AN ORDINANCE REGULATING THE SALE, TRANSFER, GIVING,
OVuTJERSIfIP, ACQUISITION, POSSESSION AND USE OF TOY
RIFLES, AND PROVIDING PENALTIES FGR THE VIOLATION
TffEREOF.
BE IT ORDAINED BY THE E30ARD OF SUPERVISORS OF THE
COUNTY OF FIAVJAII:
SECTION 1. Definition. As used in this Ordinance,
"toy rifle" shall mean any weapon using compressed air
or spring as the propelling force to eject therefrom a
projectile in the shape of a ball, pellet or rod of
any type of material or any weapon of similar design,
nature or function, whether usable or unusable,
serviceable or unserviceable, or modern or antique.
SECTION 2. Unlawful for anv minor under the age
of 18_to own, acauire. possess use operate or plav
with a tov rifle. It shall be unlawful for any minor
under the age of 18 to own, acquire by purchase, gift
or otherwise, possess, use, operate or play with a
toy rifle; provided, however, any person under the age
of 18 years, while under the immediate supervision of
an adult, may possess, use, operate or play with a
toy rifle, provided further that it shall not be
lawful for any such person under the age of 18 years,
under any. circumstance s, to possess, use, operate or
play with a toy rifle in any public place, except while
under such supervision upon a bona fide public target
range.
SECTION 3. Unlawful to permit anv minor under the
aqe of 18 to own. acauire possess use operate or
plan with a toy rifle. It shall be unlawful for any
parent, guardian or any other pe~go~ having the care,

custody or control of any minor under the age of 18 to
permit such minor to ovm, acquire by purchase, gift or
otherwise, possess, use, operate or play vaith a toy
rifle, except as otherwise provided in Section 2 of
this Ordinance.
SECTION 4, Unlawful for anv Gerson to sell,
transfer or give a tov rifle to anv minor under the age
of 18. Except as otherwise provided in this Oxdinance,
it shall be unlawful for any person to sell, transfer
or give a toy rifle to any minor under the age of 18.
SECTION 5. Toy rifle forfeited when. All toy
xifles owned, carried or possessed contrary to this
Ordinance shall be forfeited to the County, and shall be
destroyed or retained by the chief of police for use
by and under the control of the police department.
SECTION 6. Penalty. Any person violating any of the
provisions of this Ordinance shall, upon conviction thereof,
be punished by a fine not exceeding Cne Hundred Dollars
($100.00).
SECTION 7. Severability. If any provision hereof
or the application thereof to any person or circumstance
is held invalid, such invalidity shall not affect other
provisions or application of this Ordinance which can
be given effect without the invalid provision or
application, and to this end the provisions of this
Grdinance are declared to be severable.
SECTION 8, L-ffective date. This Ordinance shall.
take effect 30 days from and after its final passage by
the Board of Supervisors. ~C
