HomeMy WebLinkAboutORD 1960-005 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NC. ~ AN ORDINANCE CREATING A DISASTER COUNCIL AND PRESCRIBING ITS POWERS, DUTIES AND FUNCTIONS. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COllNTY OF HAWAII; Section 1. Creation of Disaster Council. There is hereby created a disaster council which sha 1 consist of the Chairman and Executive Officer of the County of Hawaii as Chairman, the head of a department of the County of Hawaii, to be selected by the Chairman and Executive Officer of the County of Hawaii, as Vice Chairman, the Chief of Police of the County of Hawaii, the Chairman of the Disaster Committee of the Hawaii Chapter of the American Red Cross, the Fire Chief of the Hawaii Fire Department, and the County Health Officer of the County of Hawaii, and such other persons as the Chairman and Executive Officer of the County of Hawaii may deem necessary to be appointed by the Chairman and Executive Officer of the County of Hawaii, with the approval of the Board of Supervisors, for a term of office to be the same as the appointing power. Any vacancy in the office of an appointed member shall be filled for the remainder of the unexpired term. Section 2. Disaster Defined; Declaration of Emer enc . A disaster is a situa ion, usually catas rophic in nature, w ere numbers of persons are plunged into helplessness and suffering and, as a result, may be in need of food, clothing, shelter, medical care and other basic necessities of life. When five (F) or more families are so affected by such a situation, the Chairman and Executive Officer of the County of Hawaii may declare an emergency to exist. Section 3. Duties of the Council. It shall be the duty of the council to undertake the coordination of all the resources of the County of Hawaii, together with the resources of the various persons, firms, associations and corporations doing business or located in the County of Hawaii, and by means of mutual cooperation and effort create a plan which would permit an effective and efficient method of utilizing all available resources and materials for the relief and the general welfare of the people of the County of Hawaii in the event of a disaster. Such plan is to be prepared by the council and transmitted to the Board of Supervisors for approval within ninety (90) days after the adoption of this ordinance, and reviewed by the council and re-submitted to the Board of Supervisors for approval before the 31st day of March of each year thereafter. The council shall act in accordance with all laws to which the County of Hawaii is subject and each and all members of said council shall diligently undertake to acquaint himself with and become familiar with the responsibilities imposed upon him in the event of such disaster. Section y. Duties of Chairman and Executive Officer. The Chairman and Executive Officer of t e County of Hawaii shall have the power, when a disaster exists and ir. the event Ori. N~...._ ..................._.~ Deb. ----- ------ - -...-__..-_-..- of the declaration of such emergency, subject to existing laws, to obligate the County of Hawaii for the payment of any and all supplies, equipment, materials, food or other necessities that may be required for the purpose of alleviating suffering to people of the County of Hawaii who have been affected by the disaster and for the purpose of protecting persons and property from the hazards inherent in the disaster. Should the Chairman and Executive Officer of the County of Hawaii be absent from the County of Hawaii or disqualified or unable to act for any reason the powers and duties imposed upon him by the provisions hereof shall be vested in the Chairman and Executive Officer prc tempore of the County of Hawaii. Section 5. Coordinator. The Chairman and Executive Gfficer of the County of Hawaii, with the alproval of the Board of Supervisors, may in the event of a disaster appoint a coordinator who shall serve for such term as the emergency exists and at such salary as shall be determined by the Board. The coordinator, subject, to the Civil Service Laws and with the approval of the council, may appoint such assistants and such clerical, stenographic and other employees as shall be deemed necessary and for which appropriations shall be made by the Board. The coordinator shall serve during the period of his appointment as secretary of the council and it shall also be his duty to act as a liaison officer between the various agencies or departments of government affected by this ordinance. Section v. Functions. The plan prepared by the council shall cover the fo owTT- ing functions, and such other functions as may from time to time be deemed necessary; I. Headquarters. The headquarters of the council shall be in the o~ unty Building, at Hilo, Hawaii, and in the event of the declaration of any emergency it shall be the duty of the Chairman and Executive Officer of the County of Hawaii to notify all members of the council of said declaration and all such members of the council shall forthwith assemble at the County Building or such place as may be designated by the Chairman and Executive Officer of the County of Hawaii. The Council may make such rules and regulations as it may deem necessary for the purpose of putting the plan con- templated hereby into full force and effect; provided, however, that no person shall be paid any compensation for any service rendered hereunder except as expressly provided for in this ordinance or an ordinance for such purpose. Section 8. Declaration of Necessity. It is hereby declared that this Ordinance is necessary to protect health, life and property and to preserve and enforce the good government, order and security of the County of Hawaii and its inhabitants. Section y. Severability. If any section, sentence, clause or phrase of tFis ordinance or its application to any persons or circumstances is for any reason held to be un- constitutional or invalid, the remaining portions of this ordinance or the application of this ordinance to other persons or circumstances shall not be affected.
