HomeMy WebLinkAboutORD 1962-151___ ~ _ BILL NO. 129 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. 151 AN ORDINANCE PROHIBITING THE USE OR CONSUMPTION OF INTOXICATING LIQUORS IN CERTAIN PUBLIC PLACES AND PROHIBITING THE USE OR CONSUMPTION OF INTOXICATING LIQUORS IN OTHER PUBLIC PLACES WITHOUT PERMITS AND PROVIDING PENALTIES THEREFOR. BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE COUNTY OF HAWAII: SECTION 1. It is hereby declared to be the legislative intent of the Board of Supervisors to prohibit the open indiscriminate and unrestricted use or consumption of intoxicating liquors in certain public areas or buildings, and to prohibit without first obtaining a permit the open indiscriminate and unrestricted use or consumption of intoxicating liquors in other public areas or buildings. SECTION 2. No person shall drink, offer to drink, or display to public view in the following public areas or buildings located thereon, any intoxicating 1.Lquors, whether in a bottle, demijohn, jug, container or otherwise: 1. All public school grounds and buildings; 2. All public areas or buildings contiguous to all public school grounds and buildings; 3. No person shall drink, offer to drink, or display to public view in the following public areas or buildings located thereon, any intoxicating liquors, whether in a bottle, demijohn, jug, container or otherwise, without first obtaining a permit from the Chief of Police: 1. Honaunau (Old School Site) 2. Hoolulu Park and Civic Auditorium Complex 3. Kaiwiki Park 4. Kamehameha Park 5. Kurtistown Park 6. Mooheau Park and Bayfront Area 7. Papaikou Park and Gym 8. Piihonua Gym and Gilbert Carvalho Park 9. Waimea Park 10. Waipio Lookout 11. A. J. Watt Park and Gym SECTION 4. Any person desiring to obtain a permit as described in Section 3, shall make application for a permit therefor in writing to the Chief of Police. Said application shall be signed by the applicant and the person who is to be responsible for the conduct of all persons at. the gathering or occasion, and shall include: (a) The full name and address of the applicant, if an individual, and, if a firm, association, corporation or club, the full names and addresses of the principal. officers the re of; (b) The full name and address of the person who is to be responsible for the conduct of all persons at the occasion or gathering. Such person shall be of good rcioral character. The Chief of Police may, in his discretion, s•equire proof of good moral character in the event he has any good reason to doubt the moral character of said person. In no event shall said permit extend beyond the hours licensed dispensers are permitted by law to serve intoxicating liquors; (e) The nature of the occasion or gathering; (f) The number of persons to be in attendance; (g) A statement that the permit is not for the purpose of enabling habitual drunkards to consume intoxicating liquor. SECTION 5. All permits shall be subject to all applicable laws and ordinances and to the following conditions which shall be set forth in the permit: (a) No person under the influence of intoxicating liquor shall be permitted to be or remain upon the premises; (b) No person shall willfully or intentionally destroy, damage or injure any property; (c) No person shall throw or dispose off: any refuse, waste materials, or bottles, except in receptacles placed therein; (d) The responsible person shall be present at all times. SECTION 6, The provisions of this ordinance shall not be construed to permit any person to sell any intoxicating liquor by obtaining a special license or otherwise« SECTION 7. Any person violating any provision of the ordinance or any condition set forth in a permit issued herein shall upon conviction be punished by a fine not exceeding $500. SECTION 8.
