BE IT ORDAINED 3Y THE i~OEii~D OF SL~I'EPVISO:?S OP `CHL COUNTY OF HA[aAII: SECTIOP? 1, Public Dance House or Hall. Definition. A public dance house er-hall withir. the meaning of this Ordinance is any house, hall, building or' rcom used for public dancing, for admission to which fees are charged or collected, whether directly for tickets or indirectly in any manner by way of cover charges, fees for partners or other charges of any nature whatsoever, or in which female dancing partners receive or have agreed to receive compensation; provided, however, that church halls, club houses or halls which are occasionally used for dances, at which no compensation is paid or agreed to be paid to any female dancing partners, are not included within the meaning of this ordinance; provided further that a license fee of One Dollar (:1.00) shall be paid to the Treasurer of the County of Hawaii for each clay or night when dances are held in such church halls, clu)~ houses or halls to which admission charges o.r f-ees are collected, SECTION 2. License. It shall be unlawful for any person to keep or conduct a public dance house or hall in the County of Hawaii, unless licensed so to do, SECTION 3, Application for license. Any person desiring to keep or conduct a public dance house or hall in the County of Hawaii shall make application th~refo.r ir. w.riting verified under oath to the Treasurer of the County of- Hawaii, which application shall set forth: a. The full name and address of the applicant, if an individual, and, if a firm, corporation or club, the full name and address of the principal officers, including in any event, the full name and address of the person who is to be responsible for the conduct of dances in said dance house ox hallo b. The application of the occupant, c. A brief description of the place and the location of the public dance house or hall for oahich a license i.s desired. d, The full name and address of the owner of such place, or of the person or persons in control of said premises. e. The term for which the applicant desires a license, that is, oahether for one day, several days, a month cs a year. f. A statement under oath that neither the applicant, the person to have charge of the public dances nor any person intended to be employed have been convicted of any offense against the laws of the State of Hawaii or the United States of America involving moral turpitude or intoxicating liquors. SECTIODt 4. Location of Dance House or Hall. Every public dance house or hall shall be located next to and adjacent or contiguous to a public road or highway, or in a building located next to and adjacent or contiguous to a public road or highway. or1. No license shall be issued for a public dance house or hall unless there shall first be presented to and filed with the Treasurer of the County of Hawaii the written consent of seventy-five percent of the owners of property within a radius of two hundred and fifty feet o]` the center of such dance house or hall or any proposed dance house or hall, No property owner shall be considered as having consented unless and until any and all lessees of any property, the owner of which is required to consent, shall have joined with such owner in a written consent to the issuance of sucYc license. SECTION 6. ~::rritten i?ermit. Every application for a license shall have attached to it a written permit setting forth the fact that the dance house or hall is fit and :in proper condition for dances to be held therein, and which written permit shall be duly signed and approved by the T3uilding Inspector of the County of Hawaii, the Fire Chief of the iii to Fire Department or a Deputy Fire D4arshal of the State of Hawaii and the Board of Health or its duly appointed agent. SECTIODI 7. Issuance of License, 1-then the application, written consent and written permit mentioned above have keen filed by the applicant and accented by ti.e Treasurer of the County of Hawaii, the applicant shall pay the fee ~~ereinaf-ter specified to said Treasurer for tile- tem oa terms stated in the application; and then the said Treasurer shall issue a license to operate the described house or hall as a public dance house or hall for the term or terms for which the fees havF: been paid, SECTION 3. Nc license issued under this Ordinance shall be transferrable or transferred except to a transferree approved by the Treasurer of the Cowlty of Hawaii after such transferree has filed an application as provided by erection 3 of this Ordinance, as though he were an original applicant, SECTION 9, License Fees. I'he anr.t:al fee for a license to operate a public dance .souse or hall for one year shall be One Hundred Fifty Dollars ($150,.00); the fee for thirty (30) days shall be Fifty Dollars ($50,00); and the fee for one (1) day or night or for any number of days or nights less than thirty (30) days shall be at the rate of Five Dollars 05,00) per day or per night, All fees shall be payable in advance prior to the issuance of a license. SECTION 10. Conditions of License. All licenses to operate a public dance house or hall shall be subject to the following conditions which shall be written and placed upon the license: a. the dance house or hall and the premises shall be brightly lighted during all the time it is in use, b. No undue familiarity i,~etween partners shall be permitted at any dance. No violation of law shall be allowed or countenanced in any dance house or hall, c. No person under the influence of liquor shall be permitted to be or remain in said dance house or hall or upon the premises used in connection therewith, d, Dancing shall cease at one (1) o°clock a,m, e. No person shall be employed with the conduct or operation of such public dance house or hall, who has been convicted of any offense involving immorality, moral turpitude or intoxicating liquor, or who is under the age of eighteen (lb) years,. -2- f. There shall be employed and be present at such public dance house or hall when dances are being carried cn, one person who shall be approved in writing by the Chief of Police of the County of Hawaii or his deputy. The duties of the person so employed shall be to keep order and enforce the observance of law and the conditions of the license. g, No female shall be permitted to dance, as a dancing partner, in any public dance house or hall, until she produces or shows a birth certificate or other documentary proof to the holder of a license or his manager and to the person employed as provided in the foregoing paragraph (f) that she is over the age of eighteen (18) years. SECTION 11. The Treasurer of the County of Hawaii shall require the licensee to furnish a bond to the County of Hawaii in the sum of Five Hundred Dollars 0500.00) for the faithful observance of law and order in such public dance house or :hall and of the conditions of the license. SECTION 12. 'r he Chief of Police, his deputy or any regular police officer of the County, i'iembers of the Board of Health and/or of the Fire Department of the City of Hilo and any County official, may at any time enter any public dance house or hall for the purpose of inspecting the conditions therein. SECTION 13. License and Conditions to be misplayed, ilny license issued under this Ordinance shall be displayed in a conspicuous place upon the premises for crhich said license is issued. SECTIOftT 14. Tin person. attending any public: dance house or hall shall take to or into said public dance house or. hall any intoxicating liquor whatsoever; and r.o person shall drink or consume any intoxicating liquor in any pub'.ic dance House or hall or any premises connected therecaitl~. SECTION 15. Children under eighteen, prohibited, It shall be unlawful for any licensee of any public dance house or hall, or any agent or servant of such licensee, to permit children under the age of eighteen (18) years to visit or remain in a public dance house or hall during its use fo.r dancing. SECTION 16. Penalties. Any person who shall violate any of the provisions of this Ordinance, or who shall operate or assist in the operation of a public dance house or hall orithout a license, shall be punished by a fine not exceeding Five I-Iundred Dollars (c65O0.00). And in the event any licensee or any owner of any public dance house or hall shall be convicted of any misdemeanor under this Ordinance, then in addition to the penalties hereinbefore expressed, the Judge or District 'l.iagistrate in imposing sentence may suspend or revoke the license of such person and may prescribe any period not more than one (1) year during which such person may be prohibited from obtaining any license under this Ordinance; and the Judge or District P.~Iagistrate may suspend the use of such public dance house or hall for dances for any period of time not exceeding one (1) year . -3- SECTION 17, The Treasurer of the County of Hawaii may revoke any license issued under this Ordinance upon the proper showing being made to him that any of the conditions of said license have been violated by the holder thereof or any of h:is servants, agents or employees; or that there has been rowdyism, fights or intoxicating liquor furnished or consumed in and upon the premises, dance house or hall for which a license has been issued for tYie use thereof, SECTION 18, 1\f ter a license has been issued as provided herein and if the Treasurer of the County of Hawaii shall find that any false statement had been knowingly made in any application, he shall forthwith revoke such license, -4-
