AN ORDINANCE PROVIDING FOR '1'HE RI;GULi~'IICiG OF THfC CONSTRUCTION AIdD
EQUIPP:IENT, OPERATIOPi AND I2ESPOIdSIBILITY OF DRIVI~]RS, AND INSPECTIODi
OF EQUIPMENT OF SCHOOL BUSSES AS DEFINED BY THE PROVISIONS OF
SECTION 37-23 OF THE REVISED LA?TS OF HA?.T['>II 1955, AS Ai'fENDED.

SECTION 1. Definition. As used in this Ordinance, the
following words shall have the meanings ascribed to them in this
section unless otherwise indicated by the context.
(a) "School Bus" shall have the meaning prescribed by
Section 37-23 of the Revised Laws of Hawaii 1955, as amended.
(b) "Driver" shall mean any person in actual physical control
of a school bus.
(c) "School bus operator" shall mean and include every natural
person, firm, copartnership, association or corporation, finding
itself into contract with the County of Hawaii to furnish transport-
ation of school children to or from school as provided by the said
provisions of Section 37-23 of the said Revised Laws of Hawaii 1955.
SECTION 2. Construction and Ecruibment of School Busses.
(a) No vehicle shall be used as a school bus unless the police
department of the County of Hawaii shall have determined that it is
safely constructed.
(b) Gasoline tanks shall be located entirely outside that
part of the school bus utilized for carrying passengers. Each
gasoline tank shall fe equipped with an inlet for filling on the
exterior of the bus.
This provision shall not apply to diesel-powered busses.
(c) The placement and installation of exhaust pipes of each
school bus shall be as approved by the police department of the
County of Hawaii, Every school bus shall be constructed and
maintained as to prevent exhaust gasses from entering the vehicle
through the floor.
(d) Entrance and exit doors of all school :pusses shall be
placed on the right-hand side of the front of the bus, and shall be
directly within the view and under the control of the driver.
Entrances and exits shall at all times be kept clear for the ingress
and egress of passengers. 111 such doors must be capable of positive
uniform operation at all times.
(e) Each school bus, not of a pleasure-car type, shall be
equipped with an emergency exit in the rear, or on the opposite side
of the entrance door, to be opened outward and capable of being
opened from either the interior or exterior of the bus. Such
emergency exit shall be equipped with positive devices to keep it
closed when not in use and of such character to permit it to be
opened readily when necessary without undue acce;>sibility for
unauthorized use. The size, location, and type of such emergency~~

exit must meet with the approval of the police department of the
County of Hawaii,
(f) No aisle in a school :pus shah be less than twelve inches
in width, The ceiling of all sohool busses must be free from all
projections likely to cause injury to a pupil., The ceilings over
the aisle and backrest of seats >f ~ school bus must be free from
projections of any k~_nc„
(g) No sea±s for pupils shall be placed ahead of a line drawn
crosswide of the bus irumediately back of tha driver's seat,

which shall be free iron projections of any kind, safe, and of
sufficient size to accommodate him, All seats shall be securely
fastened to the part or parts of the school hus supporting them,
(i) All. school busses shall be equipped with an adequate horn,
brakes, rear vision mirror, headlights, taillights, speedometer,
windshield constructed of safety glass, windshield wiper, steering,
mechanical handsignalling devirc if needed, and other equipment
required by law.
(j) It shall be unlawful for the driver o1= a school bus to
carry on unnecessary conversation while the said bus is in motion,
(k) No driver shall work as an operator or. be otherwise
employed for more than twelve hours in any 24-hour period,
(1) livery school bus shall be cleaned daily and kept in a
sanitary condition at all times,
(m) No driver while transporting school children shall leave
his bus while the engine is running or the brakes are released.
(n) iach school bus operator shall report to the police
department of the County- of Hawaii the license number of any motor
vehicle, the operator. of which is guilty of a violation of any
traffic regulation, when such violation in any way endangers the
safety of the pupils being transported,
(o) All side openings between the driver's seat and the rear
shall be screened with metal screen of not more than 1-3/4" mesh
and not less than No,. 16 gauge, all to the satisfaction of the
police department of the County of Hawaii,
The provisions of this paragraph shall not apply to school
busses equipped orith safety glass windows which are permanently
adjusted to permit not more than 50 per cent of the top portion of
said side openings from being opened,
(p) The words "SCHOOL BUS" shall be painted on the front and
rear of each such vehicle in such place and color as the Examiner
of Chauffeurs shall direct Said wordings shall be in letters of
not less than eight inches in height and :in strokes of not: less than
three quarters inch in width,

(a) Drivers of school busses shall at all times operate such
vehicles in a safe, prudent and careful manner with due regard to
the traffic and the use of highway by others.

(b) When any accident or damage occurs to or defect develops
in the bus so as to make it unsafe for traveling, the driver shall
immediately thereupon discontinue the use of the bus, and he shall
make all necessary arrangements for the safe transportation of
the pupils to and from their respective destinations,
(c) If any school bus is at any tires found or known by the
driver to be dangerous or unsafe for operation or reported by
anyone to the driver as being dangerous and unsaf.-e, the use of such
school bus for the transportation of pupils shall_ be discontinued
immediately thereupon, until properly examined, and if necessary,
repaired, and the certification that 1. he bus is in a safe condition
must firstly be obtained in writing i=rom an Official Inspection
Station appointed by the Chief of Police or a police officer of
the County of Hawaii,
(d) No school bus shall be put in reverse, or be backed while
on the school grounds or at any point or place where children enter
or leave the bus unless such movement can be made in safety,
(e) No school bus shall, when being ised for the transportation
of pupils, be operated or driven tiaith any trailer or other vehicle
attached thereto, nor shall anv school bus transport freight other
than the school books and o-thee school material carried by pupils
while carrying school children.
(f) No person shall operate a school bus wher, it is so loaded
or when any person is so seated as to interfere or obstruct: the
vision of the driver to the front, side, or, by means of tY~~.e mirror,
to the rear, or interfere with the operation of the bus.
(g) No school bus shall be operated with ±he clutch disengaged
except when coming to a stop, or with th> gears i:n neutral except
when the bus is not ir, motion.
(h) Smoking by the bus driver shall be prohibited whenever
pupils are being carried.
(i) No intoxicating liquor shall at any time be carried in a
school bus or upon the person of the driver,
(j) Each school bus shall be inspected daily by the driver,
before use, to ascertain that the windshield is clean and that the
lights, horn and other equipment and mechanical features of the bus
are in good and safe operating condition,
(k) Pupils being transported in a school bus shall be under
the authority and control of and responsible directly to the driver
of the bus, Continued disorderly conduct, or persistent refusal
to submit to the authority of the driver shall be sufficient reason
for refusing transportation to any pupil and for such other punish-
ment as the local school regulations may provide. The driver of
any school bus shall be held responsible for the csderly conduct
of pupils transported and shall immediately report. cases of
misconduct to the prinicpal of tl,e school.

(1) 4~Ihenever a school bu:; stops to discharge pupils who must
cross the street or highway in order i-o reach. their destination, such
pupils must cross the street or h_ghsaay in front of the bus, except
that when it is not practicas~le to cross the street or highway in
front of the bus, pupils may be permii_te~u' to cross behind the bus,
In either case, the bus shall not be moved from such point: until-all
pupils have crossed the street: or nigh*.ae:.y. In either case:, also, it
shall be the responsibility of the driver to see that pupils do not
cross the street or t:ighway until they may safely do so.
(m) All doors shall be kept closed while the bus is in motion.
(n) A school. bus stopping to load or discharge pupils outside
the city of Hilo shall stop as far to the right of the roadway as
possible whenever such stop can be made la.ith safety,
SECTION 4, Inspection of Equipment,
(a) The Chief of Police of the Coi:nty of Hawaii or his duly
authorized subordinates, which shall include Official Vehicle Inspec-
tion Stations, shall, before any passenger license is issued to the
said bus, inspect the bus for which a license is requested, and if-
he finds the same to be in good serviceable and safe condition for
the safe transportation of passengers, he shall deliver to the
applicant therefor a certificate setting forth the fact that the said
bus has been inspected and found to be safe for the transportation
of pupils,
(b) Ail vehicles used for the transportation of school children
shall be subject to a thorough inspection monthly, by the Police
Department of the County of Hawaii or any Official :Inspect:ion Station
so designated and authorized by the Chief of Folice, [,Vhen a vehicle
has been so inspected and found to be in a satisfactory operating
condition, the department of `:_nspecting station shall issue a
certificate of inspection, which certificate shall include a check
list printed on the reverse side, certifying as t:o the equipment and
mechanisms checked, and certifying to the adequacy and safety of the
vehicle and equipment, DIo vehicle without such a. certificate shall
be used and no clai.,a for the transportation of school children will
be paid unless accompanied ~.>y such a certificate of inspect=ion. A
copy of the said certificate shall be submitted each month to the
District Superintendent, Hawaii Island Schools.
SECTION 5. Penalties, i~ny person convicted of a violation of
any provision of this Ordinance shall, in addition to the penalties
provided by contract, be pur:ished by a f=ine of not more than Five
Hundred Dollars (?500,00).
