ORDINANCE NO. 276
AN ORDINANCE ESTABLISHING A CURFEW ON MINORS A.ND IMPOSING
PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS IN AND FOR THE
COUNTY OF HAWAII:
SECTION 1. No person under the age of fifteen (15)
years shall remain or loiter on any public street, highway,
park or any other public place, including ;any establishment
catering to the public wherein food, drink, entertainment, or
recreational activities are provided, between the hours of
9:30 P.M. and 4:00 A. M. except in case of necessity or
unless accompanied by his or her parent, legal guardian,
or an authorized person 18 years or older.
SECTION 2. No person under the aqe of eighteen (18)
years shall remain or loiter on any public street, highway,
park or any other public place, including <any establishment
catering to the public wherein food, drink, entertainment,
or recreational activities are provided, between the hours
of 12:00 Midnight and 4:00 A,.M. unless accompanied by his
or her parent, legal guardian, or an authorized person 18 years
or older.
SECTION 3. Any minor violating this ordinance shall
be deemed a delinquent child and may be punished as prescribed
by law.
SECTION 4. Any parent or legal guardian of a person
under the age of eighteen (18) years who knowingly permits
him or her to violate either Section 1 or Section 2 hereof

SECTION 5. A.ny keeper of an establishment catering
to the public wherein food, drink, entertainment, or
recreational activities are provided who knowingly permits
any child under the age of fifteen (15) years to remain or
loiter upon the premises between the hours of 9:~0 P,M. and
4;00 A.M „ unless the child is accompanied by his or her
parent, legal guardian, or an authorized person eighteen (18)
years or older, or who knowingly permits a child between the
ages of fifteen (15) and eighteen (18) years to remain or
loiter upon said premises between the hours of 12:00 Midnight
and 4:00 ~.M. unless accompanied by his or her parent, legal
guardian, or an authorized person shall be fined not more

SECTION 4, Any parent or legal guardian of a person

shall be fined not more than $500.00.
SECTION 5, Any keeper of an establishment catering
to the public wherein food, drink, entertainment, or
recreational activities are provided who knowingly permits
any child under the age of fifteen (15) years to b~=tar
remain upon the premises between the hours of 9:30 F'. M, and
4:00 A.M., unless the child is accompanied by his or her
parent, legal guardian, or an authorized person eighteen (18)
years or older, or who knowingly permits a child between the
ages of fifteen (15) and eighteen (18) years tofloiter upon
said premises between the hours of 1?:00 Midnight and 4:00 A.M.
unless accompanied by his or her parent, legal guardian, or
an authorized person shall be fined not more than $100.00,
SECTION 6. This ordinance will take effect upon its
approval.
