AN ORDINANCE ADOPTING THE "UNIFORM BUILDING CODE, 1946 EDITION,"
BY REFERENCE, IN TOTO, WITH CERTAIN SUBSTITUTIONS THERETO.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF
HAWAII:
Section 1. The "Uniform Building Code, 1946 Edition,"
and all-subsequent revisions thereof, are hereby in pursuance
of Act 193, S.L.H. 1947, enacted into an ordinance known as
the "Building Code" of the County of Hawaii, except as herein-
after provided.
Section 2. Wherever the word "state" or "city" is used
in the "Uniform Building Code, 1946 Edition," it shall mean the

~b~ Section 3. In lieu of Section 301 (c), Chapter 3, of the
~`~'~, "Uniform Building Code, 1946 Edition," the following is hereby

"(c). Plans and Specifications. Each application for a
F'+' permit shall be accompanied by two sets of plans and specifi-
cations.
"Exceptions. Plans and specifications need not be
submitted for restoration of plaster, papering, paintings
or small and unimportant work when the small and unimpor-
tant work shall not exceed $250.00."
Section 4. In lieu of the third sentence of the first
paragraph of Section 302 (a) of the "Uniform Building Code,
1946 Edition," the following is hereby substituted:
"If the Building Official is satisfied that the work
described in an application for permit and the plans filed
therewith conform to the requirements of this Code and
other pertinent laws and ordinances, he shall prior to
issuing a permit therefor require the applicant to obtain
the approval of the Board of Health in writing; provided,
all applications for permits for the erection, alteration
or removal of any buildings for public assembly in the
County of Hawaii must first be approved in writing by the
Chief of the Hilo Fire Department."
Section 5. In lieu of the first paragraph of Section
1002 (b), Chapter 10 of the "Uniform Building Code, 1946 Edition,
the following is hereby substituted:
"b. Special Provisions, Public garages shall have
exterior walls of not less than one-hour fire resistive con-
struction; provided, however, that in Fire Zone III, Type IV
construction may be permitted if the walls of the structure are
twenty feet or more from adjacent property lines except street

fronts; and twenty feet or more from adjacent buildings on
the same property."
Section 6. In lieu of Section 1601 (a), Chapter 16 of the
"Uniform Building Code, 1946 Edition," the following is hereby
substituted:
"General (a) Fire Zones. There shall be Fire Zones One,
Two and Three in the County of Hawaii, as outlined in Ordinance
No. 16 of the Revised Ordinances of the County of Hawaii 1960."
Section 7. In lieu of the Exceptions 1, 2 and 3 in Section
~2U4, Chapter 22 of the "Uniform Building Code, 1946 Edition," the
following are hereby substituted:
"Exceptions: 1. Interior and exterior bearing walls in
one-story building may be supported on piers.
"2. For Type V buildings, isolated piers of wood, solid
masonry or concrete may be used for post and girder construction.
"3. Wood Frame Type V buildings may be constructed of
single one (1) inch nominal thickness board walls without studs
for one (1) story in height where there are cross partitions for
at least every thirty (3U) feet of such wall. Two-story wood
frame Type V buildings may be constructed of single wall for the
upper story, but shall be supported by studded walls below.
Studding shall be not less than two by three (2 x 3) inches, and
shall be so braced to amply carry the loads imposed;"
and in addition thereto the following is included:
"When wood frame dwellings are supported by posts, knee
bracing shall be provided of sufficient strength to stabilize the
structure against movement from wind pressure in any direction.
Single wall construction shall be braced with not less than two
by six (2 x 6) belt course between the floor and the ceili.ng."
Section 8. Chapter 45 is hereby amended to read as:
In lieu of the second paragraph of subsection (b) of Section
45US, Chapter 45 of the "Uniform Building Code, 1946 Edition,"
the following is hereby substituted:
"A marquee projecting more than two-thirds of the distance
from the property line to curb shall be not less than ten (lU)
feet, above the ground or pavement below."
Section 9. In lieu of subsections c and e of Section 4505
Chapter 45, of the "Uniform Building Code, 1946 Edition," the
following is hereby substituted:
"c. Length. A marquee projecting more than two-thirds the
distance from the property line to curb line may extend the full
length of the building along direction of the street.
"e. Construction. A marquee shall be supported entirely
from the building and construction as specified under Types of
Construction. Marquees shall be of the same tare resistive

quality as the building it is attached to, except in Fire Zones
I and II wt;ere it shall be of non-combustible material or of not
less than one-hour fire resistive construction."
Section lU. Subsection (e) of Section 506 of the Building
Code is hereby amended to read as follows:
"(e) Separation on all sides. Where public space, streets
or yards, more than twenty feet (2U') in width, extend on all
sides of one and two-story buildings and adjoin the entire
perimeter, the areas specified in Section 5U5 may be increased
at a rate of five (5) per cent for each foot by which the minimum
width exceeds twenty feet (2u'). Such increases shall not exceed
one hundred (lUU) per cent, except for buildings of Group G
occupancy; provided, however, that in Fire Zone 3, such increases
may exceed one hundred (lUU) per cent but shall not exceed four
hundred (4UU) per cent for single story buildings of Type IV or
better construction."
Section 11. Declaration of legislative intent. It is hereby
declared that a public emergency exists in the City of Hilo
because of the seismic wave of May 23, lU6U, which has caused
extensive destruction and devastation to the City's industrial,
business and residential districts. Many lives have been lost
and property damages are estimated to run into millions of dollars.
It is a significant fact that during the past fourteen (14) years
the City of Hilo has been stricken by two catastrophic seismic
waves. In an endeavor to spare the people of Hilo from losses
and damages arising out of future seismic waves, it is the
intention of this Board of Supervisors in the interest of public
welfare and safety to seriously consider and act upon a proposal
to set aside a strip of area bordering the bay of Hilo as a
safety zone. In order that said proposal can be given the fullest
consideration, it is the intent and purpose of this ordinance to
suspend the issuance of building permits for certain buildings
or structures within the devastated area for a trmitea pe n.od.
Section 1L. Suspension of permits. Notwithstanding any
provision in this ordinance to the contrary, in those areas in
the City of Hilo directly affected by the seismic wave of May 'L 3,
1b6U, the issuance of building permits to erect, construct,
enlarge, alter, repair, improve or convert any building or
structure shall be suspended for a period of three (s) months
from June 2y, 19bU; provided, however, that the provisions of
this section shall not apply to:
1. Those buildings or structures used or to be used for
public utility purposes.
L. Those buildings or structures which sustained less than
bu°f, damage to their structure from the seismic wave. Such
buildings or structures may be restored up to lUU°Jo of their
pre-seismic wave condition.
s. Those buildings or structures used or to be used in the
fishing industry.

4. Those buildings or structures constructed or to be
constructed for business purposes on a temporary basis; provided,
however, that the owners or occupants the reoY shall remove or
tear down the temporary buildings or structures within three (3)
months arter HB 1, Special Session oY the Legislature, 1960,
is signed by the Governor or a later date as fixed by the Board
of Supervisors by resolution requiring one reading. The county
building oYYicial is authorized to issue building permits Yor
temporary buildings or structures and such permits shall clearly
state that the temporary buildings or structures shall be removed
or torn down within the period specified herein. The provisions
of the Uniform Building Code 1946 Edition relating to structural
requirements shall m t be applicable to temporary structures or
buildings constructed pursuant to this section.
Section 13. Determination of damages. For purposes of
Section 12 the county building official shall determine the extent
of damages.
Section 14. Building permit fees. Notwithstanding the
provisions of Section 303 of the Uniform Building Code 1946
Edition, relating to building permit fees, any person, firm or
corporation which sustained any damage from the seismic wave
of May 23, 1960, shall pay no more than one dollar ($1.00) in
permit fee for each building permit for a period of one (1)
year from June 29, 1960.
