AN ORDINANCE PROVIDID7G FOR. TEMPORARY USE PERMITS IN T}1E
CITY OF HILO FOR BUSINESSES TF{AT WERE AFFECTED I3Y THE
MAY 23, 1960, SEISMIC WAVE.
BE IT ORDAINED BY THE P.~OARD OF SUPERVISORS OF THE COUMY
OF HAS"dAII:
Section 1. Purpose. To afford any person, partnership,
or corporation in the City of Hilo that was affected by the
May 23, 19e~0, Seismic 65'ave the opportunity tc temporarily
relocate its establishment without regard to Crdinance
No. 45, the Zoning Ordinance, in order that such business
be cari:ied on until appropriate locations are found for
permanent re-establishment.
Section 2. Applicability, This ordinance shall be
applicable only to these persons, partnerships, and
corporations that were directly affected by the May 23,
1960, Seismic Rlave.
Section 3. The Planning and Traffic Commission shall
issue oT authorize its Director to issue Temporary i)se
Permits of ninety (90) days duration upon proper application
upon such foams as prescribed and provided by said Planning
and Traffic Commission.
Section 4, All Temporary Use Permits shall be issued
subject to appropriate conditions and safeguards with due
regard to the type of comme.r.cial establishment and the
intended tempoxa~:y location. Factors includi.ny but not
limited to those such as ingress and egress of vehicles,
hours of operation, number of employees, noise, smoke,
fumes, and other obnoxious elements shall be give^ the
fullest consideration in delinc-ating said conditions and

safeguards.
Section 5. Extension of Permits. Permits may be
renewed at the expiration of the ninety (90) day period
for further periods of sixty (60) days each, Extension
may be granted upon proper showing of unavailability of
appTOpriate lands or buildings in a conforming area, or
extreme personal hardship.
Sectio^ 6. Revocation of Permits. All permits issued
pursuant to this Ordinance shall be subject to r.•evocation
at any time for non-cempliance v~~ith the conditions and
safeguards attached thereto, or foT non-compliance with
this O~•dinance,
Section 7. ~A;ithin ninety (90) days after the
expi,:atien of any permit issued herein, any temporary
structure allow.~ed by said permit shall be converted to a
confo.r.ming use or Removed, and any use permitted herein
shall cease upon the expiration of a permit.
Section u, r;ppeal. zany decision or action of the
Planning and Traffic Commission or its Director may be
appealed to the Eoard cf Supervisors.
Section 9. The provisions of Ordinance No. 60,
The Building Code, shall not be applicable to the temporary
structures or alterations constructed pursuant to this
Ordinance, provided that the applicant shall obtain a
building permit from the building official and shall

Section 11. Penalty. Any person, partners}~ip, o~:

pt~ovisions of this Ordinance shall be punished by a fine
not exceeding Five Hundred Dollars (;00.00).

its approval.
