ORDINANCE NO. // 7
AN ORDINANCE AMENDING SECTIONS 2, 5, AND 21, OF ~2DINANCE N0. 45 OF THE
REVISED ORDINANCS3 OF THE CQ(iNTY OF HAWAII 1947, AS AMENDED, AND ADD-
ING NEW SECTIONS DESIGNATED AS 13.01, 17.01, AND 18.01 THERETO, KNOWN
AS THS ZONING CRDINANC$ OF THE COUNTY OF HAWAII.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF
HAWAII:
That Ordinance No. 45 oP the Revised Ordinances of the County of
Hawaii 1947, as amended, is hereby further amended in the following
reapecta:
Section 1. Section 2 of Ordinance No. 45, as amended by Section
1 of Ordinance No. 89, is hereby further amended by adding thereto the
following:
"'Home occupation' shall include any occupation or profea-
aion customarily carried on entirely within a dwelling by
a member of the iamediate family residing on the premises
provided that:
A. No article is sold or offered for sale except as
may be processed or manufactured by members of the
immediate family residing on the premises.
B. The occupation or profession is a secondary nee and
the residence a primary use.
C. No mechanical equipment is used except such as is
normally used for domestic or household purposes.
D. No signs or diapiap is used in connection with said
occupation or profession.
E. No offensive noise, vibration, smoke, fumes, duet,
odors, heat, glare, or hazard from fYre or explo-
sion shall be generated, produced or caused from
the operation of said home occupation.
A home occupation includes--but is not limited to--
Musical instruction limited to two pupils at a time and
the teaching of hula or classical dancing limited to
five pupils at a time; provided that the time limit is
not later than 9:00 p.m.
A hams occupation will not be interpreted to include uaea
such as clinics, barber shops, beauty parlors, commercial
stables and kennels, animal hospitals,
restaurants or tea houses, and the like.

Structural alteration: Any change in the supporting mem-
bers of a building, such as bearing walls, colunna, beams
or girders, or any change in the roof or in the exterior
walls, except for repairs or maintenance."
Section 2. Section 5, Subsection A, Paragraph 4, is amended to
read as follows:
"4. Schools--elementary and secondary, kindergarten, daq-
care centers and nurseries."
Section 3. Section 5, Subsection B, is amended to read as fol-
lows:
"B. Poultry and Rabbit Raising. The keeping of poultry or
rabbits for commercial purpose shall not be permitted
in any residential districts, but same may be permitted
in all residential districts as an incidetrtal nee for
Yamilq purpose, and further aub~ect to all regulations
of the Department of Health."
Section 4. Ordinance No. 45, as amended, is hereby amended by
adding Section 13.01, after Section 13, to read as follows:
"Seation 13.01. Within any business, light industrial, or
industrial district, no structure referred to in Section 5,
or any duplex dwelling, apartment house, lodging house or
hotel shall be constructed on any lot having an area less
than five-thousand square feet. There may be one or more
of the above-mentioned structures on any lot having an area
of ten thousand square feet or more. There shall not be
lass than five thousand square feet of lot area for each
of the above-mentioned structures."
Section 5. Ordinance No. 45, as amended, is hereby amended by
adding Section 17.01, after Section 17, to read as follows:
"Section 17.01. The provisions in Section 16 and 17 shall
not prohibit the construction of dressing plants and slaugh-
terhouses when supplemental to the normal operations and
when the following conditions are met:
A. Construction and location on the site have complied
xith public health regulations and is aub~ect to
review of the Department of Health and the Commis-
sion.
B. Killing and dressing is limited to animals and
poultry raised on the premises for more than one
month iemiediately preceding the said killing and
dressing.
C. The structure is located at least 200 feet from the
centerline of a government road and 150 feet away
from anq residence."

Section b. Anew section designated as Section 18.01 is txireby
added after Section 18 to read as follows:
"Section 18.01. A cemetery may be permitted in any zone
when such use is deemed essential and desirable to the
public convenience and welfare, and is in harmony with
the various elements or ob~ectivea of the Master Plan,
and its location is fYrst approved by the Planning and
Traffic Commission."
Section 7. Section ?J~. is amended to read as follows:
"Penalty. Any person, firm or corporation, violating or
failing to comply with the provlsiona of this ordinance,
shall be punished by a fine not exceeding five hundred
dollars.
The continuance of any such violation after conviction
shall be deemed a new offense for each day of such con-
tinuance."
Section 8. This ordinance shall take effect upon its approval.
