_ (3) No such vehicle, whose "rated seatinn capacitor",
as above determined, shall include standing passengers therein,
shall. be permitted to carry p=ts;engers in excess of i.ts actual
passenger seating canacity (as. I~_stinrnt~shed from its "rated
seating canacity") within any area of the Count~~ of ;Lswaii
outside the geogr.3phical limits of t}e Ci}-y ~f Ai1o; provided

Section 2. CHIL,DREI`I. ~~ child under the age of five (5)
years not necurving seating space shall not he considered a
passenger within the meaning ~f this 'ordinance.
Section 3. NO LICENSE T~"~ rF IC9[TED IN EXCi;SS ~?F R.~1TED
CApACITy, No license shall T,e issued in the County of Hawaii
under Section 155-111_, Revised Laws of Hawaii, 1.955, for any
such motor vehicle common carrier ~f passengers allowing for
the carrying of passengers of a number in excess of the rated
seatinn canacity of the vehicle, as ar~ove determined.
Section 4. "XAP.TINF.R ,?F CF~AUFFEURS Tf? DFTERb;INI: SEATING
CAPACITY. The Examiner ~f Chaeuffeurs of the Police Department
of- the County of I?awaii. shall measure tr~.e seating :,pace of
every such vehicle common carrier and shall determine the
seatinn caracit~~ of such vehicle.
Section 5. SE'1TING CAPACITY T~' 1?E PAINTED CIId VTHICLE.
The seating eaz~scity of each vehicle, excert a sedan operated
as a taxicaT,, shall. he painted in numerals at least six (F)
inches high upon the right exterior of such vehicle, in such
place and color as the Examiner of Chauffeurs shall. direct;
also the seatincx canacity of each veh~_cle .shall he indicated
in numerals two (2) inches higr, panted in the urger right
corner of the windshield, such mtmera L> shall }'e tainted nn
the inside of the windshield ~n sus} a manner as to k>e readily
lenihle from the inside of the vehicle.
Section 6. PENALTY. If any such motor vehicle common
carrier of passengers or~erating upon or using the nubl.ie streets
or highways of the County of P:awaii. shall. carry passengers
(including the chauffeur) in excess of the rated seating
capacity, tl!e chauffeur thereof shall he rntilty of a misde-
meanor and shall. bd1e punished by fine not to exceed Five
Fundred Dollars (JJJOO.QO).
