HomeMy WebLinkAboutORD 1954-140COUNTY OF HAWAII - TERRITORY OF HAWAII ORDINANCE NO.~ AN ORDINANCE AlOJNDING~SECTIONS 21, 38, 39, l,$, 55, 56, AND 61 OF ORDI- NANCE N0. 89 OF THE COUNTY OF HAWAII 1950, AND ADDING A NEW SECTION DESIGNATED AS SECTION 56.02 THERETO, AND REPEALING ALL OTHER ORDINANCES IN CONFLICT HEREWITH, PERTAINING TO TES REGULATION OF TRAFFIC UPON THE PUBLIC STREETS AND HIGHWAYS OF THE COUNTY OF HAWAII. ~ IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF HAWAII: That Ordinance No. 89 of the County of Hawaii 1950, as amended, is hereby further amended in the following respects: Section 1. Section 21, as amended, is hereby further amended in the following respects: (a) By amending Subsection (b) to read as follows: ~ "(b) Thirty-six minute parking areas: 1. Keawe Street, from Haili Street to Kilauea Street. 2. Kekaulike Street, from Waianuenue Street to Wailuku Drive. 3. Kinoole Street, from Waianuenue Street to Wailuku Drive. 4. Waianuenue Street, from Kekaulike Street to Kinoole Street." (b) By repealing Subsection (c). Section 2. Section 38, as amended, is hereby further amended by adding Subsection (d) after Subsection (c) to read as follows: "(d) On a double center-lined highway, when the solid line 'is on the same side as the vehicle, except where such overtaking and passing can be made in safety and with- out driving to the left of the said solid center line." Section 3. Paragraph 4, Subsection (a) of Section 39, as amended, is hereby further amended to read as follows: "4. On any roadway marked for four or more lanes of traffic except when driving into or out of a private road or driveway.° Section 4. Subsection (a) of Section 48, as amended, is hereby further amended to read as follows: ~.~0 _.. r ~ .., ~ ~° "(s) The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction upon any street in a.>btlainsas district, upon any four-laned highway, or at any intersection where traffic is con- trolled by. traffic signal lights during the hours b®- irwean•6:00 a.m. to midnight of each day with the ex- ception of the following: 1. Intersection of Kamehameha Avenue and Shipman Street. 2. Intersection of ldamalahoa Highway and Haina Road in Honokaa. 3, Intersection of Lihixai Street and Liholiho Street." Section 5. Subsection (c) of Section 55, as amended, is hereby further amended by adding Paragraph 70 after Paragraph 69 to read as follows: "70. Wright Road (FASP 5-253 (1))." Section 6. Subsection (a) of Section 56 is hereby amended by add- ing a paragraph to read as follows: "Entering Mahisi Road intersection from Amaumau Road from a southxesterly direction." Section 7. Anew section designated as Section 56.02 is hereby added after Section 56.01 to read as follows: "Section 56.02. Slow Yield Right-of-way Intersection. When official Slow Yield Right-of-way sign is erected at any intersection, the driver of a vehicle approaching said sign shall slow down to a speed of not more than 10 miles per hour and yield the right-of-way to other vehicles which have entered the intersection or which are approach- ing so closely as to constitute an immediate hazard. If a driver is involved in a collision at any intersee- tio{~ or interferes with the movement of other vehicles af- ter driving past a yield sign, such collision or inter- ference shall be deemed prima facie evidence of the driv- er's failure to yield the right-of-way. To enforce the provisions of this section, the chief engineer or the territorial highway engineer is author- ized to erect said sign with the advice and approval of the Planning and Traffic Commission when the said commis- sion determines that said movement will facilitate traf- fic flow within the intersection, and at the same time provide adequate safety to pedestrians as well as motor- ists." -2- _ - - Section 8. Subsection (b) of Section 61, as amended, is hereby further amended in the following respects: (a) By repealing Subparagraphs c and d of Paragraph 4, as amended by Ordinance No. 130. (b) Dy adding Subparagraph c to Paragraph 4 to read as fol- lows: "c. Haihai Street, from Kilauea Street to Laula Road." (c) By amending Subparagraphs a and b of Paragraph 6, as amended, to read as follows: "a. Mamalahoa Highway, in Mountain View, from a point 500 feet on the Hilo side of the Kulani Road to a point 300 feat on the Volcano side of the Moun- tain View stables, except when the school zone speed limit is in effect. b. Mamalahoa Highway, in Kurtistown, from a point 300 feet on the Hilo side of the Iwasaki Camp Road to the 13~ mile Homestead Road, except when the school zone speed limit is in effect." (d) By adding Subparagraph a after Subparagraph d of Para- graph 6 to read as Yollows: "e. Mamalahoa Highway, from the beginning of FAP F 2(b) to the Hilo entrance of the Hawaii National Park."
