Y OF HILO , ESTAB.'ISHING RATS AND PROVIDING PENALTIES THEREFOR, BE IT ORD,AIMM BY THE * BOARD 01' SUPERVISORS OF THE COUNTY OF HAWAII Section l.- Definitions of materials and substances. Unless otherwise expressly. stated, whenever -used in this ordinance the following terms shall be taken to have the following meaning* 1. Garbage shall mean and -include, peels of citrus fruits coffee grounds, egg shells, bones and/or any accumulation of rejected animal or vegetable matter, containing no liquid, that attends the preparation, dealing in, storage, spoilage or decay of meats, fish, fowl, fruits or vegetables and .which are unfit for use as food for animals, and shall also include any container or waste material in which or on which any such garbage has bei.,. kept. or prepared; . __ 2. Rubbish shall mean and include all solid waste material accumulating or resulting from t*he use or obcupency of any buildings g or premises such as paper �straw �excelsior rags,,bottles old clothes, . old shoes, tin cans, china, glass and metal -ware, leaves, . 1 branches., grass, stumps a'ad other materials of similar character, but shall not include any soil, concrete rock tele cement or . Bureau shall mean the Bureau of Waterworks, Sewers and Sanitation of the Department VSof Public works of the county of Hawaii. Section 2. Garbage, rubbish and swill receptacles. 1. It. shall be the duty .'f every householder or occupant of any residence- or business building or pr6mises within the City of Hilo, County of Hawaii, to remove or cause to be removed all.. garbage and rubbish at least twice each month from any residence or business building or premises; provided, further, that every householder or occupant of any residence or business building or premises within said City of Hilo shall provide or cause to be provided and maintained a sufficient number of receptacles of the type and kind hereinafter specified, to contain all of the garbage, rubbish and swill that shall have accumulated within such building or upon such premises between any , two successive dates or days for the collection of garbage or rubbish or the removal or disposition of swill within the area in which such building or premises are located. 2. Garbage receptacles. All garbage shall be kept in a garbage receptacle, which shall be of metal and of a type approved by the Bureau, having a capacity of not less than two gallons nor more than forty gallons, and shall be leak -proof and shall be kept securely covered so as to exclude rodents, flies and other insects, 3. Rubbish receptacles. All rubbish, except branches, stumps, hedge cuttings, banana leaves and palm and cocoanut leaves shall be kept in a rubbish receptacle, which shall be of metal or wood and Y of a type approved by the Bureau, having a capacity of not more than five cubic feet or forty gallons; provided, however, that the diameter of any cylindrical receptacle or the length of any rectangular receptacle shall be not less than twelve inches and. -2- r y _ not snore , than twenty-four inches; and, provided, further, that in case a wooden barrel is used as such rubbish receptacle the maximum capacity, thereof shall, be nine -'cubic feet _and the mex- imum i diametor of twenty-four inches shall not apply thereto. 4o Swill receptacles. All swill shall be kept in a swill receptacle, which shall be of metal and of a type approved by the Bureau, and shall be leak -proof and shall be kept securely covered so as to exclude rodents, flies , and other insects. 5. All such receptacles shall be kept at all times in a condition of repair and sanitation satisfactory to the head of the Bureau. Section 3, Location of receptacles and placement for collection. 1. At all buildings that do not have a yard in the front or at the side thereof which abuts on a public highway, all such receptacles shall be kept within the building or at the rear pre -- :raises therewith connected and shall be moved to the sidewalk closest to the building or to such other area as may be approved or required by the Bureau only on the days when collections are to be made; provided, however, that when the contents of such receptacles are to be collected at night such receptacles shall not be moved from within the building or the rear premises connected therewith before five o'clock p. m. of the night of collectionand when collection is to be made during the day such receptacles shall not be moved from within the building or the rear premises connected therewith before six o'clock a.m. of the day of collection s provided, further, that no such receptacle shall be so placed as to constitute or contribute to the creation of a nuisance, and that all such receptacles shall be removed -from the sidewalk area' we"3100 I 0 and returned t'o the building or the rear premises connected therewith before nine o'clock on the morning after a night collection or -within the hour after collection when such collection is made during the day. 2. At all buildings or premises having a yard in the front or at the side thereof which abuts upon a public highway, all such receptacle -s shall be placed upon the sidewalk area adjacent to such building or premises. A' 3. No such receptacle shall be so placed for collection, the weight of which, together with the contents, exceeds one hundred pounds. 4e Receptacles remaining in front of any building or on any sidewalk of ter the times specified above for removal therefrom shall be subject to removal and confiscation by the County of Hawaii without any recourse to the. owner of such receptacle. 5. All hedge cuttings, stumps, branches banana leaves palm and cocoanut leaves and other similar substances shall be coat into pieces not to exceed three feet in length and arranged ' g g �. n bundles weighing not more than fifty pounds and securely tied d be fore being placed for removal; and such b s candle s shall be kept, moved and placed only as is hereinabove provided for the - • p placing or .moving of rubbish receptacles; provided, however, that not more than a combined total of two cubic yards of hedge cuttings, . g s tul4s , branches, banana leaves, palm or cocoanut leaves and other similar� substances shall be placed for collection at onetime, Section 4. Disposition of swill. It shall be the duty of every householder or occupant of any residence or busi e' s . n s building or premises within the city of Hilo, Count of Hawaii, �. , to dispose of or provide for the disposition Of all swill as hereinabove des. cribed by providing for the collection and removal of the same by a person,, firm or corporation holding a -permit issued under the provisions of section 8, or otherwise in accordance with the rules and regulations of the territorial board of health, Section 5. Time for removal of swill . P P y f Hilo between the hour of ten in the morning and the hour of five in the afternoon of any day. Section 6. Unlawful to dump garbage, rubbish or swill in vacant lots, etc . It shall be unlawful to dump, place or keep on any vacant lot or other public or private premises any garbage, rubbish or swill, -,except as permitted under the terms of this ordinance, -Section 7 . Collection of garbage, etc.., by the Bureau; charges, The Bureau shall collect and remove at -least twice each month all garbage and rubbish placed for collection as hereinabove provided, and shall charge for said collection and removal at the rate of one Dollar ($1.00) per month for each residence unit* provided, however, that c olle c,ti on and removal of garbage and rubbish from places of business and charges therefor shall be governed by the provisions -of section 13 of this ordinance. The Bureau shall receive free of charge all hedge cuttings, stumps, branches, banana leaves, palm and cocoanut leaves, and other similar substances delivered -from residences or unimproved properties to the dumping grounds belonging t o or under the control, of the County of Hawaii, Section 8. Collection. of garbage, rubbish or swill by other than Bureau, 1. No person, firm or corporation shall engage in any business involving the removing of any rubbish, garbage or swill ow 50» from any premises within the limits of the city of Hilo, County r of Hawaii, without having first secured a written permit from the Bureau to do so. 2. ,Any persona; firm or corporation desiring such permit shall, when making application to the Bureau state the nature of the materials to be removed, the location or address of each building or premises from which said materials are to be removed. Section 9. Unlawful to disturb receptaclesa when any receptacle containing garbage, rubbish or swill, or any bundle of hedge cuttings, stumps, branches, banana leaves, palm or cocoanut leaves,. and other similar substances, has been placed for collection as hereinbefore provided, it shall be unlawful for any person or persons, to remove any, such receptacle or bundle from the place where the same has been placed for collection; and it shall be unlawful for any person or persons to remove, transport , carry, disturb, or 'haul away any garbage, rubbish or swill tram any' receptacle or bundle that has been placed for collection as ' herein= before provided; provided, how -ver, that the* rern_ova1 of any ,such receptacle or bundle by the owner thereof or his agent or by", the ~ employees of the Bureau, while in the performance of their duties or by the employees of any person, firm or corporation while actually engaged in removing garbage, rubbish or swill for which work a permit has been issued by the Bureau shall not be deemed a violation of the provisions of this section. Section 10, Vehicles for removingbarba e anal rubbish. g All vehicles used for the collection and removal of 'garbage, rubbish and swill, shall be kept in a clean, inoffensive and sanitary- condition anitarycondition satisfactory to . the head of the Bureau. Allarba ge g g , rubbish and swill shall be handled and hauled in such a manner as, to. prevent the, scattering, spilling or leaking of the same. & ^ a IY r y IM Section 11. Dead animals* It shall be the duty of every owner of dead cattle, horses, mules goats, and similar animals of a larger type ! to, remove , or cause to be removed, such dead animals to the County dumping grounds for disposal within- a reasonable time after death, or before the same shall constitute a nuisance. Section 12., old automobiles and scrap iron. It shall be unlawful for any person, firm or corporation, to leave old automobiles, scrap iron, or other similar substances upon an art � Y p or parts of the public streets, roads or highways. Section 13 Collection from places of business; charges, 1. The Bureau shall collect and remove from places of business at times regularly scheduled for such collections, and dispose of , any garbage and rubbish as hereinabove defined., upon payment of the following charges ; which shall be made and collected by said Bureau: Garbage and rubbish, eight cents per cubic foot; minimum charge for each place of business two dollarsp er month. 2. For the purpose of this ordinances a place of business shall be construed to mean any business, industry, hotelrooming house, apartment house, court of four or more houses and an ship � y p berthed in Hilo harbor, or any unit of the federal t • d , territorial or county governments. Section 14. Special collections; charges. The Bureau shall upon request, and on days other than the regular collection days, d T g make special collections from all premises of garbage or rubbish, including hedge cuttings, stumps, branches banana leavesalm. p and cocoanut Leaves and other similar substances, uponp y a ment of a charge of one dollar per cubic yard, or fraction thereof, of such materials. � w Section 11. Section 15. Disposal of combustible materials; charges. Combustible garbage and rubbish, fifty cents per cubic yard Provided, however, that no charge shall be made for receiving and . disposing of hedge cuttings, stumps, branches, banana leaves, palm and cocoanut leaves and other similar substances delivered from all premises. Section 16. Disposal of noncombustible materials; charges. The Bureau will receive from business establishments and dispose of at any dumping ground belonging to or under the control of the County of Hawaii any noncombustible garbage, rubbish, concrete, rock, tile, cement, lumber, automobiles, automobile chassis scrap iron or other-, similar substances., upon payment .of the following charges which shall be made and collected by the Bureau: a* Noncombustible garbage or rubbish, concrete, cork, tile, cement or lumber., fifty cents per cubic yard, b. Automobiles and automobile chassis, four dollars each. c 10 Scrap iron and similar substances, thirty cents per cubic foot. Section 17* Disposal of dead animals; charges. The Bureau will accept without charge, at the County dumping grounds, all dead cattle., horses, mules, or any similar large animals* provided however, the owner or representative of the owner of said animals shall dispose of the same at said County dumping grounds as directed by the Bureau, 1 - Section 180 Failure to pay charges* In case of the failure Of any business, industry, hotel, rooming house,, apartment, owner or, ,occup6nt of a house, or dwelling or any unit of the federal, ,,, territorial or , county governments, or any individual, to pay, upon, demand, any bill rendered for services performed in accordanCe with .the provisions of this ordinance, the Bureau -may decline to render -any further garbage and rubbish collection and/or disposal service to the art or .ace concerned and may p party p Y proceed according to law to recover any delinquency for nonpayment of collection charges. Section 19, Penalty.` Any person violating any of the provisions of this ordinance shall, upon conviction, be punished by a fine not exceeding five hundred. dollars, Dated at Hilo , .
