ORDINANCE N0. 6
AN ORDINANCE ESTAB.T.ISHING THE NUMBER AND RATES OF COMPENSATION FOR
ALL POSITIONS IN DEPAR"'MENTS, OFFICES AND OTHER AGENCIES OF THE COUNTY
OF HAWAII UNDER THE LEGISLATIVE CONTROL OF THE BOARD OF SUPERVISORS,
DESIGNATING PAYROLL PEP,IOLS, PAY DAYS, PERQUISITES, AUTOMOBILE
ALLOWANCES AND OFFICIAL FIDELITY BONDS: SAIll ORDINANCE TO BE KNOWN
AS THE SALARY ORDINANCE OF 1967.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII:
SECTION 1, Declaration of policy. That, among other things,
it is the purpose of this ordinance to fix and establish the number
and rates of compensation for all positions in departments and
offices of the County of Hawaii under the legislative control of the
Board of Supervisors pursuant to the provisions of Act 99, Session
Laws of Hawaii 1957, and Chapters 3 and 4 of the Revised Laws of
Hawaii 1955, as amended. The term "Employees" as used iri this
ordinance shall include all officers.
SECTION 2. Payroll periods and pay days. All salaries and
wages shall be earned and payable in semi-monthly payroll periods,
from the first (1st) to the fifteenth (15th) of each month and from
the sixteenth (lb~th) to the end of each mronth.
The fifteenth (15th) and last days of each month shall be the
pay days for all employees.
SECTION 3. Rate of Compensation.
(A). The monthly rates of compensation for positions covered
by the position classification plan shall be determined and fixed in
accordance with the salary schedule, including increment increases,
of Sections 4-9 and 4-10 of the Revised Laws of Hawaii 1955, as
amended, and said salary schedule, including increment increases,
is made a part hereof by reference,
(B). Employees occupying positions not subject to the
compensation schedule hereiriabove set forth (A) shall be paid at
rates of compensation as fixed and established by applicable
provisions of the Revised Laws of Hawaii 1955 and any act amendatory
thereto, or any resolution in pursuance thereof by the Board of
Supervisors in accordance with the following setredule:

S~CTtiOa ~. Automobile allowances. Each person, legally
appoiute;] to anG occupying any position enumerated in this Ordinance,
exclu_ling ~eparta!oxit heads and membars of the police department,
shall b^_. allowed monthly compensation for the value of the use of
a privately-owcxed automobile used regularly t>y such person in the
r_ourse 2':d scope of his employment for count} purposes under the
direction and with tlxe approval of the head of the department in
which s~ciz person is employed, at such a flat: monthly rate and

subject to such limitations and conditions as recommended by the
said department head and appro•~ed by the Board of Supervisors,
provided, that aL. :>uch flat_ rnonthly -sates shall be based on a
trial period of not :no re than six months (during which time
allowance shall b=: ~ranteU on a mileage basis) prior to the deter-
mination of a flat monthly rate,
All flat monthly a1:Lowances, limitations and conditions,
referred to above, shal'_ be set forth in a resolution or resolutions
adopted by the Board of Supervisors upon one reading; and any amend-
ments thereto, shall be made by resolution adopted and approved in
the heretofore mentioned manner.
Department heads may be granted automobile allowances for the
use of privately-owned cars in the course and scope of their
employment in such amounts and under such conditions as shall be
determined and established by the Board of Supervisors.
Members of the police department shall be governed by the
provisions of Section 145-16 of the Revised Laws of Hawaii 1955.
No such allowance shall be authorized to be paid by the Auditor
unless moneys for the payment thereof are appropriated by the Annual
Appropriation Ordinance or made available by other specific
appropriation or transfer nor unless the recipient thereof shall
have filed with the Auditor a duplicate copy or other satisfactory
evidence of the existence of a policy of insurance undertaking to
indemnify the County of Hawaii against claims arising out of the
negligent operation of the automobile for the use of which such
compensation is paid, to the extent of n.ot less than $S,UOU.00 for
injuries to property and not less than $10,00U.U0 for injuries to
persons, together with satisfactory evidence that such insurance is
and will be continued to be, maintained in force at all times during
which such officer or employee may operate such automobile in the
course and scope of his employment by the County of Hawaii.
The Auditor shall be authorized to requirEa as a prerequisite
to the payment of any such allowance or compensation satisfactory
proof that such automobile has actually been operated for county
purposes during the period for which such compe>nsation or allowance
is claimed. He mad also require a record of the number of miles
travelled in support of such claim.
Each department head shall prepare and keep current a list
showing persons in his department to whom automobile allowances
are to be paid Copies of such Lists shall be filed with the
Auditor>
SECTION 6.01, Automobile mileage allowances. In the absence
of any flat monthly automobile allowance, any officer or employee
of the County of Hawaii who is required to use a privately-owned
automobile in the performance of his official duties shall be
allowed mileage at the rate of eleven cex:ts per mile for each mile
actually and necessarily travelled.
SECTION 7. Official Fidelity Bonds.. Pursuant to the
provisions of Sections 144-2` to 144-28, Revised Laws of Hawaii
1955, and any act amendatory thereto, or any provision passed in
pursuance thereto by the Board of Supervisors, official fidelity

bonds, filed and approved in the form and manner set forth in
Sections 138-1 and 138-2, Revised Laws of Hawaii 1955, shall be
required of the persons appointed to or occupying certain positions
enumerated in the above sections; said bonds shall be in the
custody of the County Treasurer, excepting the bond of the
Treasurer which shall be in the custody of the County Attorney.
SECTION 8, The number and rates of compensation for all
positions in departments and offices of the County of Hawaii under
the legislative control of the Board of Supervisors of the County
of Hawaii be and the same are hereby fixed and established in
accordance with schedules as set forth in Section 3 of this
Ordinance, as follows:

SECTION 9. Severability. If any section, or any part or
clause of any section, of this ordinance be decided by the Courts
to be unconstitutional or invalid, the same shall not affect the
validity thereof which can be given effect without that so decided
to be unconstitutional or invalid.
