ORDINANCE N0.
AN ORDINANCE AMENDING ORDINANCE N0. 173 OF THE COUNTY
OF HAWAII PERTAINING TO REGULATING THE COLI:ECTION AND
DISPOSAL OF REFUSE WITHIN THE CITY OF HILO; REGULATING
THE DISPOSAL OF DEAD ANIMALS AND OTHER MATERIALS WITHIN
THE COUNTY OF HAWAII AND PROVIDING PENALTIES THEREFOR.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY
OF HAWAII:
That Ordinance No. 173 of the County of Hawaii is
hereby amended in the following respect:
Section 1. Section 4 is hereby amended to read
as follows:
^Section 4. LOCATION OF REFUSE AND RECEPTACLES.
All refuse and receptacles, as hereinbefore mentioned,
shall be kept on private premises and shall not be placed
upon any sidewalk or government right of way for collection
purposes, excepting however, refuse receptacles that may
be placed and affixed on any sidewalk or government right
of way for public use; provided, however, that for the
purposes of collection, such refuse and receptacles may
be placed in that area of the private premises adjacent
to the sidewalk or the government right of way and the
refuse and the receptacles so placed adjacent to the
sidewalk or the government right of way shall be
placed so as not to constitute or contribute to the
creation of a nuisance or to the creation of a pedestrian
or traffic hazard.^
Section 2. This ordinance shall take effect upon
its approval.
