ORDINANCE AMENllING ORDINANCE N0. 153, REGULATING THE
PLACING, LEAVING Olt DEPOSITING OF' ANY GOODS, WARES OR
NERCHANllISE ON SIllEl4ALKS IN THE CI'PY LIMITS OF HILO AND

SECTION 1. Section 3 (b) oi' Ordinance No. 153 is
hereby .mended by deleting the words "three (3) feet high"
therefrom and substituting therefor the words "four (4) feet
high" so that the sub-section, as amended, now reads as
follows:
"(b) tl statement that the newsstand, news
rack or other similar publication dispensers do
not occupy one-fifth (1/5) of the width of the
sidewalk and over four (4) feet high."
SECTION 2. The last paragraph of Section 3 of
Ordi-nance No. 153 is amended to read as follows:
"Upon completion oI' all the above requirements,
the Hoard shall grant a permit to place newsstand,
news rack or other similar publication dispensers
on the sidewalk area desired for a period not to
exceed one year, provided that the holder of this
permit shall indemnify and save harmless the
County of fiawaii, the officers and agents thereof,
from all claims, demands, suits, actions or pro-
ceedings of every name, character and description
which may be brought against the County for or on
account of any injuries or damages to any person
or property received or sustained by any person

by or in consequence of any act or acts of the
holder of said permit for actions done under
this permit."
SF;CTION 3. Paragraph (e) of Section 4 of Ordinance
No. 153 is amended to read as follows:
"Upon the finding that the use will not
unreasonably endanger the public use of the side-
walk or unreasonably impede pedestrian traffic,
the Board shall ;;rant a permit to the aAPlicant
for a specified period, not to exceed seven (7)
days, to use a specified sidewalk area for the
purposes applied, with a provision that such
properties or services would not cover more than
two-thirds (2/3) of the wi-dth of the sidewalk and
not piled up to a greater height than four (4)
feet, provided that the holder of this permit
shall indemnify and save harmless the County of
Hawaii, the officers and agents thereof, from all
claims, demands, sui-ts, actions or proceedings of
every name, character and description which may
be brought against the County for or on account of
any injuries or• damages to any person or property
received or sustained by and person by or in con-
sequence of any act or• acts of the holder of said
permit for actions done under this permit."
SECTION 4. This ordinance shall take effect upon its
approval.
