COUNTY OF HAWAII - STATE OF HAWAII
ORDINANCE N0. ~ ~
AN ORDINANCE AMENDING ORDINANCE N0. 20 OF THE REVISED
ORDINANCES OF THE COUNTY OF HAWAII 1960, AS AMENDED, AND
ORDINANCE N0. 23 OF THE REVISED ORDINANCES OF THE COUNTY
OF HAWAII 1960, RELATING TO THE ESTABLISHMENT OF LAND USE
ZONE DISTRICTS IN THE COUNTY OF HAWAII.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY
OF HAWAII:
SECTION 1. Ordinance No. 20 of the Revised Ordinances
of the County of Hawaii 1960, as amended, is hereby further
amended by deleting the entire provisions appearing before
Section 1 thereof, and. substituting in lieu thereof a new
section to read as follows:
"Section lA. Land Use Districts in the City
of Hilo. The following land use districts are
hereby created in the City of Hilo."
SECTION 2. Section 2 of Ordinance No. 23, Revised
Ordinances of the County of Hawaii 1960, is hereby amended
by adding to the end thereof the following:
"Resort Hotel: Any building or portion
thereof designed or used for the supplying of
shelter and/or food to residents or guests and
containing twenty (20) or more sleeping rooms
for guests.
"Resort Apartment Hotel: Any building or
portion thereof which is designed, built, rented,
leased, let or hired out to be occupied or which
is occupied as the residence of twenty (20) or

more families living independently of each
other and doing their cooking in the building,"
SECTION 3. Paragraph A of Section 3, Ordinance No.
23, Revised Ordinances of the County of Hawaii 1960, is
hereby amended to read as follows:
"Section 3. Use Districts:
"A. In order to regulate and restrict the
location of trades, businesses, industries,
residences and other uses and th® location of
buildings, designed, erected, altered or occupied
for special purposes; to regulate and limit the
height and size of buildings hereafter erected,
or altered; to regulate and determine the area
of yards and other open spaces; and to regulate
and limit the density of population in various
areas of the County of Hawaii, there shall be tke
following use districts:
1. Class "A" Residential Districts
2. Class "B" Residential Districts
3. Class "C" Residential Districts
4. Class "D" Two Family Dwelling Districts
5. Hotel and Apartment Districts
6. Restrictive Business Districts
7. Neighborhood Shopping Districts
8. Business Districts
9. Light Industry Districts
10. Industrial Districts
11. Noxious Industry Districts
12. "A1" Agricultural Districts
13. "A2" Agricultural Districts
14. Safety Zone Districts
15. Waterfront Business Districts
16. Resort Hotel and Resort Apartment
Hotel Districts."
SECTION 4. Ordinance No. 23 of the Revised Ordinances
of the County of Hawaii 1960, is hereby amended by adding
two new sections after Section 10.01 to read as follows:

"Section 10.02. Resort Hotel and Resort
Apartment Hotel Districts:
"Within any of the resort hotel and resort
apartment hotel districts, the minimum area of
each lot shall be forty thousand (40,000) square
feet and the minimum lot width shall be 125 feet.
No building or premises therein shall be used
except for resort hotel, resort apartment hotel
and residential uses; provided, however, that the
residential use shall be restricted to the same
use allowed on the particular land immediately
prior to rezoning to a resort hotel and resort
apartment hotel district.
"Section 10.03. Accessory uses within a
Resort Hotel and Resort Apartment Hotel District:
"The provisions of Section 10,01 of the Revised
Ordinances of the County of Hawaii 1960, relating to
accessory uses within a hotel and apartment district are
applicable to resort hotel and resort apartment hotel
district."
SECTION 5. This ordinance shall take effect upon
its approval.
