HomeMy WebLinkAboutORD 1953-129~~ Y ~~~ COUNTY OF HAWAII - TERRITORY OF HAWAII - ~ ORDINANCE NC1. /~ AN ORDINANCE REGULATING THE CONSTRUCTION OF DRIVEWAY APPROACHES IN THE COUNTY OF HAWAII. BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF HAWAII: Section 1. Definitions. For the purpose of this ordinance, the following definitions shall apply to these words: A. Driveway. A place in private or public property for the operation of automobiles and other vehicles. B, Driveway approach. An area, construction, or facility between the roadway of a public street and private or public Property intended to provide access for vehElea from the roadway of a public street to abutting property. For clarification, a driveway approach must provide ac- cess to something definite on private or public property, such ss a parking area, a driveway, or a door at least 7 feet wide, intended and used for the entrance of m- hicles. C. Corner. The point of intersection of the lines of two street-curb faces extended into the street intersection. D. Curb parkintt space. A apace approximate],y 22 Peet in length and 7 feet 6 inches in width where an automobile or other vehicle can park. E. Abandoned driveway approach. A driveway approach shall be considered abandoned when its use has been discon- tinued and it does not provide access to something def- inite on private or public property, such as a parking area, a driveway, or a door at least 7 feet wide, in- tended and used for the entrance of vehicles. Section 2. Permit required. It shall be unlawful for ar{p person, firm or corporation to construct a driveway approach across any public sidewalk, or cut any curb for such purpose without first having ob- tained a permit therefor as required in Ordinance No. 47. Section 3. Application. Application for such permit shall be ~~ ~,, made to the chief engineer of the department of public works and shall ~`'~ state, among other things, the location, grade and dimensions of the -- -- -- proposed driveway approach and the purpose for which it is desired. If the proposed driveway approach complies with the provisions of this ordinance, the chief engineer shall issue a permit therefor. Section 4. Staadarda for driveway approaches. A. Maximum width. No driveway approach shall be constructed of a width greater than 4O per centum of a street front- age of a lot or 30 feet whichever is larger. In case of a lot having more than one street frontage, the width of the driveway approach allowed shall apply separately to each street frontage, B. Location. Where more than one driveway approach on a street Front serves a single lot, there shall bo at least one curb parking space between driveway approaches. C. Distance between drivexav approach and corner. No por- tion of a driveway approach shall be constructed within 20 feet of a corner. D. Distance between driveway approach and property line. No portion of a driveway approach shall be constructed closer than 2 feet to the extension of aqy property line divid- ing 2 lots. E. Street structures. No driveway approach shall interfere with municipal facilities, such as street-lighting poles, traffic-signal standards, signs, catch-basins, hydrants, crosswalks, bus-loading zones, utility poles, £ire-alarm supports, underground pipes or ducts, or other necessary street structures. If a proposed driveway approach in- terferes with an existing street structure, the abutting property owner shall bear the expense of removing, recon- structing, or relocating said structure. However, if a proposed street structure interferes ~*ith an existing driveway approach, the County of Hawaii ox the specific agency shall bear the expense of removing, reconstruct- ing, or relocating said driveway approach and pay all damages accruing from such changes, Section 5. Buildinr. official's cooperation. Aqy plans submitted to the building official for approval, which include or involve unusual driveway approaches or problems, shall be referred by the building of- ficial to the chief engineer for his approval. Section 6. Reconstruction of abandoned driveway approach. Any abandoned driveway approach on any street with a curbing shall be re- constructed by the owner into a sidewalk within 6 months of the effect- ive date of this ordinance. Any driveway approach abandoned after the adoption of this ordinance shall be reconstructed by the owner within 6 months. Section 7. Construction specifications. All sidewalks and drive- way approaches constructed under this ordinance shall be in accordance with standard drawings on file in the office of the chief engineer, de- partment of public works. Section B. Saving clause. If any section or part thereof of this ordinance shall•be held illegal, unconstitutional, or void, this shall not be construed to render void any other provision or requirement of this ordinance. Section 9. Penalties. Any person violating any of the provisions of this ordinance, or causing, permitting, or suffering the same to be done, shall be guilty of a misdemeanor and upon conviction shall be fined not more than One Hundred Dollars. Each such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this ordinance is committed, continued, or permitted. The issuance or granting of a permit shall not be deemed or con- strued to be a permit for, or an approval of, any violation of this ordinance. _2- ;: / 2 9 _., :-:, _. Section 10. Effective date.
