BE IT ORDAINEll BY THE BO:1RD OF SUPERVISORS OF THE COUNTY OF HAWAII: SECTION 1. UEFINITIUNS, Whenever in this ordinance the following terms are used, they shall have the meanings respectively ascribed to them in this section. (a) "Sanitary Sewage" is hereby defined as the waste from water closets, lavatories, sinks, bath tubs, showers, household, laundries, bars, soda foun- tains, cuspidors, refrigerator drips, drinking fountains and such other wastes of similar origin and nature. (b) "Industrial Wastes" are hereby defined as being the liquid and semi-liquid waste resulting from any commercial, manufacturing, or industrial operation or processes. (c) "Sanitary Sewage System" is hereby defined as being any one of the systems of lateral sewers, trunk sewers, intercepting sewers, pumping stations, force mains, outfall sewers and other appurtenances for conveying, pumping and disposing of "Sanitary Sewage" and "Industrial Wastes" in the County of Hawaii, Territory of Hawaii. (d) "Bureau of Sewers" as herein used is hereby defined as referring to Bureau of Sewers and Sanitation, Department of Public Works, County of Hawaii. (e) "County" as herein used is hereby defined as referring to the County of Hawaii, Territory of Hawaii. (f) "Dwelling Units" as herein used is hereby defined as any building or part of a building or vehicle designed for or occupied by one or more persons as a single housekeeping unit, and shall include duplexes, apartments, trailers, and other similar dwellings or structures. (g) "Owner" as herein used is hereby defined to include a holder in fee, life tenant, executor, administrator, trustee, guardian or other fiduciary, __ ~.,-~ ... ..., R • .. -- ~- ~.~~-. SECTION 2, DECLAI:ATION OF POLICY, It is hereby determined and. declared to he necessary and conducive to the protection of the public health, safety, welfare, and convenience of the County of Hawaii, to construct, establish, and provide a sanitary sewerage system, and to establish, levy, assess and collect sewer service charges upon all lots, lands, buildings, dwelling units and premises served by connections, either directly or indirectly, with the sanitary sewerage systems, as hereinafter provided, SECTION 3, SCHEDULE OF [LSTES, The tenant or owner of each lot, parcel of land, building, dwelling unit or premises shall be responsible and liable severally and pointly for the payment of the sewer service charge based upon the following schedule of rates: a, Quarterly charge for sewer privilege shall be computed on the basis of the number of fixtures and shall be the sum of the quarterly charges for fixtures, provided, however, the minimum charge shall be $1,00 per quarter per sewer privilege plus $,50 for every fixture in excess of four, SECTION 4, COLLECTION. The sewer service charge levied and assessed pursuant to this ordinance shall he collected by the i3ureau of Sewers. The Board of Supervisors of the County shall prescribe and the Chief Engineer, Department of public Works shell enforce such by-laws and regulations as may be deemed necessary for the regulating, collecting, rebating and refunding of the sewer service charges provided for in this ordinance. SECTION 5. PENALTY, Any person who shall violate or fail to comply with any of the provisions of this ordinance, or who shall counsel, aid or abet any such violation or failure to comply upon conviction, shall be deemed guilty of a misdemeanor and shall be punished by a fine not to exceed $50,00 or by imprison- went not to exceed 30 days, either or both penalties to be imposed at the discretion of the court. _~ SFxTION 6. SEVERABILITY. If any section or provisions of parts thereof in this ordinance shall be adjudged invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity of the ordinance as a whole or of any other section of provisions or part hereof. SECTION 7. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 8.
