Section 1. DEFINITIONS. 'wherever in this Ordinance the
following terms are used, they shal] have the meanings respec-
tively ascribed to them in this section.
(a) "Taxicab" shall mean and incl~.ide any motor vehicle
desicxned to carry seven passencxers or less, operating
for hire solely nn call or demand from a fixed stand
~~ i'-~ within the georrraphical li.mi.ts of the county of Hawaii,
and accepting a passenger or passengers with or with-
out bagcrage for transrortati_on between such points as
'~'~'" may be directed by the passena,e.r or passengers, the
characs for service heina based upon the distance
traveled, plus waitincr time.
The term "taxicab" shal] not include: (1? ~ight-
seeing buses, (2) Fuses employed solely for trans-
portincr school children or teachers, (3) Motel. buses
one rated solely between s+~amship piers, airnlane
terminals or hotels, (4) 'bartered buses, (5) P7otor
vehicles rented or hired c.n a "U-Drive" or "Drive-
~'ourself" basis.
(b) "Chief of Police" shall mean the Chief of Po1i_ce or
the examiner of chauffeurs of the County of Hawaii.
(c) "Passenger" The term "passencxer" shall not include
the operator of the taxicab nor any child under the
acre of 5 years not occupvina seating space..
Section 2. ~S[TSPENSION AND RF'V~~CATI')N '?F PERMITS. Any
permit issued pursuant to the provisions of this Ordnance may
be suspended or revoked by a court of competent jurisdiction;
provided, however, that the decision or order of the third
circuit court shall he final whenever:
(a) The holder of such permit is found to be discDialified
by any of the provisions of this Ordinance;
(h) The holder of such permit has been convicted for a
violation of the pm visions of this (irdinance;
(c) The holder of such. permit shall have ceased to drive
a taxicab for a period of thirty consecutive days
-without nrevious]~~ having filed with the Chief of
Police a caritten notice of intention to cease such
drivinrr and havina been Granted permission by the
Chief of Police authorising the cessation of operation
or drivinr.,
(d) It shall appear that a person to whom a permit is
issued does not wort as a taxicab driver as his
principal. occupation;
(e) The holder of such Hermit has been convicted of
driving while intoxicated or of vio]atina the pro-
visions of Chapter 52 of the Revised Laws of Hawaii.,
1°55, or the provisions of tl-e Federal Narcotics Laws.

Section. 3. DRIVER'S PERMITS. (a) It shall he unlawful
for any person to drive a taxicab without first obtaining a
Hermit from'the Chief of Police. Such permit shall he placed
in a prominent place within the taxicab being driven by the
person to whom it was issued. Such permit shall bear a serial
number, the name of the person, his address, and a recent
photograph of himself, said photograph to be no less than 3
inches in height and 2 inches in width.
The Chief of Police may impose such rules and regulations
regarding the exercise of such driver's Hermit as he may deem
necessary for the safety and welfare of the general public.
(b) No permit shall. he issued to any person unless he shall:
(1) Have a reasonable knowledge of the traffic laws
of the county of Hawaii.
(2) Have a reasonable knowledge of the locations of
streets, roads, and highways, and of important
county and strte buildings and places
orithin the County of Hawaii.
(3) Tae able to speak and understand the English
language well enough to converse satisfactorily
with English speaking people; provided, however,
that the provisions of this paragraph shall- not
apply to any applicant whose. sole occupation for
the past 10 year period prior to the enactment
of this ordinance has been that of a taxicab
driver.
(c) No person shall. he issued a driver's permit unless he
shows that his sole occupation. will. be that of a taxi-
cab driver.
(d) Every Hermit iss~~°d under this section shall expire,
unless otherwise revoked or cance']ed, one year after
the issuance thereof and shall bE renewed on or before
its expiration date upon re-examination; provided,
however, that the Chief of Police may in his discretion
waive examination upon renewal. of such Hermit.
Section 4. APPEAL TO CIRCUIT JUDGE. Any applicant who
has been refused a driver's permit after at least three exami -
nation, or who has been refused any examination, may anneal from
such refusal to the rircnit judge at chambers of the third
circuit court by filing his petition in such court within twenty
days of the date of -the refusal; pm vided, however, that the
appeal shall not operate as a stay to t:he order or decision
appealed from. The appeal sha71 he subject to such procedure
and rules as may be prescribed by t]ie curt and the decision of
the circuit judge shal.]. be final.
Section S. CRUISING PF2OH7F3TTED. No driver of a taxi_r.ab
shall cruise in search of patronage at any time. For the purpose
of this section the term "cruising" sha]1 mean the movement or
standing, when not engaged, of taxicabs, over or on the public
streets of the city of Hilo in search. of or soli_citinq prospec-
tive passengers; provided, however, that a driver of a taxicab,
o~rhen returning by the most direct route, after having discharged
a passenger or passengers, to the garage ~~r stand where said
taxicab is rernzlar]y stationea, ma~.~ stor to pi.ek un a passenger
or passengers only if and ,~~hen hailed by such passenger or
passengers for that rntrnose.
