ORDINANCE N0. 66
AN ORDINANCE AMENDING SECTIOPdS lz AND 14 OF ORDINANCE N0. 39
OF THE REVISED ORDINANCES OF THE COUNTY OF HAWAII 1960,
RELATING TO BUILDING PERMITS AND PERMIT FEES.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE
COUNTY OF HAWAII:
That Ordinance No. 39 of the Revised Ordinances of the
County of Hawaii 1960, is hereby amended in the following respects:
Section 1. Section 1L thereof is hereby amended to read
as rollows:
~ "Section 12. Suspension of permits. Notwithstanding
any provision in this ordinance to the contrary, the issuance
~,~ of building permits to erect, construct, enlarge, alter, repair,
improve or convert any building or structure shall be suspended
for a period of six (6) months from June L9, 1960, in the
Kaiko'o Project area and more particularly described as follows:
"Beginning at a point wf~ich is the extension of the West
right-of-way line of Huipu Street and the intersection of the
shore line at Reeds Bay, running Southeast along the West right-
of-way line of Huipu Street to the intersection of the South
right-of-way line of Kalanianaole Street, thence running :iouth-
west to the intersection of the South right-of-way line of
Kamehameha Street, thence running West to the Northwest corner
lot 2-2-3`L-61, thence South to the South right-of-way line of
Kuawa Street, thence East to the Northwest corner lotL-G-32-13,
thence South along the East right-of-way line of Kalanikoa
Street to a point of the extension of the South right-of-way
line of Kawelolani Street, thence West to the intersection: of
the East right-of-way line of Manono Street, thence South to
the intersection of the South right-of-way line of Piilani.
Street, thence West to the intersection of the East right-of-
way line of Mililani Street, thence South to the intersection of
the South right-of-way line of Hualani Street, thence West. to
Northeastern line of lot `1-2-;;u-3, thence along the Northerly
line of lot L-Z-3U-3 to the Northeast line of lot L-2-ZH-ilU,
thence Northwest to the Southeast corner of lotL-1-28-111,
thence West along the North lot line of lot 2-L-2£s-11G, 113,
114 and 41 to the intersection of the i~Iest right-of-way line
of Kilauea Street, thence Northwesterly along the Southwestern
right-of-way line to the intersection of the Southwest right-
of-way line of Keawe Street, thence Northwest to the intersection
of the Northwest right-of-way line of Mamo Street to the inter-
section of the South rir3ht-of-way line of Kamehameha Street,
thence Northwest to a point which is the projection of the
Northwest lot line of lot L-:i-Ul-2, thence Northeast along the
Northwest lot lines of lots 2-3-01-L & 3 to the intersection
of Hilo Bay, thence along the shore line and including Coconut
Island to the point of beginning;

provided, however, that the provisions of this section shall
not apply to:
"l. Those buildings or structures used or to be used for
public utility purposes.
"L. Those buildings or structures which sustained less
than 6U% damage to their structure from the seismic wave. Such
buildings or structures may be restored up to lUU°Jo of their
pre-seismic wave condition.
"3. 'Phose buildings or structures used or to be used in
the fishing industry.
"4. Those buildings or structures constructed or to be
constructed for business purposes on a temporary basis; provided,
however, that the owners or occupants thereof shall remove or
tear down the temporary buildings or structures within three (3)
months at ter HB 1, Special Session of the Legislature, 1960,
is signed by the Governor or a later date as fixed by the Board
of Supervisors by resolution requiring one reading. The county
building official is authorized to issue building permits for
temporary buildings or structures and such permits shall clearly
state that the temporary buildings or structures shall be removed
or torn down within the period specified herein. The provisions
of the UnlfOrm Building Code 1946 Edition relating to structural
requirements shall not be applicable to temporary structures or
buildings constructed pursuant to this section."
Section L. Section 14 thereof is hereby amended to read
as follows:
"Section 14. Building permit tees. Notwithstanding
the provisions of Section 303 of the Uniform Building Code 1946
Edition, relating to building permit fees, any person, term
or corporation wnich sustained any damage from the Kapono
Volcanic eruptions of 1955 or 1960 or the seismic waves of
1~'iay L3, 1y6U, shall pay no more than One Dollar ($l.iiU) in
permit tee ror each .building permit for a period of one year
from June Ly, 196U."
Section 3. This ordinance shall take effect upon its
approval.
