applicant to obtain
the approval of the Board of Health in writing; provided,
all app:l.ications for permits for the erection, alteration
or removal of any buildinr,s for public assembly in the
County of Hawaii must first be approved in wriia ng by the
Chief of the Milo Fire Department."
Section b. In lieu of the first paragraph of Section 1002
(b) Chapter 10 of the °Uniform building Code, 1946 Edition", the
following is hereby substituted: ~

"b. Special Provisions. Public garages shall have
exterior walls of not less than one-hour fire-resistive
construction; provided, howover, that in Fire Zone III,
Type IV construction may be permitted if the walls of the
structure are twenty feet or more from adjacent property
lines except street fronts; and twenty feet or more from
adjacent buildings on the same property."
Section 6 In lieu cf Section 1601 (s) Chapter 16 of the
"Uniform Building Code, 1946 Edition", the following is hereby
substituted:
~~aa "General (a) Fire Zones. 'T'here shall be Fire
Zones One, Two and Three in the County oP Hawaii, as
outlined in Ordinance No. 33 of the Revised Ordinances
of the County of fiawaii, 1947.
Section 7. In lieu of the Exceptions 1, 2 and 3 in
Section 2204, Chapter 22 of the °Uniform Building Code, 1946 Edition",
the following are hereby substituted:
"Exceptions: 1. Interior and exterior bearing walls
in one-story building may be supported on piers.
2. For 't'ype V buildinr~s, isolated piers of wood, solid
masonry or concrete ma,y be used for post and girder
construction.
3. `aVood Frame Type V buildings may be constructed of
single one (1) inch nominal thickness board walls without
studs for one (1) story in height where there are cross
partitions for at least every thirty (30) feet o:f such
wall. Two-story wood frame 'Pype V buildings may be
constructed of single wall for the upper story, 'but shall
be supported by studded walls below. Studding shall be
not less than two by three (2 x S) inches, and shall be
so braced tc amply carry the loads imposed";
and in addition thereto the following is included:
"When wood frame dwellings are supported by posts,
knee bracing shall be provided of sufficient strength
to stabilize the structure against movement from wind
pressure in any direction. Single wall construction
shall be braced with not leas than two by six (2 x 6}
belt course between the floor and the ceiling."
Section 8. Chapter 45 hereby amended to read as:
In lieu of the second paragraph of subsection (b) of Section
4505, Chapter 45 of the "Uniform Building Code, 1946 Edition", the
following is hereby substituted:
"A marquee projecting more than two-thirds of
the distance from the property line to curb shall be
net less than ten (10) feet, above the ground or pavement
below."

Section 9. In lieu of subsections c and e of Section 4505,
Chapter 45, of the "Uniform Building Code, 1946 Edition", the
following is hereby substituted:
"e. Length. A marquee projecting more than
two-thirds the distance from the property line to curb
line may extend the full length of the building along
direction of the street.
"e. Construction. A marquee shall be supported
entirely from the building and construction as
specified under 't'ypes of Construction. Marquees shall
be of the same fire resistive. quality as the building
it is attached to, except in Fire Zones I and II where
it shall be of non-combustible material or of riot less
than one-hour i'ire resistive construction."

Section 10. this Grdir.~ance shall take effect upon its
approval.
