HomeMy WebLinkAboutORD 1960-220Bill No. 36 COUN~'1'Y OF HA1^JAII - STATE OF HA'aJAII ORDINANCE N0. 220 AN ORDINANCE AIviENDING SECTIONS 1, 2, 4, 6, 7, 9, 10, AND 11 OF ORDINANCE N0. 1i0, RELATIIVG TO THE CREATION OF THE HAGJAII VOLUNTEER FIRE DEPART'1w1ENT, FOR COMPENSATION, AND FOR BENEFITS FOk INJURIES :"iND DEATH ARISING OUT OF VOLUNTEER FIl.E F'IGHTIIVG ACTIVITIES. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF' THE COUNTY OF HALvAI I Section 1. Ordinance No. 17C of the County of Hawaii is hereby amended in the following respects: (1) By amending section 1 thereof to read as follows: "Section 1. Creation of Organization. There is hereby created and established for and within the County of Hawaii a department to be known as the Hawaii Volunteer Fire Department to train volunteers in the prevention of fires and to aid in the control of fires. The department shall have its principal office in the Hilo Fire Station." (2) By amending section 2 thereof to read as follows: "Section 2. Head. The Chief Engineer of the Hawaii Fire Department, County of Hawaii, shall be the Head of said department. The Head shall be vested with the management and control of the affairs, personnel and property of the department, subjer_t to the general authority and control of the Board of Supervisors. He shall, with the consent and approval of the Board of Supervisors make expenditures of moneys appropriated by the Board. for the Department. He shall not contract any debt on behalf of the department, nor dispose of any property belonging to the same without the consent of the Board. FIe shall make periodic reports to the Board concerning the affairs and activities of the department. In addition thereto, he shall perform and discharge such other duties as may be assigned to him by this ordinance or by the Board of Supervisors." (;i) By amending section 4 thereof to read as follows: "Section 4. Volunteer Ferso ruiel. The table of organization of the llepartment shall be patterned as closely as is practicable to that of the Hawaii Fire Department. The Head shall appoint, with the approval of the Board of Supervisors, such volunteer personnel as he may deem necessary tv fill the membership of the llepartment. The qualifications for membership shall be as prescribed by the rules and regulations governing the conduct of the Department. These rules and regulations shall be formulated by the Head and shall be presented to the Board of Supervisors for its approval.." ~~~, Ord. In the event of a fire occurring at any place within the County of Hawaii, the F~ead shall place the personnel of this department under the direction and control of the Hawaii Fire Department, County of Hawaii.. which may utilize the service of the personnel of the depart- ment to the fullest extent to aid i.n bringing such fire under control and to perform such other duties as may be necessary tc prov.de For the maximum safety of the inhabitants of the area threatened by such conflagration." (5) By amending section 7 thereof to read as follows: "Section 7. Cooperative use of fire fighting apparatus and facilities. Such fire fighting apparatus and facilities of the Hawaii Fire Department, County of Hawaii, necessary to carry out the purpose of this ordinance shall be made available to the Volunteer Fire Department when the Chief Engineer, Hawaii Fire Department, County of Hawaii, is satisfied that the efficiency of his aepartment is not seriously impaired thereby." (6) By amending section 9 thereof to read as follows: "Section ~~. Extent of Coverage. In case of injury or death arising out of and in the performance of volunteer fire fighting or training, all persons included. in Section is of this ordinance shall be entitled to benefits as prescribed by Chapter 97, Revised Laws of Hawaii 19SS, as amended. No person shall. he excluded from receiving such benefits by reason of being an elected official, employer or having an occupation which is excluded from coverage under said Chapter 9?, Revised Laws of Hawaii 1955, as amended." (7) By amending section 10 thereof to read as follows: "Section 10. Computation of Wages. For the purposes of such benefits, average weekly wages or earnings shall be computed from the usual employment or occupation of such person upon the basis set forth i~n Chapter 97, Revised Laws of Hawaii 1955, Section 9%-~U, or upon the basis of earnings at the rate of $ZJ.UO per week whichever is most favorable to the claimant or clai.mants." (R) By amending section 11 thereof to read as follows: "Section 11. Other Volunteers. tall other persons not members of the Hawaii Volunteer Fire Department who volunteer their services at fires and whose services are accepted by authorized persons and whose injuries or death arise out of and in the performance of volunteer fire fighting shall be paid their reasonable -2- hospital and medical expenses as authorized by Section 97-1`L0, Revised Laws of Hawaii 1955, and funeral expenses not to exceed $300.00. Authorized persons as used in this section shall mean such persons in the Hawaii Fire Department or FIawaii Volunteer Fire Department who are supervising or directing the fire fighting operations."
