HomeMy WebLinkAboutORD 1953-130COUNTY OF HAWAII - TERRITORY OF HAWAII ORDINANCE N0. 3 ~ r r, AN ORDINANCE Al[ENDING SECTIONS 2, 18, 20, 21, 23, 24, 39, 42, 43, 5Q, 53, 55, 56.01, 57, 61, 73, 80, ~, 93, 108, 114 OF ORDINANCE N0. 89,0E THE COUNTY OF HAWAII 1950, ADDING NEW SECTIONS DESIGNATED AS SECTIONS 32.01, 38.01, 42.01, 65.01, 79.01, 85.01 THERETO, AND REPEALING ALL OTHER ORDINANCES IN CONFLICT HEREWITH, PERTAINING TO THE REGULATION OF TRAFFIC UPON THE PUBLIC STREETS AND HIGHWAY3 OF THE COUNTY OF HAWAII. BE IT ORDAINED BY THE BOARD OF HAWAII: IN AND FOR THE COUNTY OF That Ordinance No. 89 of the County of Hawaii 1950, as amended, is hereby further amended in the following respects: Section 1. Section 2, as amended, is hereby further amended in the following respects: a. B9 amending Subsection (p) to read as follows: "(p) Authorized emergency vehicles. Vehicles of the fire department, vehicles driven by police of- ficers when responding to emergency calls, gov- ernment vehicles when performing authorized amsr- gency operations, ambulances and emergency vehi- cles of municipal departments or public asri~ice corporations as are designated or authorized by the chief of police." b. Hy adding Subsections (x) and (y) to read as follows: '(ac) Hot rod or racer. A~ vehicle whose shape, design and construction has boon materially altered, the purpose of altering being primarily for the increase in speed of said vehicle. (y) Emergency. Aqy event or unforeseen combination of circumstances calling for immediate action or remedy." Section 2. Subsection (a) of Section 18, as amended, is hereby further amended in the following respects: a. By amending Paragraph 2 to read as follows: "2, In front of or within four feet of either side of a private driveway." b. By adding Paragraph 19, after Paragraph 18, to read as follows: "19. Where a clear view of such stopped vehicle is not available from a distance of txo hundred feet in each direction upon such highway and where the width of the roadway is sufficient for only twq~raffic lanes or lase, provided that official signs are posted prohibiting said parking." ~~~ ~.~ F~~~ ~ ,` ~:' .. I n Section 3. Section 20, as amended, is hereby further amended by repealing Subsection (c). Section 4. Subsection (a) of Section 21, ae amended, is hereby further amended by adding Paragraph 15, after Paragraph 14, to read as follows: "15. Hualalai Street." Subsection (a) of Section 5. /Section 23 ':: ), as amended, is hereby further amended to read as follows: "(a) Tha department of public works of the County of Haxaii is hereby authorized and directed to establish, mark and designate where there is an apparent need therefor, a consecutive series of parking spaces for the parallel or angle parking of motor vehicles. Each such parking space shall extend seven feet six inches in width and twenty-two feet in length." Section b. Subsection (b) of Section 21+, as amended, is hereby further amended to read as follows: "(b) No parson shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pickup and loading of freight or passengers in arty place marked as a loading zone or freight loading zone, during the hours when the provi- sions applicable to loading zones, or to such loading zone, are in effect. In no case shall the stop for loading and unloading of materials exceed thirty-six minutes unless the load is of such size and nature as to require a longer period, in which case the operator shall obtain a special permit from the chief of police for this particular load." Section 7. A nex section designated as Section 32.01 is hereby added after Section 32 to read as follows: "Section 32.01. Special parking privileges. (a) Vehicles of government agencies, public utility com- panies, garages, contractors, or any other person may stand and park contrary to the parking provisions set forth in this ordinance xhen the owner of such vehicle holds a special permit issued by the chief of police granting him such privilege for a limited time. Said permit shall be either in the possession of the driver or on the vehicle at the time. It shall be unlawful for any owner or driver to violate az{y of the specific terms or conditions .of the permit." Section 8. A nex section designated as Section 38.01 is hereby added after Section 38 to read as follows: "Section 38.01. Overtaking and passing school bus. (a) The driver of a vehicle upon a public highway outside of a business or residence district upon meeting or -2- ~:. Af t ~.. overtaking from either direction a~ school bus which has stopped on the highvray for the purpose of receiv- ing or discharging any school children shall decrease the speed of such vehicles and shall proceed peat such school bus at a speed not greater than is reasonable and prudent and in no event greater than ten miles per hour and with due caution for the safety of pedestrians. (b) Every bus used for the transportation of school children shall bear upon the front and rear thereon a plainly visible sign containing the words "SCHOOL BUS" in let- ters not less than 10 inches in height. When a school bus is being operated upon a highway for purpose other than the actual transportation of children either to or Pram school (on school days) all markings thereon in- dicating "SCHOOL BUS" shall bs covered or concealed. (c) The driver of a vehicle upon a highway with separate roadways need not stop upon meeting or passing a school bus which is on a different roadway or when upon a controlled-access highway and the school bus is stopped in a loading zone which is a part of or adjacent to such highway and where pedestrians are not permitted to cross the roadway." Section 9. Paragraph 4, Subsection (a) of Section 39, is hereby amended to read as follows: "4, On any double center-lined roadway, except where the double line consists of a solid line and a broken line and the broken line is on the same side as the vehicle; and when driving into or out of private road or drive- xay." Section 10. Subsection (d) of Section 42, as amended by Ordinance No. 116, is hereby further amended to read as follows: "(d) Whon one vehicle is towing another and the connection consists of a chain, rope, or cable, which is over fifteen feet long, there shall be displayed midway oP such connection a white flag or cloth not lass than twelve inches square," Section 11. Anew section designated ea Section 42.01 is hereby added after Section 42 to read as follows: "Section 42.01. Trailers and towed vehicles, (a) When one vehicle is towing another the drawbar or other emergency connection shall be of sufficient strength to pull all weight towed thereby. (b) When one vehicle is drawing a trailer, semi-trailer, or pole or pipe dolly, there shall be an additional emergency connection between said vehicles sufficient to hold the vehicle being towed in the event the nor- mal connection should break or become disconnected. (c) No person shall operate a train of vehicles when any trailer, semi-trailer, or other vehicle being towed whips or swerves from side to aide dangerously or un- reasonably or fails to follow substantially in the path of the towing vehicle." ;., -3- ,. Section 12. Section k3 is hereby amended in the following rea- pecta: a. By amending Subsection (b) to read as follows: "(b) Approach for a left turn shall be made in that por- tion of the right half of the roadway nearest the center line thereof, and after entering the inter- section, the left turn shall be made so as to leave the intersection in that portion nearest the cen- terline on the right half of the roadway being en- tered." b. By changing Subsections (c), (d) and (e) to Subsections (d), (e), and (f) respectively and adding a new Subsec- tion (c) to read as follows: "(c) Approach fora left turn from a one-way street into a two-way street shall be made as closely se prac- ticable to the left-hand curb or edge of the road- way, and the left turn shall be made so as to leave the intersection in that portion nearest the centerline on the right half of the roadway being entered." Section 13. Section 50 is hereby amended to read as follows: "Section 50. Prohibited left and right turns. (a) When official traffic signs are erected giving notice thereof, no driver oP a vehicle shall make a left or right turn at any signposted intersection within a congested district. For the provisions of thiapara- graph, the chief of police may place or erect signs of a temporary nature during peak traffic hours at any intersection he may deem to be congested. (b) left turns prohibited. 1. Between the hours of 7:00 a.m. and k:30 p.m. of ar{y day, except Sundays and public holidays, the operator of any vehicle shall not make any left turn between intersections in a business district provided that adequate signs and/or markings are placed. The department of public works shall place signs and/or markings as recommended by the police de- partment and the planning and traffic co~~,j,on where a left turn movement into a drivexa create an undue hazard or congestion to a nearby inter- section. 2. No vehicle shall make a left turn at the following designated intersections when official signs are erected giving notice thereof: a. Waianuenue Street into Rainbow Drive (makai intersection). b. Rainbow Drive into Waianuenue Street (mauka intersection). (c) Right turns prohibited. ~, ; „ 1. No vehicle shall make a right turn at the following designated intersections when official signs are erected giving notice thereof. a. Waianuenue Street into Rainbow Drive (mauka intersection). b. Rainbow Drive into Waianuenue Street (makai intersection)." Section 7.4. Section 53 is hereby amended to read as follows: "Section 53. Starting, atopping, turning or backing. The driver of any vehicle before starting, atopping, turning from a direct line, or backing shall first see that such movement can be made in safety. If such movement cannot be made in safety, or if it interferes unduly with the normal movement of other traffic, said driver shall wait for amore favorable opportunity to make such movements. If the operation of another vehicle should be affected by a stopping or turning movement, the driver of such other vehicle shall be given a plainly visible signal, in the manner described in Section I14of this ordinance." Section 15. Section 55, as amended, is hereby further amended by adding Subaectiona (66), (67), (b6) and (69) to read as follows: "(66) Ilima Street in Honokaa. (67) Mails Street in Honokaa. (68) Pikake Street in Honokaa. (69) Kilau Homestead Road in Laupahoehoe." Section 16. Section 56.01 is hereby amended by adding Subaectiona 13 and ]J+ to read as follows: "13. Haihai into Kinoole. 14. Lehi into Ainako." Section 17. Section 57 is hereby amended by adding Subsection c, after Subsection b, to read as follows: "(c) The operator of a vehicle entering a public highway from a private road or driveway shall atop in obe- dience to a stop sign as required by this ordinance when said stop sign is erected at the entrance to the public highway by the county engineer oP territorial highway engineer for the county of Hawaii. 'For the provisions of this section, the county engineer is hereby authorized to erect stop signs at the en- trance to a public highway when the county engineer or the commission determines its need in the interest of traffic safety upon the basis of an engineering and traffic investigation." Section 18. Subsection (b) of Section bl, as amended, is hereby further amended in the following respects: a. By amending Paragraph 4 by adding Subparagraph c and d to read as follows: "c. Mamalahoa Highxap, in Mountain ~iex. 500 feet on the Hilo side of the Kulani Road to a point, -5- .t .~ , ~r;= a measured 300 feet on the Volcano side of the Moun- tain View stables, during the hours of 7:00 a.m. to 8:00 a.m, and 2:00 p.m. to 3:30 p.m.on school days. d. Mamalahoa Highway, in Kurtistown. 300 feet on the Hilo side of the Iwasaki Camp xoad to the 137 mile Homestead Road, during the hours of 7:00 a.m. to 8:00 a.m. and 2:00 p.m. to 3:00 p.m. on school days." b. By amending Paragraph 6, as amended by Section 5 of Ordinance No. 118, to read as follows: "6. Forty-five miles per hour in the following areas: a. Mamalahoa Highway, in Mountain View. 500 feet on the Hilo side of the Kulnn; Road to a point meas- ured 300 feet on the Volcano side of the Mountain View stables, except the hours of 7:00 s.m. to 8:00 s.m. and 2:00 p.m. to 3:30 p.m. on school days. b. Mamalahoa Highway, in Kurtistown. 300 feet on the Hilo side of the Iwasaki Camp Koad to the 13~ mile Homestead Road, except the hours of 7:00 a.m. to 8:00 a.m. and 2:00 p.m, to 3:00 p.m. on school days.' Section 19. Anew section designated as Section 65.01 is hereby added after Section 65 to read as follows: "Section 65.01. Unlaxful to sit on the outer Bide of driver or to obtain view of highway through steering wheel. (a) No person shall operate a motor vehicle with another person to the left of the driver on the drivers asst in a left-hand-drive vehicle or to the right of the driver on the drivers seat in a right-hand-drive vehicle. (b) No person shall operate a motor vehicle when the view of the highway ahead is viewed through the steering wheel or seated so low as to be unable to give a clear hand signal." Section 20. Section 73 is hereby amended to read as follows: "Section 73. Pedestrians' right-of-way in crosswalks. (a) The driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be to so yield to a pedestrian crossing the roadway within any marked crosswallc or within arty unmarked crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger, but no pedestrian shall enter any crossxalk or part of a crosswalk when ve- hicular traffic is so close thereto as to constitute an immediate hazard. (b) Pedestrians shall walk briskly within a crosswalk ao as not to impede the flow of vehicular traffic." Section 21. Anew section designated as Section 79.01 shall be added after Section 79 to read as follows: ~` ~' -6- ,: , ~'{ ;, "Section 79.01. Unlawful to sit, ..kneel, squat or lie on highway. It is unlawful for at~y person to sit, kneel, squat or lie upon arpr roadway, or sidewalk curbing except when overcame by illness or in an emergency." Section 22. The title and Subsection (a) of Section 80 is hereby amended to read as follows: "Section 80. Reconstructed, apecislly constructed and hot rod vehicles. (a) No person shall operate upon arq. street or highway a reconstructed or rebuilt motor vehicle, a specially constructed vehicle, or a hot rod, without first hav- ing obtained a permit for the vehicle from the chief of police." Section 23. Anew section designated as Section 85.01 is hereby added after Section 85 to read as £ollowa: "Section 85.01. Fenders required. (a) Every motor vehicle or trailer shall be equipped with fenders for all wheels. Motor vehicles whose rear wheels are covered by the vehicle body shall not be required to have rear wheel fenders provided that the said vehicles are equipped with a splash or mud guard located to the rear of the rearmost wheals and sus- pended not more than 18 inches from the ground. (b) Fenders stall be in good repair and free of Sagged edges and shall be securely fastened to the vehicle. (c) The provisions of this section shall not be applicable to motorscooters, road machinery, road rollers, farm tractors or implements of husbandry." Section 24. Section 8$ is hereby amended in the following res- pecte: a. By amending the title to read as follows: "Section 88. Lights. No person shall operate a motor ve- hicle upon any highway from thirty minutes after sanest un- til thirty minutes before sunrise unless such vehicle shall have in operation lights as required by the provisions of the Revised Laws of the Territory of Hawaii. Any lighted headlamps upon a parked vehicle shall be depressed or died. b. By adding Subsection (d) to read as follows: "(d) Signal lamp or lamps. 1. Arty motor vehicle may be equipped with signal lamp or lamps. 2. A signal lamp or lamps shall be capable of clearly indicating at~y intention to turn either to the right or to the left and shall be visible and un- derstandable during the daytime and nighttime from a distance of 100 feet both to the front and rear. -7- 1rr,' . 3. When a vehicle is equipped with a signal lamp or lamps, such lamp or lamps shall at all times be maintained in good working condition. 4. No signal lamp or lamps shall pro3ect a glaring or dazzling light." Section 25. Section 93 is hereby amended to read as follows: "Section 93• Signaling devices required on certain motor vehicles. (a) No motor vehicle shall be driven upon any street or highway when the body of the vehicle is so constructed or when the vehicle is so loaded that the operator of the vehicle when sitting directly behind the steering wheel is unable to clearly show the whole forearm from the extreme left of the vehicle or load when indicating a turn or atop signal to both approaching and following traffic, unless such vehicle is equipped with signal lamp or lamps or a mechanical signalling device as ap- proved by the chief of police. (b) All mechanical hand signal devices when required shall be visible at least twelve inches from the extreme left of the vehicle or vehicle load." Section 26. Section 108 is hereby amended to read as follows: "(a) No vehicle shall be driven or moved on any highway un- less such vehicle is so constructed or loaded ae to prevent any of its load from dropping, sifting, leak- ing, or otherwise escaping therefrom, except that sand may be dropped for the purpose of securing traction, or water or other substance may be sprinkled on a road- way in cleaning or maintaining such roadway. (b) No parson shall operate on arry highway any vehicle with any load unless said load and covering thereon is securely fastened so as to prevent said covering or load from becoming loose, detached, or in ar~v manner a hazard to other users of the highway." Section 27• Section 114 is hereby amended to read as follows: "Section 114. Signals on starting, stopping, and turning. (a) Arty stop or turn signal when required herein shall be given either by means of the hand and arm, or signal lamp or lamps, or by a mechanical device of a type approved by the police department, but when a vehicle is so constructed or loaded that a hand and arm sig- nal xould not be visible both to the front and rear of such vehicle than said signals must be given by such lamp or lamps or mechanical signal device. (b) The signals herein required to be given by hand and arm s~~gPillgf''""~rra from the left side of the vehicle in the ~I~ , such signals shall indicate as fol- lows: 1. Right turn. Left hand and forearm extended up- ward with an open palm facing forward and with the thumb side of the hand not less than six inches from the side of the vehicle. ~~: , " _ 2, left turn. Left hand and arm extended horizon- tally. -g.. 3, Stop or decrease speed. eft hand and forearm extended downward showing the palm of the hand to the rear with the thumb side of the hand not less than six inches from the side of the vehicle. 4. Re-entering lane of traffic from parked position. Hand and arm extended horizontally. (c) In a right-hand drive vehicle, the driver shall indi- cate his intention to turn to the left by extending his right hand and arm upward and beyond the right aide of the vehicle; his intention to turn to the right by extending his right hand and arm horizontally from and beyond the right side of the vehicle; and his intention to atop or to suddenly decrease speed by extending his right hand and arm dowrmard from and beyond the right side of the vehicle, showing the palm of the hand to the rear. (d) No person shall stop or decrease the speed of a ve- hicle without first giving an appropriate signal for a distance of fifty feet in a business or residence dis- trict, and one hundred feet outside of said districts, in the manner hereinbefore provided to the driver of aqy vehicle to the rear. 1n the event such signal cannot be given for the said distances required, the driver shall signal as soon as possible until the stop has been made. (e) A signal of intention to turn right or left herein re- quired, whether given by hand-and-arm, signal lamp or lamps, or by a mechanical device shall be given con- tinuously during the last fifty feet traveled by the vehicle before turning in a business or residence dis- trict, and one hundred Yeet outside of said districts.~~ Section 2$.
