HomeMy WebLinkAboutORD 1957-189COUNTY OF HAWAII - TERRITORY OF HAWAII ORDINANCE N0. _ ~~ 9 CREATING DEPARTMENT OF PARKS AND RECREATION; CONFERRING POWERS AND IMPOSING DUTIES UPON SAID DEPARTMENT; CREAT- ING PARKS AND RECREATION CCMMISSIOTJ AND EXECUTIVE CQUMITTEE THEREOF. BE IT ORDAINED BY THE BOARD OF SUPERVI5CRS OF THE COUNTY OF HAWAII: Section 1. Department of parks and recreation, There is hereby created a department of paxks and recreation of the county of Hawaii. The department shall have charge of and shall administer, supervise and maintain all public parks, recreational facilities and playgrounds in the county of Hawaii owned by said county or in its possession or control other than the Municipal Golf Course and Hilo Civic Auditorium, together with all equipment, supplies and paraphernalia used in connection with the same. The department is authorized and empowered to care for the recreational needs in the County of Hawaii and provide such organized and supervised games and recreation as shall be conducive to the mental, physical and moral development of the youth and juvenile population of the county. Section 2. Superintendent; other employees. The department shall be in charge of a superintendent, who shall be appointed and be removable by the eha~rrt~an and e~cutive oftieer of t#~e board of supervisors with the approval of the board of supervisors. The superintendent ' shall have such qualifications as t!r.~ ,;n.~rd may deem necessary and he shall not be subject to the civil service and compensation laws. The superintendent shall have the power to appoint such other employees as may be necessary in accordance with the civil service and compensation laws, He shall be vested with and have, enjoy, perform and be subject to all the powers, duties and functions and liabilities conferred or imposed upon the department by ordinance and such powers, duties and functions as shall be prescribed by the board. Section 3, Yarks and recreation commission, there is hereby created a parks and recreation commission consisting of seven (7) members in each of the following geographical districts in the County of Hawaii: (a) District of North Kohala (b) District of South Kohala (c) District of North Kona (d) District of South Kona (e) District of Kau (f) District of Puna (g) District of Hamakua (h) District of North Hilo (i) City of Hilo (j) District of South Hilo outside of the city of Hilo With the approval of the board of supervisors, the chairman and executive officer of the board of supervisors shall appoint the members of each commission v/ho shall be residents of the geographical districts fox which they are appointed. The members of each commission shall serve without pay, but may be reimbursed for any traveling expenses incurred in the performance of their official duties. Each commission shall annually select its own chairman from the members t`hexeofj;a~d meetings shall be called at the discretion of the chairman, Section 4. Term of office. The term of office of the members of each commission shall be two (2) years; provided, however, that on the first appointment under the provisions of this ordinance, four (4) members of each commission shall be appointed for a term ending at noon on January 2, 1958, and three (3) members of each commission shall be appointed for a term ending at noon on January 2, 1959, thereafter all appointments shall be for two years from the date of expiration of the term for which the predecessors were appointed, Any vacancy shall be filled by appointment for the remainder of the unexpired term. Officers and employees of the territory and county of Hawaii shall not be eligible for membership on the commission, Section 5. Powers of commission. Each commission is authorized and empowered to assist the board of supervisors, in an advisory capacity, in and on all matters pertaining to the supervision and maintenance of all public parks, recreational facilities and playgrounds in the respective districts. Section 6, Executive committee. The chairmen of the ten commissions shall constitute the executive committee of the parks and recreation commissions. The executive committee shall annually select its own chairman from the members thereof and shall meet from time to time at the discretion of the chairman, Section 7. Five (5) members of the executive committee shall constitute a quorum for the transaction of business. -, ,; Section 8, Power, la~~. duti.2~s_.Q.£..s~ecutive committee. It shall be the duty of the executive committee to coordinate the functions and resources of the various parks and recreation commissions throughout the county for the purpose of developing and utilizing all available parks, playgrounds and recreational facilities for the advancement and improvement of recreational programs. Subject to the approval of the board of supervisors, the executive committee may make rules and regulations to carry into effect the provisions of this ordinance. Section 9. Repeal. County of Hawaii Resolution Nos. 78 of 1939, 99A of 1941, 698 of 1942, 466, 467 and 468 of 1945, 131 of 1947, 545 of 1948, 65 and 66 of 1951, 287 of 1956 and 177 of 1949, and all other resolutions inconsistent with this ordinance are hereby repealed.
