ORDINANCE N0. 252
AN ORDINANCE AMENDING ORDINANCE N0. 122 OF THE COUNTY OF
HAWAII, AS AMENDED, RELATING TO THE POWERS OF THE BOARD OF
APPEALS.
BE IT ORllAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF
HAWAII:
SECTION 1. Ordinance No, 122 of the County of Hawaii, as
amended, is hereby further amended by adding thereto a new
section, Section 3-A, to read as follows:
"Section 3-A. Amending Section 204 to read as
follows:
"'In order to determine the suitability of
alternate materials and types of construction, to
provide for the granting of waivers of violations
of any provision of this Code, excepting engineering
requirements, to provide for the granting of variances
from any of the provisions of this Code and to provide
for reasonable interpretations of the provisions of
this Code, there shall be and is hereby created a
Board of Appeals, consisting of five members who are
qualified by experience and training to pass upon
matters pertaining to building construction, The
Building Official shall be an ex officio member and
shall act as Secretary of the Board, The members of
the Board of Appeals shall be appointed by the Mayor
and shall hold office for terms of two years. The
members of the Board of Appeals shall be appointed,
three for a period of one year and two for a period
of two years; thereafter every appointment shall be

made for a term of two years, commencing from the
date of the expiration of the last preceding term.
Any vacancy shall be filled by appointment for the
remainder of the unexpired term. The Board shall
adopt reasonable rules and regulations for conducting
its investigations and shall render all decisions and
findings in writing to the Building Official with a
duplicate copy to the appellant and may recommend to
the City Council such new legislation as is consistent
therewith, "'
SECTION 2, This ordinance shall take effect upon its
approval,
