COUNTY OF iIAPJAII:
Section 1. That Ordinance }70. 129 of the County of
Hawaii. 1953, as amended, is hereby further amended by
adding Section 5-A, after Section 5, the said Section 5-A
to read as fol] ovas:
"Section 5-A. Unusual conditions. The Board
of Superv:~sors of the County of 1{awaii. stay, by
resolution, grant variances from the strict app]i-cation.
of the provisions of this ordinance, provided it
first determines, after consultation with the County
Pl.ann].ng and Traffic Commis-=or., th~~t the fo].lewing
conditions are present:
1. The exception nr variance desired
arises from peculiar physical. conditions not
ordinarily existing in sir.~ilar districts in the
city, considering the nature of the '.:usiness of
the applicant.
2. That the exception or variance desired is not
against the public int?rest, particularly safety,
convenience, and general welfare.
3. That the granting of the permit for the
exception or variance ~~!i7.1 not adversely affect the
r-fights of adJacent property owners or tenants.
4. "Chat the strict application, of the terms
of this ordinance rvi].7. ~~iork unnecessary hardship and
practical difficulty on the nr.operty owner or tenant.
Section 2. This ordinance shall. {.aLe effect upon i.ts
approval.
