COUNTY OF HAWAII - STATE OF HAtiJAII
ORDINANCE N0. 48
AN ORDINANCE PROVIDING FOR THE REGULATION AND CONTROL OF
SIGNS, THE LOCATION, ERECTION, MAINTENANCE AND USE OF SIGNS,
AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF' THE COUNTY
OF HAWAII:
SECTION 1. Legislative Intent.
The Board of Supervisors finds and declares:
(a) That the people of the County of Hawaii have a
primary interest in controlling the erection, location and
maintenance of outdoor signs in a manner designed to protect
the public health, safety and morals and to promote they public
welfare; and
(b) That in the past few years there has been a
marked increase in the number and size of signs advertising
business activities in the County of Hawaii; and
(c) That the increased number and size of such signs,
coupled with the increased use of motor vehicles make it
imperative that the public streets and highways be kept free
from signs which distract motorists' attention from driving,
and which detract from the attention which should be devoted
to signs promoting traffic safety; and
(d) That the indiscriminate erection, location,
illumination, coloring and size of outdoor signs constitute
a significant contributing factor in increasing the number
of traffic accidents on the public streets and highways,
by detracting from the visibility of official traffic lights
and signals, and by tending to distract and divert the
attention of drivers away from the flow of traffic movement;

(e) That in addition thereto, the construction,
erection, and maintenance of large outdoor signs sus,~ended
from, or placed on top of '~uildings, walls or other strur_tnres
constitute a direct danger to _~edestri.sr. traffic ~~elo~•• sucYz
signs, especiall~~ duri~lg ~~eriods ~..hez ?.,;nds of hi,;;'Z velocity
are prevalent; and
(f) That the size and ].ocat.i.on. of such outdoor
signs ma~~, if uncontrclled, constitute ai. o~~stacle to effective
fire-fighting techni_ruesy and.
(g) That the natural beauty of landscape, vie~•-, and
attractive surroundings of the IIa~•~aiian Islands, i_ncludinp
the County of Ha~•~aii, constitutes a~~ attraction for tourists
and visitors; and
(h) That a substantial source of income and revenue
of the people of the Count_,. of fia~~~aii is derived from the
tourist trade; and
(i) Thhat the indiscrima.nate erec'ion aid m~=!i_ntenance
of large signs seriousl,,~ detract -~',rom the en;o~ment and
pleasure of the natural scen'_c rae uty of t?ze County of Ha*•~ii,

SI;CTIC:~ ?. Definitions.
The folloz•~ina ~•~ords and ~'xzrases shall, ^or the purposes
hereo.E, have the meanings respectively ascribed to them .i,n this
Section, unless it is an~~arent from the context that a
different meaning is intended::
(a) "Sign" shall mean end include every sign,
device, figure, ;painting, dra~•>ing, message, placard, roster,
billboard, ground si.rtn, x•211 sirn, roof sign, illuminated
sign, projecting sign, temporary sign, marquee, a*,+ning,
cano~~y, and street clock, and shall include an~> announcement,
declaration, demonstration, display, illustration or insignia
used to advertise or promote the interests of an~~ person
u>hen the same is placed out o£ doors on real pro_~erty or
'~uildings or structures thereon in vie?•> of the general 1~u?~lic.
('~) "P'arquee Sian" shall mean any sicn attached to,
or hung from a marruee. .T. "A:arruee" shall mean a canopy or
covered structure projecting .crom and su!~~orted by a building,
~•fien such canopy or covered structure extends t?e~~ond the
'wilding, '~uildinre line or ;~roperta line.
(c) "Projecting Sign" shell mea;> >~?~> sign ~>hich is
affixed or attached to, and ~.s sup~~ortec~ solel-~ '~~- a '~ui.ldna
x•211 or structure, and extends '~eyond the '~uildina x211,
structure, or ,arts thereat', more than 1~ inches and ~•>hose
angle of incidence to said '~uildinr e>~11, struct~zre, or parts
thereof is greater than 3(1 degrees.
(d) "Ground Sic.n" shall mean a sicrn t•fiich is a
complete self-supported structure and is not attached. or
affixed in any ur3v to a '~uildincx or structure.
(e) ":.goof Sian" shall mean a sign erected, constructed
and maintained ?~fioll~> u.~on and over the roof o.~ amp `?uildinR.
(f) "*'all Sign" shall mean a sinn *•_
filch is affixed

sign shall ~~roject not more than 15 inches crom the buildi_nry

(?) "Illuminated 3i^n" shall mean any siryn *•filch
has characters, letters, yigures, designs or o?ztline illuminated
'~~~ electric lights or luminrnis tu'-~es as a ~~art of the sign
~~ro~~er.

(h) "Chief Engineer" shall mean the chief engineer
of the Department of nbli.c ''orl:s.
SECTIC:? 3. Exem ~t 3iens.
The follo~•~inq t,~pes of signs are exem;~ted Erom all
of the ~~rovisions o this Cr~c'i.nance, exce?t for the requirements
of Section i(a), (c) and. (d), section 7(a), ('~), (c) and (i),
and Sect i_on " .

(2) Real estate signs. Signs not exceeding
eight square feet in area advertising the sale,

rental, or lease of the premises may '~e ~~e,rmitted
i_n such manner as to '~e visi'~1e to traffic proceeding

(3) Su'~div~_sioz signs. Sims announcing the
subdivision and improvement of property ~•+here
located on the pro ~ert~T to '~e improved, not to
exceed one sign for each mile or Fraction thereof
of such property alonc* the street or high,•~av,
provided such signs shall. not exceed 32 square
feet in area. Such signs may, not '~e erected
until a formal application for subdivision has
been filed ~•~ith the ~n~~re,~ri.atc County Ciicials.
Said signs are exem__,ted from tha t,rovisions of

(d) Public signs. Signs of a public, non-commercial
nature, ~+hich shall include sa°pt•;~ signs, danger signs,
trespassing signs, signs ind;catinry scenic or historical
_~oints of interest and all signs erected by a ~-~ublic officer
in the performance of a nu'~~lic duty.
(e) D;rectional sines. vi!?ns serving as directional

reconstructed after the efEecti~re date of this Ordinance,

+•+ri.ti.nq from the Chief Bnnineer, and makinn navment o:E the

(1) The name and ac'idress of the ap~~licant
and of the .person '_~•~ ••+hom such sign i_s to '~?e constructed,
erected, altered, relocate, or reconstructed.
(2) >n accurate descr+_~tion of the location
or pro.~osed location and character of each sign.
(3) A ;~1an or desi_~n of the sign sho~•~inR its
+•~eight, dimensions, linhti..nc equi~~ment, materials,
details of its attachment and hanri.~zn and its
position relative to the ',uildi.ng and street lines.
(4) An+r electrical _~ermits required and i.ssrxed.
for said sign.
(5) Such other information :~erti.nent to the
a~~~lication as may '~e required '~v the C'lief Engineer.

The an~li_cat;on for a permit for a sign i_n ~>n;_ch electrical
~•~irinq and connections are to '~e used shall '~~~ sd~mitted to the
Electrical Inspector. The Electrical I-~s~ector shall examine
the Mans and s~~ecifications respecting all t••.rina and connec-
tions to determine iF the same com~ln .••+_th the Electrical Code
of_ the Count•~ of Ha*^i.i, and 'ze shall a~-,rove the an~L.cation
tf the glans and s~eci.fica~ions com~l~r ~•+.th said code or disa~-

The action of the Electrical Ins^ector shall '~e taken prior to

(e) Disposition of fees. The Chief Enntneer shall. kee~~
an accurate record, in a form a~~•~roved '~~~ the auditor, of all
fees received and shall deposit all fees received ~•~ith the
Treasurer to the credit of the general fund at least once each
~~2e]c; shall render an account of all ;?ermits issued and monies
received therefor each month to the Board of Supervisors; and
shall maintain for public ins,^ection a record of all 'permits
issued.
(f) Permit issued if anplicati.on in order. It shall be
the dut~~ of the Chief Engineer, upon the filing of an a~~~lica-
ti.on for a Hermit hereunder, to examine such ;:Lars, s;~ecifica-
bons and other data and the _~remises upon •~'hich it is ~ro~osed

(h) ITU11i_fication of hermit. IE the •••ork authoria,ed under
a hermit has not been su'~stantially com_~leted T•ithi.n si`L months
after date o` issuance, then such ?ermi.t shall become
void and ana sign installed, constructed, erected, relocated, or
altered thereafter under such hermit shall constitute a viola-
tion of the terms of this Crdina~zce.

{a) Ch;.eE 3n~+inner. The Chief ~nni-Weer i.s charnel. ••ith

shall render such assistance, as is consistent ~••;_th the usual
duties of the;_r res~~ective departments, to the Chi_e` Engineer
at his reouest.
(b) :?ion-conformi_nq si.q±ZS, Any sign erected >>rior to the
effective date of this Ordinance, ;,~ compliance ~••ith all then
existing statutes, ordinances and regulations, shall be nernii_tted
to be maintained as anon-concorminR si~*n, subject to the follo4~ing
condit;onse
(1) Safe condition, ion-conforming signs shall be
'tee maintained ;_n a safe condition and shall not in an<~
respect be dan,~rerous to the ;~ubli_c or te -~ro~ert~~.
(~) :alteration or relocation. 7;~on the alteration
or relocation of an•~ non-conforminn si.cn or the d;_scon-
tinuance or removal From the ~rem~.ses of the activity
to ~•~hich such sign relates, such sign shall cease to be
a non-conforming sign and shall thereafter ~^e nerm:itted

person of the violation or of the dangerous condition of such
sign and directing him to make such alteration or repair or do

(g) Distance above ground. The lo~•+er edge of all signs

(1) Any marquee or projecting sign permissible
under subsection (d).
(2) Ground sign. one ground sign, lighted or
unlighted, not exceeding 75 square feet in area,
relating to businesses conducted on the premises,
and not exceeding 15 feet in height from the ground.
(3) Roof sign. One roof sign, lighted or
unlighted, connected ~•~ith a business conducted on
the premises, provided (a) on flat-roofed, single-
storied buildings, the height of any such sign shall
not exceed more than five feet above the roof; (b) on
other than flat-roofed, single-storied buildings, the
sign shall not project above the roof ridge and the
sign area shall be less than one-fourth of the
projected vertical area of the side of the roof on
which it is placed, or 400 square feet, whichever
shall be the lesser.
(4) hall sign. Cne wall sign, lighted or
unlighted, per side or rear of the buildina to
r+Ytich such sign is attached, relating to businesses
conducted on the premises, and not exceeding 25 per
cent of the area of the total exposed urall on which
such sign shall be displayed. Pall signs on the face
of the building for each business therein conducted
shall not exceed 25 per cent of the area of the face
of the building actually occupied by said business.
SECTION 9. Penalty.
(a) Any person urho fails to comply with the requirements
set forth in the ~•n'itten notice ~•rhich is issued pursuant to
Section 5(c) shall, upon conviction, be punished by a fine
not exceeding $500.
(b) The failure to comply with the requirements set
forth in a ~.+ritten notice issued pursuant to said Section 5(c)

within the period of time prescribed therein, shall be deemed
a new offense for each day o:E such non-compliance.
SECTION 10. Variances.
The Board of Supervisors shall have the power to grant
variances from the operation of any provision of this Ordinance
to an applicant for a permit in any case when, in the opinion
of the Board, the enforcement thereof would work a hardship
upon such applicant, and where the granting of a variance would
not be contrary to the spirit and purpose of t: his Ordinance
and the public interest,
