ORDINANCE ADOPTING THE RE'JISED ORDINANCES OF THE COU^JT7f CTF

BE IT ORDAINED BY THE B0:4P«~ OP SUPERVISORS OF THE COUNTY OF
HAWAIIe
SECTION 1, Enactment of Revised Ordinances. Ordinances
2 to 6o, both inclusive, and each section thereof, are hereby
re-enacted as revised ordinances to take effect on approval
of this Act, The ordinances 2 to 66, both inclusive, and each
section thereof, shall be designated and may be recited as
"Revised Ordinances of the County of I-lwaii 1967."
SECTION 2. Repeal; er.cepti'on. Revised Crdinances of the
County of Hawaii 1960, as amended, is hereby repealed except as
herein provided:
(a) That all ordinances, amending and effective after
August 3, 1960 and which are omitted from the Revised Ordinances
of the County of Hawaii ].967 shall not be deemed to have been
repealed, but shall be continued in fall force and effect
unimpaired by the Revised Ordinances of the County of Hawaii
1967.
(b) That the repeal of the Revised Ordinances of the County
of Hawaii 1960, as amended, or any portion thereof, by this section
shall not affect or impair any act done or right vested or accrued
or any proceeding, suit or prosecution had or commenced in any
cause before such repeal shall take effect; but every such act
done, or right vested or accrued, or proceeding, suit or prosecu-
tion had or commenced shall remain in full force and effect to
all in~,ents and purposes as if such Revised Ordinances of the
County of Hawaii 1960, or any part thereof, so repealed had

remained in force. No offense committed and no liability, penalty
or forfeiture either civilly or criminally incurred prior to the
time when any such Revised Ordinances cf the County of Hawaii
1960, or any part thereof, shall be repealed or altered by the
Revised Ordinances of the County of Hawaii 1967, shall be dis-
charged or affected by such repeal or alteration; but prosecutions
and suits for such offenses, liabilities, penalties or forfeitures
shall be instituted and proceeded with in all respects as if such
Revised Grdinances of the County of Hawaii 1960, or any part
thereof, had not been repealed or altered.
(c) That no ordinance relating to appropriation of funds,
general plans, improvement districts and moratorium on permit fees
and no resolution relating to improvement districts, cemeteries,
traffic regulations and naming of streets shall. be affected by
the repealing clause of this ordinance.
(d) Ordinance Nos. 20 (Land Use - Hilo), 21 (Land Use -
Hamakua), 22 (Land Use - Kona), 23 (Zoning) and 183 (Interim
Zoning) of the Revised Ordinances of the County of Hawaii 1960,
as amended, shall continue in full force and effect unimpaired
by the Revised Ordinances of the County of Hawaii 1967 until
the zoning map referred to i.n Ordinance i~'o. 63, Revised Ordinances
of the County of Hawaii 1967, is adopted.
SECTION 3. Construction of Revised Ordinances. Provisions
in the Revised Ordinances of the County of Hawaii 1967 shall be
construed as continuations or amendments of applicable or.
corresponding provisions of previously existing ordinances and
not as new enactments. In case of a conflict between two or more
previsions, or in any case of a latent or patent ambiguity or
obvious clerical error in any provision of the Revised Ordinances
of the County of Hawaii 1967, reference rr,ay be had to the
previously existing ordinances for the purposes of applying the

rules of construction relating to repeal by implication or for
the purpose of resolvingthe amuiguity er cor_recting the error.
SECTION 4. Revivor, !'then any ordinance repealing a former
ordinance, clause, or provision shall ba itse]_f repealed, such
repeal shall not be construed to revive such former ordinance,
clause, or provision.
SECTION 5. Effective date. This Act shall take effect
upon its approval.

ORDINANCE ADOPTING THE REVISED ORDINANCES OF THE COUNTY OF
HAWAII 1967.
This Bill re-enacts ordinances numbered 2 through 66 as
"Revised Ordinances of the County of Hawaii 1967" and repeals
all Revised Ordinances of the County of Hawaii. 1960, as
amended, with exceptions.
