HomeMy WebLinkAboutORD 1960-010 COUNTY OF HAWAII - TERRITORY OF HAWAII GRDINANCE NO. tU AN ORDINANCE PROVIDING FOR THE REGULATING OF THE CONSTRUCTION AND EQUIPMENT, OPERATION AND RESPONSIBILITY OF DRIVERS, AND INSPECTION OF EQUIPMENT OF SCHOOL BUSSES AS DEFINED BY THE PROVISIONS OF SECTION 37-23 OF THE REVISED LAWS CF HAWAII, 1955. BE IT ORDAINED BY THE BOARD OF SUPER'JISORS OF THE AUNTY OF HAWAII. Section 1. Definition. As used in this Ordinance, the following words sha 1 have the meanings ascribed to them in this section unless otherwise indicated by the context. "School Bus" shall have the meaning prescribed by Section ~ ,3f-23 of the Revised Laws of Hawaii, 1)55. "Driver" shall mean any person in actual physical control of a school bus. "School bus operator" shall mean and include every natural person, firm, copartnership, association or corporation, binding itself into contract with the County of Hawaii to furnish trans- portation of school children to or from school as provided by the said provisions of Section 37-2'i of the said Revised Laws of Hawaii, 1555. Section 2. Construction and Equipment of School Busses: (a) No vehicle shall be used as a school bus unless the police department of the County of Hawaii shall have determined that it is safely constructed. (b) Gasoline tanks shall be located entirely outside that part of the school bus utilized for carrying passengers and shall be separated from the remainder of the bus by fireproof material. Each gasoline tank shall be equipped with an inlet for filing on the exterior of the bus. (c) The placement and installation of exhaust pipes of each school bus, shall be as approved by the police department of the County of Hawaii. Every school bus shall be constructed and maintained as to prevent exhaust gasses from entering the vehicle through the floor. (f) No aisle in a school bus shall be less than twelve inches in width. The ceiling of all school busses must be free from all projections likely to cause injury to a pupil. The ceilings over the aisle and backrest of seats of a school bus must be free from projections of any kind. (g) No seats for pupils shall be placed ahead of a line drawn crosswide of the bus immediately back of the driver's seat. (j) It shall be unlawful for the driver of a school bus to carry on unnecessary conversation while the said bus is in motion. (k) No driver shall work as an operator or be otherwise employed for more than twelve hours in any 2l}-hour period. (1) Every school bus shall be cleaned daily and kept in a sanitary condition at all times. (m) No driver while transporting school children shall leave his bus while the engine is running or the brakes are released. O eration of Busses and Res onsibilit oz urLVC~~• (b) When any accident or damage occurs to or defect develops in the bus so as to make it unsafe for traveling, the driver shall immediately thereupon discontinue the use of the bus, and he shall make all necessary arrangements for the safe transportation of the pupils to and from their respective destinations. (c) If any school bus is at any time found or known by the driver to be dangerous or unsafe for• operation or reported by anyone to the driver as being dangerous and unsafe, the use of such school bus for the transportation of pupils shall be discontinued immediately thereupon, until properly examined, and if necessary, repaired, and the certification that the bus is in a safe condition must firstly be obtained in writing from an CffiCial Inspection Station a pointed by the Chief of Police or a police o _icer of he County of Hawaii. -~ (d) No school bus shall be put in reverse, or be backed while cn the school grounds er at any point or place where children enter or leave the bus unless such movement can be made in safety. (f) No person shall operate a school bus when it is so loaded or when any person is so seated as to interfere or obstruct the vision of the, driver to the front, side, or, by means of the mirror, to the rear, or interfere with the operation of the bus. (g) The driver of the school bus shall bring the bus to a full and complete stop at all railroad crossings at least six feet and not more than ten feet from the nearest rail and must not proceed until he has ascertained that the traffic is clear in both directions and that the bus may proceec; safe'Ty:' .4f ter making the stop provided for in this rule, the bus shall be driven in low gear across the tracks. (h) No school bus shall be operated with the clutch disengaged except when coming to a stop, or with the gears in neutral except when the bus is not in motion. (i) Smoking by .t he bus driver shall be prohibited whenever pupils are being carried. (j) No intoxicating liquor shall at any time be carried in a school bus or upon the person of the driver. (1) Pupils being transported in a school bus shall be under the authority and control of and responsible directly to the driver of the bus. Continued disorderly conduct, or persistent refusal to submit to the authority of the driver shall be sufficient reason for refusing transportation to any pupil and for such other punishment as the local school regu- lations may provide.. The driver of any school bus shall be held responsible for the orderly conduct of pupils transported and shall immediately report cases of misconduct to the principal of the school. (m) Whenever a school bus steps to discharge pupils who must cross the street or highway in order to reach their destination, such pupils must cross the street or highway in front of the bus, except that when it is not practicable to cross the street or highway in front of the bus, pupils, may be permitted to cross behind the bus. IN EITHER CASE, THE BUS SHALL NOT BE MOVED FROM SUCH POINT UNTIL ALL PUPILS HAVE CROSSED THE STREET OR HIGHWAY. 1N EITHER CASE, ALSO, IT SHALL BE THE RESPONSIBILITY OF THE DRIVER TO SEE THAT PUPILS DO RIOT CRC SS THE STREET OR HIGHWAY UNTIL THEY MAY SAFELY DO SO. (n) All doors shall be kept closed while the bus is in motion. (o) A school bus stopping to load or discharge pupils outside the city of Hilo shall stop as far to the right of the roadway as possible whenever such stop can be made with safety. Section Inspection of Equipment; (a) The Chief of Police of the County of Hawaii or his duly authorized subordinates, which shall include Official Vehicle Inspection Stations, shall, before any passenger license is issued to the said bus, inspect the bus for which a license is requested, and if he finds the same to be in good serviceable and safe condition for the safe transportation of passengers, he shall deliver to the applicant therefor a certificate setting forth the fact that the said bus has been inspected and found to be safe for the transportation of pupils. (b} All vehicles used for the transportation of scYiool children shall be subject to a thorough inspection monthly, by the Police Department of the County of Hawaii or any Official Inspection Station so designated and authorized by the Chief of Police. When a vehicle has been so inspected and found to be in a satisfactory operating condition, the department of inspecting station shall issue a certificate of inspection, which certificate shall include a check list rinted on the reverse side, certifyin~_as to t e equipment and mechanisms checked, and certifying to the adequacy and saf-ety o~-tie vehicle and equipment. No vehicle without such a certificate shall be used and no claims for the transportation of school children will be paid unless accompanied by such a certificate of inspection. Penalties: Any person convicted of a violation of any provision of this ordinance shall, in addition to the penalties provided by contract, be punished by a fine of not more than five hundred dollars.
