DEFINITIONS. Unless otherwisf: expressly stated, whenever used in this Ordinance the following terms shall be taken to have the following meaning: A. Garbage. Shall mean and include all organic wastes not fit for animal consumption. B. Rubbish. Shall mean and include solid waste or rejected material including, without limiting the generality thereof, paper and cardboard cartons, straw, excelsior, rags, clothes, shoes, bottles, tin cans, china, glass, metalware, leaves, grass, tree branches, tree stumps, and any other material of similar character; but not including such materials as lumber or iron pipes exceeding five feet in length, concrete blocks and tiles, cement, acids, ice boxes, refrigerators, ranges, radios, television sets, phonographs, bedsteads, bed springs, tables, sofas, chairs, and other furniture, water heaters, water tanks, sinks and other similar materials or equipment of a weighty or bulky nature. C. Swill. Shall mean and include all food wastes which are fit for animal consump~ion. D. Refuse. Shall mean and include all discarded and disposable matter, includinc, garbage, rubbish and swill as above defined. SECTION 2. REMOVAL OF GARBAGE, RUBBISH AND S41ILL. Every householder or occupant of any residence or business building or premises within the City of Hilo, County of Hawaii, shall remove or cause to be removed to the County Dumping Grounds all refuse from any residence or business building or premises; provided, however, that nothing herein shall prevent any such householder or- occupant from disposing of such refuse within his premises by burning, burying or destroying the same. All garbage and swill, prior to its removal to the County Dumping Grounds, shall be drained of all liquids, SECTION 3. RECEPTACLES. All garbage and swill shall be contained in leak-proof metal receptacles and shall be securely covered at all times so as to exclude insects and animals. All rubbish, except hedge cuttings, stumps, k~ranches, banana leaves, palm and cocoanut leaves and other similar materials, shall be contained in metal or wood receptacles, or in paper or cardboard cartons of sufficient strength to adequately contain the contents therein. SECTION 4. LOCATION OF REFUSE AND ECEPTACLES. All refuse and receptacles, as hereinbefore mentioned, shall be kept on private premises and shall not be placed upon any sidewalk or government right of way for collection purposes, excepting however, refuse Ord. It shall be unlawful for any person, firm, or corporation to engage in any business involving the collection and removal of any refuse from any premises within the limits of the City of Hilo, County of- Hawaii, without having first secured a license from the Treas~_trer of the County of Hawaii so to do, SECTION G, VEHICLES FOR REiIOVIldG REFUSE. All vehicles used for the collection and removal of refuse shall be kept in a clean, inoffensive and sanitary condition. All refuse shall be handled and hauled in such a manner so as to prevent the scattering, spilling or leaking of the same, SECTION 7, DEAD ANI7ALS. Every owner of dead cattle, horses, mules, goats, dogs, cats and similar animals within the County of Hawaii shall properly bury, burn or dispose of such dead animals within a reasonable tune after death, or before the same shall constitute a nuisance. SECTION 8. ?^,22ECKED, NOId-OPERATIONAL AUTOl;iOBILES AND SCRAP IRON. It shall be unlawful for any person, firm or corporation within the County of Hawaii to leave, abandon or place wrecked or non-operational autornol:~iles or construction equipment or parts or portions of such. automobiles or construction equipment, or scrap iron, or other similar materials, upon any part or parts of the public streets, roads, or highways or upon any premises of another. SECTIOTJ 9. RELIOVAL OF DOORS OF ABAI?DONED REFRIGERA7.'ORS, ETC. It shall be unlawful for any person, firm or corporation within the County of Hawaii to abandon refrigerators, ice boxes, wardrobe trunks, or any other container, equipment or appliance having self- locking doors without first removing and detaching the doors or covers from the same. SECTION 10. EXPLOSIVES, ALii.IUI?ITIOid, ETC . It shall be unlawful for any person, firm or corporation caithin the "County of Hawaii to dump, place or remove to any County Dumping grounds any explosives, blasting materials, fuses, live ammunition or any other substance or material that may explode upon contact with heat or fire, SECTION 11. DUT:iPItdG REFUSE IId VACAPl'T LOTS, ETC. It shall be unlawful for any person, firm or corporation within the County of Hawaii to dump or place refuse in or upon any vacant lot, public place or in or upon the premises of another, SECTION 12, PEP}ALTY. Any person violating any of the provisions of this Ordinance shall be guilty of a misdemeancr and upon conviction shall be punished by a fine not exceeding Five Hundred Dollars (:500.00), SECTION 13, SEVERABILITY. If any section, sentence, clause or phrase of this Ordinance, or the application thereof to any person or circumstance is for any reason held to be unconstitutional or invalid, the remaining portions thereof or of the portion concerned to any other persons or circumstances shall not be affected, -2-
