COPrP'IIT'~EE; CONFERRING POi~IERS AND PRESCRIBING DUTIES THEREnF, BE IT ORDAINED BY THE BOA12D Oi~ SUPERVISORS IId AND FOR THE COUNTY OF HAVdAII; SECTION 1, Intent, The County government now renders overlapping services in the area of government participation in the economic development of Hawaii County, It is the intent of this ordinance to consolidate and incorporate the duties of the Promoter of Activities and the Administrator of Economic Research and Development Commission, to further provide for a whole new area of governmental activities assumable under the Economic Opportunity Act and to designate specific areas of county participation so that there is greater coordination and centralization of similar functions for the funds available, SECTION 2. Department of Economic Development, There is hereby created a Department of Economic Development of the County of Hawaii. The department shall consist of the Director of Economic Development, a Deputy Director of Economic Development, an Economic Development Committee; and such otY~er officers and employees as may be provided for by the Board of Supervisors. SECTION 3. Director and Deputy Director of Economic Development, The Department of Economic Development shall be in charge of a Director who shall be appointed and be removed by the Chairman and Executive Officer of the Board of Supervisors, with the approval of the Board of Supervisors. The said Director shall have such qualifications as the Board of Supervisors may deem necessary and shall not be subject to the civil service and compensation laws, and shall receive a salary fixed by the Board of Supervisors. The said Director shall have the power to appoint such other employees as may be necessary in accordance with the civil service and compensation laws. He shall be vested wit h, perform and be subject to all powers, duties and functions conferred or imposed upon the department by this ordinance and such other powers, duties and functions as shall be prescribed by the Board of Supervisors, There shall also be a Deputy Director of Economic Development who shall be appointed and removed in the same way as the Director of Economic Development and shall possess similar qualifications, He shall be under the direction of the Director., receiving such salary as may be provided for by the Board of Supervisors in compliance with the prevailing classification law, He shall perform County functions dealing with all activities assumable under the Economic Opportunity Act as he may be directed. He shall aid the Director of Economic Development in the performance of his duties and shall be the Acting Director during the temporary absence or during a vacancy in the office of the Director. SECTION 4, Functions. The department, under the broad framework of policies established by the Chairman and Executive Officer of the County of Hawaii and the Board of Supervisors, shall: tu• Ala. !1. ~. I1a Dates A. Be in charge of encouraging the promotion of agriculture and the development of business, commerce, industry and tourism, so as to accelerate the ecoaonic grooath po~ential of the County of Hawaii. In this regard, the deportment meiy report and recommend for implementation any ideas wherein the "ounty's participation may be an impetus to economic develo?r.ent. It may also recommend to the Board of Supervisors public services and improvements needed f-or the development or expansion of any of the above-mentioned enterprises. B. Gather and disseminate infor;nation of use to prospective investors in the field of agriculture, business, commerce, industry or tourism in this County on an impartial basis, The department may actively reel; prospective investors and -also prepare a list of available sites in the County suitable for economic development, C. Conduct programs of study, education, planning, promotion and research with the view of expending the economic base of this County. D. Be designated the official County Economic Development Organization to deal with matters pertaining to the Area Redevelopment Act, the Depressed Areas Act and any County functions assumable under the Economic Opportunity Act. E, With the approval of the Board'of Supervisors, shall: 1, Prepare all reports necessary in order to become eligible to participate in any related State or Federal assistance program, 2. Determine the priority of projects the County shall enter into pertaining to such assistance programs, 3. Be the recipient of Federal, State, County and private funds ir. initiating economic development projects. 4, Coordinate and assist in the raising of private contributions and loans, in conjunction with Federal and State grants and loans for the purpose of initiating economic development projects, 5. Perform all necessary functions having to do with Federal, State and County economic development programs. F. Coordinate and cooperate with efforts cf any private organization, County, State or Federal government in the area of economic development. G. Plan, promote and organize County-wide activities, subject to general direction, on matters of policies and objectives. H. Perform any other related functions and duties as may be directed by the Chairman of the Board of Supervisors. SECTION 5. Economic Development Committee. There shall be within the Department of Economic Development a committee hereby designated as the Economic Development Committee, which shall sit in an advisory capacity to the Director or Deputy Director of Economic Development on matters within the jurisdiction of the said department. Said committee shall also be the recipient of funds appropriated by the State of- Hawaii for neighbor island economic development, and for this purpcse determine the manner in which said appropriation be expended. -2- The committee shall consist of five (5) members who shall be appointed by the Chairman and Executive Gf-ficer of the Board cf Supervisors, wit t, t:_,,e a_nproval of the Board of Supervisors, and shall hold off,_ce fo tcac (i! year-s cr until their successors are appointed and c~ialified; provided tha-t of the members on-gin ally appointed hereunder, three (3) shall b:: ~ppo.inted for a term expiring ~anuary 1, 1966, and two (2j shall be appointed for a term expiring January 1, 196?; tY~ereaftcr, every appointment shall be made for a term of two (2) years conurenr.ine; from the date; of the expiration of the last preceding term, Any vacancies shall be filled by appointment for the remainder of the unexpired term. The Chairman and Executive Officer of the Board of Supervisors shall name one of the members to act as Chairman of the committee. The members of.- the committee shall serve without compensation but shall be entitled to receive reasonable traveling expenses beyond the city limits of Hilo for the al=tendance of meetings or for the performance of official functions of the committee, The majority of the members o.f the committee shall constitute a quorum necessary for the transaction of business and for the exercise of powers and authority conferred upon the committee. The committee shall meet as many times as necessary to advise the Department of Economic Development in the performance of its functions. SECTION 6. Other Inconsistent Provisions. All ordinances, resolutions and policies inconsistent with this ordinance are hereby repealed, rescinded and superseded. -3-
