Section 1. llefinitp)i. As used in this Ordinance, the following
words shall have the meanings ascribed to them in this section unless
otherwise indicated by the context.
"School Bus" shall have the meaning prescribed by Section 1724.
of the Revised Laws of Hawaii, 1945.
"Driver" shall :mean any pers~~r, in actual physical control of a
school bus.
"School bus operator" shall mean and include every natural person,
firrn, copartnership, ass~~ci~.?,i.on or corporatiua, binding itself into contract
with the County of Hawaii to furnish transportation of school children to
or from school as provided by the said provisions of Section 1724 of the
said Revised Laws of Hawaii, 1145.

(a) No vehicle shall be used as a school bus unless the police

(d; Entrance and exit doors of all school busses shall be
placed on the right-hand side of the front of the bus, and shall. be
direct]„v within the view and under the control of the driver. 'ntrances
and exits shall at all. tines be kept clear for the ingress and egress
of passengers, All such doors must be capable of positive uniform
operat'.on at all tines.
(e Each school bus, not of a pleasure-car type, shall be
equipped with an emergency exit in the rear, or_on the, o,ppgsite. side, of
the entrance door, to be opened outward and capable of being opened from
either the interior or exterior of the bus. Such emergerc~= exit shall be
equipped with positive devices to keep it closed whenrnt. in use and of
such character to permit it to be opened readilT= when necessar;,= ro+ithout
undue accessibility for unauthorized use. The size, location, and type of
such emergency exit must neet with the apT~roval of the police department
of the County of Hawaii,

(k) No driver shall work as an operator or be otherwise employed
for more than twelve hours in any 24-hour period,
(1; Every school bus shall be cleaned daily and kept in a sanitary
condition at all times.
(m~ No driver while transporting school children shall leave his
bus while the engine is running or the brakes are released.
(n) Each school bus operator shall report to the police department
of the County of Hawaii the license number of at~y motor vehicle, the operator
of which is guilty of a violation of any traffic regulation, when such
violation in any way endangers the safety of the pupils being transported,
(o) All side openings between the driver's seat and the rear
shall be screened with metal. screen of not more than 1-3/4" mesh and not
less than No. 16 gauge, all to the satisfaction of the police department
of the County of Hawaii.

Section ~. Operation of Busses and Responsibilit~r of Drivers;,
(a) Drivers of school busses shall at all times operate such
vehicles in a safe, prudent and careful manner with due regard to the
traffic and the use of highway by others.
(b) When any accident or damage occurs to or defect develops in
the bus so as to make it unsafe £or traveling, the driver shall immediately
thereupon discontinue the use of the bus, and he shall make all necessary
arrangements for the safe transportation of the pupils to and from their
respective destinations.
(c) If any school bus is at any time found or known by the driver
to be dangerous or unsafe for operation or reported by anyone to the driver
as being dangerous and unsafe, the use of such school bus for the transporta-
tion of pupils shal]. be discontinued immediately thereupon, until properly-

examined, and i.f necessary, repaired, and the certification that the bus
is in a safe condition must firstly be obtained in writing from an

(d) No school bus shall be put in reverse, or be backed while on
the school grounds or at any point or place where children enter or leave '
the bus unless such movement can be _made in_safety,
(e) No school bus shall, when being used for the transportation
of pupils, be operated or drivers with any trailer or other vehicle attached
thereto, nor shall anv school bus trans ort frei ht other than the schoo

(f) No person shall operate a school bus when i.t is so loaded or
when any aerson is so seated as to interfere or obstruct the visign of the
driver to the front, side, or, by means of the mirror, to the rear, or
interfere with the operation of the bus.
(@) Phe driver of tshe school bus shall bring the bus to a full
and complete stop at all railroad crossings at least six feet and not more
than ten feet from the nearest rail and must not proceed until he has
ascertained that the traffic is clear in both directions and that the bus
may *roceed safe],y. After making the stop provided fcr in this rule, the
bus shall be driven in low gear across the tracks,
(h) No school bus shall be operated with the clutch disengaged
except when coming to a stop, or with the gears in neutral except when the
bus is not in motion,
(i) Smoking, by the bus driver shall. be prohibited whenever pupils
are being carried.
(;,) No intoxicatinFs liquor shall at any time be carried in a
school bus or upon the person of the driver.

(1) Pupils being transported in a school bus shall be under the
authority and control of and responsible directly to the driver of the bus,

cross the street or highway in order to reach their destination, such

(n) All doors shall be kept closed while the bus is in motion,
Section /~, lns~~ctivn of Equi ent: (a) The Chief of Police of
the County of Hawaii or his duly authorized subordinates, which shall
include Official Vehicle Inspection Stations, shall, before any passenger
license is issued to the said bus, inspect the bus for which a license is
requested, and if he finds the same to be in good serviceably; and safe
condition for the safe transportation of passengers, he shall deliver to
the applicant therefor a certificate setting forth the fact that the saki
bus has been inspected and found to he safe for the transportation of pupils,

(b) All vehicles used for the transportation of school children
shall be subject to a thorough inspection monthly, by the Police Department
of the County, of Hawaii or any Official Inspection Station so designated
and authorized by the Chief of Police, When a vehicle has been so inspected
and found to be in a satisfactory operating condition, the department of
inspecting station shall issue a certificate of inspection, which certificate
shall include a check list printed on the reverse sides certifvine as to
the equipment and mechanisris checked, and certif~rinn to the adequacy and
safety of the vehicle and equipment. No vehicle without suet! a certiP:icat,e
shall be used and no claims for the transportation of schoo]_ children will
be paid unless accompanied by such a cert:i.ficat.e of inspection. ~{ copy of
the said certificate shall be submitted each month to the District Superin-
tendent, Hawaii Island Schools,

any provision of this ordinance shall, in addition to the penalties
