Yti~ ~1~~~ ,~ 5 ~' -;,_, LEGAL NOTICE BILL NO. 44 COUNTY OF HAWAd[ - STATR OF HAWAII ORDINANCE NO. - AN ORDINANCE AsvIENDFNG ORDINANCE NO. 60 OF THE COUNTY OF HAWAII, AS AMENDED, RELATING TO "BUILDING CODE" OF THE COUNTY OF HAWAII. BE IT ORDAINED BY TIIE HOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: Section 1. Ordinance No. 60 of the County of Hawaii, as amended, is hereby further amended by adding thereto the following new sections after Section 9 to read as follows: "Section 10. Declaration of legislative intent. It is hereby declared that a public emer- gency exists 'in the City of Hilo because of the seismic wave of May 23, 1960, which has caused extensive destruc- tion and devastation to the City's industrial, business and residenial districts. Many lives have been lost and property damages are estimat- ed to run tnto millions of dollars. It is a significant fact that during the past fourteen (14) years the City of Hilo has been stricken by two catastro- phic seismic waves. In an en- deavor to spare the people of Hilo from losses and damages arising out of future seismic waves, it is the Intention of this Board Of Supervisors in thv tntcrest of ps:blic welfare and safety to aeriouslY con- sider and act upon a proposal to set aside a strip of area bordering the bay of Hilo as a safety zone. In order that said proposal can be given the fullest consideration, it is the intent and purpose of this ordinance to suspend the is- suance of building permits for certain buildings or structures within the devastated area for a limited period. "Section Il. Suspension of permits. Notwithstanding any provision in this ordinance to the contrary, in those areas in the Clty of H11a directly af- fected by the seismic wave of May 23, 1980, the issuance of building permits to erect, construct, enlarge, alter, re- pair, improve or convert any building or structure shall be suspended for a period of three (3) months from the effective date of this ordinance; pro- vided, however, that the pro- visions of this section shall not apply to: i 1. The provi- sions of the Uniform Building Code 1948 Edi- tion relating to s[rnetural requirements shall not he applicable to temporary structures or bulldin~+s constructed pursuant to this section. Notwithstanding the provisions of Section 803 of the Uniform Building Code 1946 Edition, relating to building permit fees, any person, firm or corporation which sustained any damage from the seismic wave of May 23, 198Q shall pay no more than one dollar ($1.00) In permit fee for each building permit. for a period of mie year from the effective date of this ordinance.
