SECTION 4. LOCATION OF REFUSE AND RECEPTACLES. All
refuse and receptacles, as hereinbefore mentioned, shall be
kept on private premises and shall not be placed upon any
sidewalk or government right of way for collection purposes,
excepting however, refuse receptacles that may be placed and
affixed on any sidewalk or government right of way for public
use; provided, however, that for the purposes of collection,
such refuse and receptacles may be placed in that area of the
private premises adjacent to the sidewalk or the government
right of way and the refuse and the receptacles so placed
adjacent to the sidewalk or the government right of way shall
be placed so as not to constitute or contribute to the
creation of a nuisance or to the creation of a pedestrian or
traffic hazard.
SECTION 5. LICENSE REQUIRED. It shall be unlawful for
any person, firm, or corporation to engage in any business
involving the collection and removal of any refuse from any
premises within the limits of the City of Hilo, County of
Hawaii, without having first secured a license from the
Treasurer of the County of Hawaii so to do.
SECTION 6. VEHICLES FOR REMOVING REFUSE. ;111 vehicles
used for the collection and removal of refuse shall be kept
in a clean, inoffensive and sanitary condition. All refuse
shall be handled and hauled in such a manner so as to prevent
the scattering, spilling or leaking of the same.
SECTION 'I. DEAD ANIMALS. Every owner of dead cattle,
horses, mules, goats, dogs, cats and similar animals within
the County of Hawaii shall properly bury, burn or dispose of
such dead animals within a reasonable time after death, or
before the same shall constitute a nuisance.
SECTION tS. ':dRECKED, NGN-OPEKATIONAL AUTOMOBILES AND
SCRAP IRON. It shall be unlawful for any person, firm or
corporation within the County of Hawaii to leave, abandon or
place wrecked or non-operational -automobiles or construction
equipment or parts or portions of such automobiles or construc-
tion equipment, or scrap iron, or other similar materials,
upon any part or parts of the public streets, roads or highways
or upon any premises of another.
SECTION y. REMOVAL OR DOGRS OF fiBANDONED REFRIGERATORS,
ETC;. It shall be unlawful for any person, firm or corporation
within the County of Hawaii to abandon refrigerators, ice-
boxes, wardrobe trunks; or any other container, equipment or
appliance having self-locking doors without rust removing
and detaching the doors or covers from the same.
SECTION lu. EXPLOSIVES, Ab1MUNITION, ETC. It shall be
unlawful for any person, firm or corporation within the County
of Hawaii to dump, place or remove to any County Dumping
grounds any explosrves, blasting materials, fuses, live
ammunition or any other substance or material that may explode
upon contact with heat or fire.
SECTION 11. DUMPING REFUSE IN VACANT LOTS, ETC. It
shall be unlawful for any person, firm or corporation within
the County of Hawaii to dump er place refuse in or upon any
vacant lot, public place or in or upon the premises of another.
SECTION 12. PENALTY. Any persor, violating any of the
provisions of this Ordinance shall be guilty of a misdemeanor
and upon conviction shall be punished by a fine not exceeding
five hundred dollars ($500.00). ~ 7
SECTION 13. VALIDITY. If any section, sentence, clause
or phrase of this Ordinance, or the application thereof to
any person or circumstance is for any reason held to be
unconstitutional or invalid, the remaining portions thereof
or of the portion concerned to any other persons or circum-
stances shall not be affected.
