COUNTY OF HAWAII - 5T ATE OF HAWAII . n -' ;~, ~ ., ORDINANCE IW . ~ x'~ ~' <~~ AN ORDINANCE AMENDING GRDINANCE N0. 60 OF THE COUNTY OF HAWAII, AS AMENDED, RELATING TO "BUILDII`JG CODE" CF THE `,% COUNTY OF HA4"iAII. 13E IT OP.DAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: Section 1. Ordinance No. 60 of the County of Hawaii, as amended, is hereby further. amended by adding thereto the following new sections after Section 9 to read as follows: "Section 10. Declaration of legislative intent. It is hereby declared that a public emergency exists in the City of }Ii to because of the seismic wave of May 23, 1960, which has caused extensive dest7~uction and devastation to the City's industrial, business and residential districts. Many lives have been lost and property damages are estimated to run into millions of dollars. It is a significant fact that during the past fourteen (14) years the City of Hilo has been stricken by two catastrophic seismic waves. In an endeavor to spare the people of Hilo from losses and damages arisiny out of future seismic waves, it is the intention of this Board of Supexvisors in the interest of public welfare and safety to seriously consider. and act upon a proposal to set aside a strip of area bordering the bay of Hilo as a safety zone. In order that said proposal can be given the fullest consideration, it i.s t}re intent. and purpose of this ordinance to suspend the issuance of building permits ~, ~;'.., Ord. JUN 29 1960 `. for certain buildings or structures within the devastated area for a limited period. "Section 11. Suspension of permits. Notwith- standing any p~:ovision in this ordinance to the contrary, iri those areas in the City of Hilo directly affected by the seismic wave of May 23, 1960, the issuance of building permits to erect, construct, enlarge, alt ex, repair, improve or convert any building or structure shall be suspended for a period of three (3) months from the effective date of this ordinance; px:ovided, however, that the provisions of this section shall not apply to: 1. Those buildings ox structures used or to be used for public utility pug: poses. 2. Those buildings or structures which sustained less than 60~ damage to their structure from the seismic wave. Such buildings or structures may be restored up to 100/ of their pre-seismic wave condition. 3. Those buildings or structures used or. to be used in the fishing industry. 4, Those buildings or structures constructed or to be constructed for business purposes on a temporary basis; provided. however, that the ovmers or occupants thereof shall remove or tear down the temporary buildings or structures within three (3) months after --pa~iication of a notice- f'~ , in the local newspapefi: thatr public lands ar.e available to disaster victims for the relocation of their businesses. The county building official is authorized to issue building permi-ts fo.r temporary buildings or structures and such permits shall clearly state that the temporary buildings or structures shall be removed or torn doe^m within the period specified herein. The provisions of the Uniform Building Cc de 1946 Edition relating to structural requirements shall not be applicable to temporary structures or buildings constructed pursuant to this section. -2- "Section 12. Determination of damages. For purposes of this ordinance the county building official shall determine the extent of damages. "Section 13. Building permit fees. Notwith- standing the provisions of Section 303 of the Uniform Building Code 1946 Edition, relating to building permit fees, any person, firm or corpora- tion which sustained any damage from the seismic wave of May 23, 1960, shall pay no mope than one dollar ($1.00) in permit fee for each building permit for a period of one yeaT~ from the effective date of this ordinance.
