BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HA'~VAII: SECTION 1. Title and Purpose. A. Title. This Ordinance shall be known as the "Electrical Code," may be cited as such, and is referred to herein as "this Code." B. Purpose. The purpose of this Code is to reduce the hazards to persons and property from electrical causes. To accomplish this, the requirements set forth herein are intended to provide a minimum standard for electrical installations in the County of Hawaii. SECTION 2. Scope. A. Scope. The provisions of this Code shall apply to all electrical work and installations in the County, with exceptions as covered by Section 90-2(b) of the 1965 National Electrical Code and the following: 1. Electrical work on buildings or premises owned by or under the direct control of the United States or the State of Hawaii. 2. Electrical work by an electrical utility or serving agency supplying electricity, operating under a franchise or charter granted by the State of Hawaii on the following: a. Any generating plant, receiving station, switching station or distributing station, under the control of such utility or serving agency; b. Any electrical wiring for supply lines or mains under the control of such utility or serving agency; and c. Any electrical wiring for overhead service drops, or underaround or station service supply conductors under the control of such utility or serving agency. 3. Electric wiring by a public telephone or telegraph communication utility subject to regulation by the Public Utilities Commission of the State of Hawaii for the following: a. Is used solely for communication purposes between premises; b. Does not constitute part of the electric supply for communication apparatus; fed. k .---'-.~-L"r File lip. 1/. i. !a pates c. Is nct located in a "hazardous location" as defined in THE NATIONAL ELECTRICAL CODE. 1965 EDITION. 4. The provisions. of this Code shall not apply to a Municipal System for street lighting, traffic signal or police and fire alarm where installed outside of k~uildings on public property. 5. The physical placement and reassembly of an electric sign, x-ray equipment or household appliance. 6. Existing electrical installations which complied with the laws, ordinances and regula-lions in effect when the electrical work thereon was performed, provided that such installations shall be subject to the provisions of Subsection C of Section 4 hereof. 7. Electrical work in accordance with the laws, ordinances and regulations in effect prior to the effective date of this Code under a permit therefor issued prior to such date. 8. All buildings moved into or relocated within the County shall comply with all regtairements of this Code for new buildings. 9. Electrical work related to work regulated by Chapter 22 of Rule XX of the Department of Labor and Industrial Relations of the State of Hawaii, relating to the Elevator Code, but not including electrical work for the supply of power to the control panels of elevators, dumb-waiters, escalators, moving walks and manlifts. 10. Replacement or repair of devices and apparatus of air conditioning and refrigeration systems, except electrical work on overcurrent devices which are not physically attached to, or physically mounted on, such systems. B. Interpretation - Same Subject Matter. If there are two or more provisions in this Code or any other ordinance or statutes, covering the same subject matter, the provisions which provide the greater safety to life or limb, property or public welfare shall prevail. SECTION 3. Definitions. The following words and phrases when used in this Code shall have the meaning respectively ascribed to them in this section, unless it is apparent from the context that a different meaning is intended: A. Administrative Authori~. Nlhenever the term "Administra- tive Authority" is used in this Code, it shall be construed to mean the Chief Engineer of Hawaii County Department of Public Works or his authorized representative. B. Assistants. Whenever the term "assistants" is used in this Code, it shall be construed to mean the authorized representa- tives of the Administrative Authority. C. Apprentice. A person who performs electrical work under the direct supervision and in the presence of a supervising electrician, -~- supervising specialty electrician, journeyman electrician or journeyman specialty electrician. D. Board. The Board of Electrical Examiners. E. Department. The Department of Public i~"forks of the County of Hawaii. F. Electrical Contractor. Any person who has been certified by the Examining Board and is registered with the Department to do business as an electrical contractor and enters into contracts with property owners or contractors for the performance of electrical work. G. Electrical Specialty Contractor. Any person who has been certified by the Examining Board and is registered with the Department to do business as an electrical specialty contractor and enters into contracts with property owners or contractors for the performance of electrical work related to installing, repairing, altering and main- taining, but not the attachment of lighting and power circuits to, the following: (1) electronic equipment, sound public address systems and communication systems; (2) radio and television receiving antenna systems; (3) sound recording systems; (4) burglar and fire alarm systems; (5) low voltage remote control; and (6) low voltage communi- cation signal systems. H. Electrical Work. The installation, alteration, reconstruction, or repair of electrical wiring. I. Electrical Wiring. Any conductor, material, device, fitting, apparatus, appliance, fixture or equipment, constituting a part of or connected to any electrical installation, attached or fastened to any building, structure or premises and which installation or portion thereof is designed, intended or used to generate, transmit, transform or utilize electrical energy within the scope and purpose of the National Electrical Code referred to in Section 16 of this Code. J. Emergency Electrical Work. Repair of electrical wiring to restore electrical service to a building following a fire, remedy a power failure and protect persons and property against short cir- cuiting and open circuits. K. Journeyman Electrician. Any person who has been certified by the Examining Board and is registered with the Department as a journeyman electrician to perform electrical work under the supervision of a supervising electrician. L. Journeyman Specialty Electrician. Any person who has been certified by the Examining Board and is registered with the Department as a journeyman specialty electrician to perform electrical work related to installing, repairing, altering and maintaining, but not the attachment of lighting and power circuits to, the following: (1) electronic equipment, sound public address systems and communica- tions systems; (2) radio and television receiving antenna systems; (3) sound recording systems; (4) burglar and fire alarm systems; (5) low voltage remote control; and (6) low voltage communication signal systems. -3- M. Maintenance Work. The keeping in repair and operation of any electrical installation, apparatus, fixtures, appliance or equipment. N. Motion Picture Operator. Any person who has been certified by the Examining Beard and is registered with the Department for the purpose of operating a movie projector using 35 mm film or larger for commercial purpcses. 0. Person. Any individual, firm, partnership, association or corporation, provided that a firm, partnership, association or corporation a.re not included withirr the meaning of person found in the definitions for journeyman electrician, journeyman specialty electrician, supervising electrician, supervising specialty electri- cian, and motion picture operate r. P. Supervising Electrician. Any person who has been certified by the Examining Board and is registered with the Department as a supervising electrician to direct and supervise the performance of electrical c~rcrk and to perform electrical work. Q. Supervising Specialty Electrician. Any person who has been certified by the Examining Board and is registered with the Depart- ment as a supervising specialty electrician to direct and supervise the performance of electrical work related to installing, x•epairing, altering and maintaining, but not the attachment of lighting and power circuits, to the following: (1) electronic equipment, sound public address systems and communications systems; (2) radio and television receiving antenna systems; (3) sound recording systems; (4) burglar and fire alarm systems; (5) low voltage remote control; and (6) low voltage communication signal systems. SECTION 4. Administration and Enforcement. A. D~epartme~nt Havin~Jurisdictiorr. Unless otherwise provided for by law, the Department o Public Works of the County shall have jurisdiction over and administer all matters covered by this Code. B. Right of Entry. Upon presentation of proper credentials, the Administrative Authority or his Assistant may enter at reasonable hours any building, structure or premises to perform any duty imposed upon him by this Code. Nc person shall hinder or prevent the fore- going right of entry of the Administrative Authority or his Assistant. C. Inspection and Prccedures. 1. All electrical wiring, for which a permit is required, shall be inspected and approved by the Administrative Authority before being concealed, energized or used. All fees required by this Code shall be paid by t'rie permittee prior to the energizing or use of such wiring. 2. No person shall use, operate or maintain, or cause or permit to be used, cperated or maintained, any electric wiring until it is inspected and approved. 3. No serving agency shall supply, or cause or permit to be supplied, electric energy to any electric wiring until the wiring has been inspected and approved. -~ - EXCEPTION, Temporary construction services installed by the serving agency for temporary use, as prescribed under this Code. 4, No person shall conceal, enclose or cover, or cause or permit to be concealed, enclosed or covered, any portion of any electric wiring or equipment in any manner which will interfere with or prevent the inspection and approval. thereof, 5. Fixtures, appliances, devices or equipment shall not be connected to any electric wiring until the rough electric wiring, including conductors have been inspected and approved, except as otherwise satisfactory to the department. 6. All obstructions, covers, plates, tapes, etc., which makes impracticable the making of a thorough inspection of electric wiring shall be removed upon notice (either verbal or in writing) to do so, and shall be kept :removed until the electric. wiring has been inspected and approved. D. Defective Electrical Installations. Whenever any electrical installation is found to have been installed, altered, changed or reconstructed contrary to the provisions of this Code or any other law, whenever any electrical installation is found to be in use contrary to the provisions of t}:is Co~!e or any other law, or whenever amp electrical installation, which compl:iad with the existing laws, ordinances and regulations in effect when the elec- trical work thereon ~~.~as performe_~, is found to be unsafe or dangerous to persons or property, the Administrat:ivc Authority shall give the owner or the person i.n control of such installation a written notice stating the findings vdii:h respect to such installation and order the owner or sur_h other person to make the corrections to be set forth in such written notice. E. Request for inspection. Jhenever any work regulated by this Code, or any portion thereof, i_s ready for inspection, the Administrative Authority shall be notified by the person that same is ready for inspection. The notice shall be in writing on forms furnished by the Administrative Autho.r.ity, or may be by telephone at the option of the Administrative Authority. The notice shall be filed with the Department not less than 24 hours and not more than 72 hours before any such inspection is desired. 1. The Administrative Authority shall proceed to inspect the same within 48 hours, not including Sundays or holidays, after receipt of such notice, and if said work conforms in all respects with the provisions of this Code, }~e shall attach a notice granting authority to prxeed with installations. 2. No electrical wiring shall be covered or concealed until the said 48 hours have expired after notice to the Administrative Authority has been received in his department, or until the Administrative Authority has approved the installation and given permission to cover or conceal the same. Should the Administrative Authority condemn any of said work or equipment, as not. being in accordance with the provisions of this Code, notice in writing to that effect shall be given by him to the person engaged in the work. _5_ 3, Within a reasonable time thereafter such work or equipment shall be altered or removed as the case may require, and necessary changes shall be made so that all such work and equipment may fully comply with the provisions of this Code before further work is connected on or with such condemned work or equipment., In default, said Electrical Contractor shall be liable to the penalties provided in this Code, and any and every owner, contractor or other person engaged in construction of the building or structure, or otherwise, coveriny or allo~~ving to be covered such portion of work or equipment, or removing any notice not to cover same placed thereon by the .Administrative Authority shall likewise be liable to the penalties in this Code provided. F, Final Inspection Required. 1. No person shall use or supply electrical energy to any electrical installation on which electrical work was or is being performed under a permit issued pursuant to the provisions of this Code before the Administrative Authority has approved such installation. 2. Whenever electric wiring has been approved, a certificate of inspection therefor shall be issued on demand, provided all fees required by this Code have been paid. G. Re~onsibility for Compliance. Every person installing, altering, repairing, using or maintaining electric wiring shall be responsible for compliance with this Code. H. Liability of Persons. This Code shall not be construed to relieve from or lessen the responsibility of s~_ach person oNming, operating or installing any eler.~~rical wirers, appliances, apparatus, construction or equipment fnr damages to any one injured by any defect therein. I. Non-responsibili±y of County. Neither the County of Hawaii, nor any department, board, commission, officer, employee, or the Administrative Authority thereof shall be held liable or responsible for any damage or injury caused by or resulting from the issuance of any permit issued, or any inspection or approval or issuance of a certificate of inspection, made under the provisions of this Code. SECTION 5. Permits Required; Exceptions. A, Permit Required and Exceptions. No person shall perform any electrical work or cause or permit the same to be done, unless a permit therefor has been obtained from the Administrative Authority with the following exceptions: 1. Electric work and installations to which the provisions of this Code are expressly declared to be not applicable. 2. Installation of any portable motor or other portable appliance energized by means of a cord or cable having an attach- ment plug and, if such cord or cable is perrnitted by this Code. -6- 3. Repair of any fixed motor or other. appliance, or replacement of any fixed motor with another. having the same horsepower rating and situated at the same location. 4, Replacement of attachment plug receptacles, but not the outlet therefor. 5. Maintenance work by a supervising electrician, supervising specialty electrician, journeyman electrician or journeyman specialty electrician employed as a maintenance electrician by someone other than an electrical contractor or electrical specialty contractor. 6. Emergency electrical work by a pex•son to whom a permit may be issued. 7. Electronic equipment, sound public address systems and communication systems. 8. Radio and television receiving ant:enna systems. 9. Sound recording systems. 10. The provisions of the foregoing exceptions shall not apply to any repairs or replacements of electrical devices, apparatus, or appliances which were originally installed without a permit vahen such permit is required for the original installation, or when energized by, or which is a part of any hazardous or illegal wiring system. 11. The foregoing exceptions from permit requirements shall net be deemed to allow any electric ~~~iring to be done in a manner contrary to o'.:her provisions of this Code. B. Scope of rermit. 1. The issuance of a permit is not an approval or an authorization of work specified therein. A permit is merely an application for inspection, the issuance of which entitles the permittee to inspection of the work which is prescribed therein. 2. Neither the issuance of a permit nor the approval by the Administrative Authority of any document shall constitute an approval of any violation of any provision of this Code or of any other law or ordinance, and a permit or other document purporting to give authority to violate any law sha1:1 not be valid with respect thereto. C. Emergency Work. Nlhen emergency electrical work :is commenced without a permit, an application for a permit for the work shall be made pursuant to the provisions of Section 7 hereof as soon as possible after the work i commenced. SECTION 6. Sepflrate Permits. A separate permit shall be obtained for each building or structure, except t:hat a permit for a main building may include electrical. work for a private garage, -7- shed, or accessory building located on the same premises as the main building, and supplied by a feeder or circuit from the main building. SECTION 7. Application for Permit. A. Filing. To obtain a permit, the applicant shall file an application on forms furnished by the Administrative Authority. The application shall contain all information necessary to the lawful enforcement of the provisions of this Code. B. Plans and Specifications. The application shall be accompanied by approved plans and specifications or a suitable diagram when and as required by Section 8. C. Issuance of Permit. L1hen the Administrative Authority determines that the information on the application and plans is in conformance with this Code, the Administrative Autherity shall issue a permit upon receipt of the total fees. D. Exceptions. Nothing contained in this Code shall be construed to require the Administrative Authority to immediately accept or reject any application, whenever it is necessary to investigate the proposed evirinq and premises as to its compliance with this Code, or it is necessary tc check plans and specifications accompanying the application. SECTION 8. Plans and Specifications. Plans and specifications giving such details of the propcsed installation as may be required by the Administrative R,uthorit.y shat.]. be filed with the application. Such plans and specifications shall bear 'the approval of either a professional engineer registered in the State of i-lawaii as especially qualified in the electrical }iranch of engineering, or a professional architect or other engineer rc,gistered in the State of Hawaii and qualified in such work. by experience. provided that if the demand load of the proposed ins±allation is less than thirty (30) kilo-volt- ampers, this requirement shall be applicable only if the Adminis- trative Authority so directs. No person shall materially deviate from any approved plan or specifications or fail, neglect or refuse to comply therewith, unless permission to do so has first been obtained from the Depari;ment. SECTION 9. Issuance. If the Administrative Authority is satisfied that the installation described in the application will conform i:o the provisions of this Code and all. pertinent laws, and the fee prescribed in Section 14 hereof has been paid, he may issue a permit to the persons specified in Section 10 Hereof. SECTION 10. Persons to 6'Jhom Permits May Be Issued. A permit may be issued only to: (1 any person to do any electrical work regulated by this Code in a single family dwelling used exclusively for living purposes, includinca the usual accessory building and quarters in connection with such buildings in the event that any such person is the bona fide owner of any such dwelling and accessory building and quarters, and that the same a:re occupied by or designed to be occupied by said owner provided, th„± said owner shall personally purchase all material and shall personally perform all labor in connec- tion therewith; or (2) a supervising electrician or supervising specialty electrician: -8- A. Who is an electrical contractor or electrical specialty contractor; or B. VJho is empioyec' by an electrical contractor or electrical specialty contractor for work of the electrical contractor or electrical specialty contractor; or C. 'aVho is employed as a maintenance electrician by someone other than an electrical contractor. or electrical specialty contractor; or D. Who is donating his services as an electrician o:r specialty electrician to an eleemosynary institution in connection with electrical installations of a temporary nature; or E. Who is applying for a permit for electrical or specialty electrical work for his own dwelling. F. Who is employed by the County. SL-CTION 11. Content; Posting; ~^Jhen Null and Void. Every permit shall be issued in such form and detail as shall be prescribed by the Administrative Authority, shall specify the geographical location of the premises whereon the work authorized thereby is to be done, shall be valid only for the location so specified, and shall be conspicuously posted by the holder thereof on the premises. If the work authorized by any permit shall be continuously suspended for a period of ninety days, such permit shall thereupon, and there- after, be null and void. SL-C TIO.J 12. Transferability. No permit shall be assigned, transferred or leaned to another by the person to whom it was issued. SECTION 13. ~usoension or Revocation. The Administrative Authority may, in writing, suspend or revoke a permit issued under provisions of this Code whenever the permit has been issued in error or on the basis of incorrect information supplied, or i.n v:iolation of any ordinance, regulation or provision of thi~~ Code. In such event, the permit fee shall not be refunded. SECTION 14. Permit Fees. A. To Whom Paid. A fee in accordance with the schedule set forth hereinafter shall be paid to the County Treasurer for each permit. B. Schedule. 1. Issuing Permits. A fee shall be paid for issuing each permit in addition to all other charges specified herein 81.00 each. 2. Service Installations. Portable Electric Signs. A "portable electric sign" means a small advertising contrivance operated with electricity and used in interior of buildings only; which is capable of being moved or removed at will without damaging or altering the structure or finish at or adjacent to the location thereof, and which is not: attached or fastened in place by nails, screws, bolts, conductors, wiring enclosures or in any other manner. No fee shall be required for such portable electric signs when the outlet and circuit to which it is attached has been installed pursuant to a valid permit. 14. Liqhtinq fixtures. For each set of ten fixtures or fraction thereof: (fees to be charged only when circuit wiring is excluded.) $1.00 15. Motors. (Fees are to be charged only when circuit wiring is excluded.) 19. Repairs, alterations, additions. Outlets added to existing circuit>. Standards for Electrical Work. A. Adoption of the National Electrical Code. THE NATIONAL ELECTRICAL CODE, 1965 EDITION, adopted May, 1965, and published by the National Fire Protection Association, is hereby adopted by reference and made a part hereof. Three copies of said Code shall be kept on file and be available for public inspection in the County Clerk's Office. The scope, technical specifications and exemptions set forth in said Code are hereby adopted as the standard for electrical work covered by i;he Code, if there are no specific provisions in another secticm of this Code covering the particular matter. B. Compliance Required. iJo person shall do or cause to be done any electrical work which does not comply with the provisions of this Code. -15- SECTION 17. Standards for Performance of Electrical Work. Except as otherwise provided herein, no electrical work for. which a permit is required shall be performed by any person who is not a duly certified and registered supervising electrician, supervising specialty electrician, journeyman electrician or journeyman specialty electrician, provided that each super°~ising electrician, supervising specialty electrician, journeyman electrician, er journeyman specialty electrician, may be assisted in the performance of such work by an electrician's helper or an apprentice in an ele-ctrical apprenticeship program under Chapter 89, Revised Laws of Ha~~~aii 1955, and provided further that pole and linemen employed by the County shall not be prohibited by the provisions hereof front performing electrical work within the scope of their employmer;t. SECTION 1B. L-xamining Board. A. Composition. There is hereby created a Board of Electrical Examiners, hereinafter referred tc as the Board, consisting of two supervising electricians, one supervising specialty electrician, the Administrative Authority, and a senior member electrical inspector. The members of the Board other than the Administrative Authority and the senior member inspector shall not be government employees and shall be appointed by the Chairman and Executive Officer of the County with the approval of the Board of Supervisors. The Administrative Authority and the inspector shall have a voice but no vote in the proceedings of the Board. The Board shall elect a chairman and a vice-chairman. The vice-chairman shall act. as the chairman in the temporary absence or disability of the chairman. The Administrative Authority shall provide a secretary for the Board, B. Term of Office. Each member shall servEa for a term coterminous with the term of the Chairman and Executive Officer, and any member may be removed from office sooner, for cause, by the Chairman and Executive Officer with the approval of the Board of Supervisors of the County. C. Compensation. The members of t}re Board,. other than the Administrative Authority and inspector, shall be paid $10.00 for each meeting attended, but not more than $50.OG in an.y one month. D. Expenses. The Board may incur such expenses as may be necessary and proper in the performance of its dui:ies and functions, for which appropriations have been made by the Board of Supervisors of the County. Disbursements therefor shall be made by warrants issued on vouchers signed by the chairmac~ or acting chairman of the Board. E. Rules. The Board shall adopt reasonable rules for the performance of its duties, provided that no action shall be taken by the Board unless the action receives three or more votes. F. Duties and Powers. 1. Appeal. The Board shall hear any appeal by any person aggrieved by a decision of the Administrative Authority. -16- 2. Bxaminatior,s. The Board shall examine applicants for certification as supervising electrician, supervising specialty electrician, journeyman electrician, journeyman specialty elec- trician and motion picture operator and shall submit to the Department the names of applicants who have qualified for certi- fication as supervising electrician, supervising specialty electrician, journeyman electrician, journeyman specialty electrician and motion picture operator by passing the examina- tion therefor prescribed by the Board with a grade of seventy (70) or more. Provided, hoU.~ever, that, if any applicant for certification as supervising specialty electrician and journeyman specialty electrician was a bona fide, ful].-time employment as supervising specialty electrician and journeyman specialty electrician prior to the date of adoption of this ordinance, in the County of Hawaii and has been so engaged since that date, the Board shall issue such cer±ification. without examina- tion, if application for such certification is made to the Board as provided under this Code and within ninety (90) days after this Code shall take effect. Other~.vise, the application for such certification shall be decided in accordance with the procedure provided in this Code and such certification shall be issued or denied accordingly. Pending the determination of such application, the continuance of employment in the several specialties concerned shall be lawful. 3. Determination on Compliance with Subsection D of Section 19. The Board shall determine whether or not applicants for certification as electrical contractor or electrical specialty contractor meet the requirements therefor in Subsection D of Section 19 hereof and steal]. submit to the department the names of applicants who meet; said requirements. 4. Appeal from a Denial. of Re-registration. The Board shall hear all appeals from any denial of re-registration by the Administrative Authority under the provisions of Section 21-C hereof. Pending and subject to the determination of an appeal, the Board may authorizE: the appellant to be re-registered with the department. A denial of re-registration shall be reversed on appeal only if the Board finds that the appellant meets the requirements applicable to the class in which he has applied for re-registration, l%Jhen a denial. of re-registration is sustained, any re-registration granted pendiny the determi- nation of the appeal shall be cancelled. 5. Revocation or Suspension. a. Revocation of Certificate. The Board shall revoke tFie certi icate and reaistration of any person whenever it finds that the certificate has been obtained by fraud or misrepresentation. Upon such revocation, no certification and registration cf such person shall be allowed for a period of six months thereafter. b. Suspension of Registration. The Board shall suspend the registration of any supervising electrician, supervising specialty electrician, electrical contractor or electrical specialty contractor who allows his certification or registration card to be used directly -17- or indirectly for obtaining a permit for the performance of electrical work which is not under his supervision or connected with his electrical r~usiness. Such suspension shall be for a period of net mere than six months. c. Permissive Suspension or Revoca~ion. The Board may suspend for such period as it deems advisable or revoke the certificate and registraticn of any person for being principally engaged in a vocation or business other than that for which the certificate or registration were issued, failing to comply with the applicable provisions of this Code after having received written notice of violation thereof from the r~.dministrative Authority, making a misrepresentation in an app]-ication for a permit or obtaining the registration by fraud or misrepresentation. Upon such revocation er suspension, no certification and registration of such person shall be allowed for a period of six months thereafter-. d. Hearing 'befcre Rcvocatian or Suspension of Certificate or Reristrat;ion. Before any such certificate or registration is revoked or suspended, the Board shall hold a hearing, at .which time the person may appear before the Board in defense of his certificate or registration. He shall be giver-, at least ten (1.0) days' written notice of such hearing. If after careful consideration of all 'the facts ir, the case the Board finds that the certificate or registration must be revoked or suspended ~~r that it may revoke or suspend the certificate or registration and the certificate or registration should. be revoked or suspended, the Board shall so order and such order shall take effect immediately thereafter. G. Administration of Oaths and Issuance of Subpoenas. The Board shall have the power to administer oaths and issue subpoenas, as prescribed in Section 7-27, Revised Laws of Hawaii 1955. SECTION lg. Electrical Ccntrac±or and E-lectrical Specialty Contractor. A. Certification and Registration Required. No person shall engage in a business involving the perfcrmance df electrical work, or represent to be an "electrical contractor" ~:~r "electrical specialty contractor" unless he has an electrical contractor's or electrical specialty contractor's certificate from the Administrative Authority and is registered with the department as an electrical contractor or electrical specialty contractor. B. Application. Ar.y person desiring to have a certificate as an electrical contractcr or electrical specialty contractor shall file a written application ti:erefor with the Department on forms furnished by the department. The forms may require a financial statement and a statement of experience. C. Fee. Any person who applies for an electrical contractor's or electrical specialty contractor's certificate shall pay a fee of $25.00 to the County Treasurer. -lf's- D. Minimum Requirements. Have a State Contractor's license, pursuant to Chapter i66A, Revised Laws of Hawaii 1955, as amended; and c. Be a supervising electrician, or employ a supervising electrician, principally engaged in the business of the electrical contractor, provided that this requirement shall be ccnsidered satisfied in the case of a partnership or corporation if one of its members or employees is a supervising electrician principally engaged in the business cf t;ie electrical contractor, d. Give a bend, to the County of Hawaii, executed by him, it or them, as principal, and by a surety company authorized to do business in the State of Hawaii and approved by the County Treasurer, in the penal sum of 91,000.00, conditioned on the principal complying with any provisions of this Code that may be cited to him in writing by the Administrative Authority and conditioned further on the surety giving the County Treasurer not less than thirty ~3G) days' writ;ten notice before any cancellation of the bond. 2. An electrical specialty contractor shall: a. Maintain a place of business in a business or industrial district in the County ~.vith a listed telephone number and be principally enyaged in the business of an electrical specialty contractor durina normal business hours from said place of business. b. Have a State Contractor's License, pursuant to Chapter 166A, Revised Laws of Hawaii 1955, as amended; and c. Be a supervising specialty electrician, or employ a supervising specialty electrician, principally engaged in the business of the electrical specialty contractor, provided that this requirement shall be considered satisfied in the case of a partnership or corporation if one of its members or employees is a supervising specialty electrician principally engaged in the business of the electrical specialty contractor, d. Give a bond, to the County of Hawaii, executed by him, i.t or them, as principal, and by a surety company authorized to do business in the State of Hawaii and -19- approved by the County Treasurer, in the penal :sum of $1,000.00, conditioned on the principal complying with any provisions of this Code that may be cited to him in writing by the Administrative Authority and conditioned further on the Buret giving the County Treasurer not less than thirty (30~ days' written notice before any cancellation of the bond. E. Cancellation of certification and re istration. If an electrical contractor or electrical specialty contractor should at any time become an employee of another electrical contractor or electrical specialty c;;nt.ractor, he shall submit his certification and registration as an electrical contractor or electrical specialty contractor to the department for cancellation. SECTION 20. Electrician and BRotion Picture Operator. A. Certification and Registration Re uired. No person shall act in the capacity of a supervising electrician, supervising specialty electrician, journeyman electrician, journeyman specialty electrician, or motion picture operator unless he has a certificate therefor from the Administrative Authority and is registered with the department to act in such capacity. No person shall enter a projection booth of a theater as apprentice to learn the trade without first obtaining an "apprentice motion picture operator's" permit +,"'rom the department. B. Application. Any person desiring to have a certificate as supervising electrician, supervising specialty electrician, journey- man electrician, journeyman specialty electrician, or motion picture operator shall file a written application therefor with the department on forms furnished by the department. Minimum Requirements. 1. Journeyman Electrician. Every applicant to be eligible for the journeyman electrician examination shall be at least 20 years of age and must have had at least four years experience in the trade. 2. Journeyman SK?ecialty Electrician. Every applicant to be eligible for the journeyman specialty electrician examination shall be at least 20 years of age and must have had at least four. years experience in the trade. 3. Supervising Electrician. Every applicant to be eligible for the supervising electrician examination shall have been registered with the department as a journeyman electrician for at least :j period of two years in the trade. -7_0- 4. Supervising Specialty Electrician. Every applicant tc be eligible for the supervising specialty electrician examination shall have been r-egistered with the Department as journeyman specialty electrician for at least a period of two years in the trade. 5. Motion Picture Operator. Every applicant to be eligible for the motion picture operator examination shall be not less than 18 years of age and shall have had not less than one year of experience under supervision of a registered motion picture operator in the operation of machines for the projection of motion pictures for commercial purposes in the trade. 6. Apprentice. Apprentice motion picture operator shall be at least 17 years of age, and shall apply for an apprentice permit to be permitted to enter the projection booth to learn the trade. An apprentice permit shall be for a period of one year and the permittee must apply for an examination. Upon failure he shall not be eligible to take another such. examina- tion until at least one year after date of taking the previous examination, SECTION 21. Registration. A. Required. Every certified journeyman electrician, journeyman specialty electrician, supervising electrician, supervising specialty electrician, electrical contractor, electrical specialty contractor, or motion picture operator shall register with the department, at which time he shall be issued a registration card. B. Term of Registration. Every registration, whenever entered, shall expire on June 30 of each year. C. Annual Registration. Every registered electrician, electrical contractor, electrical specialty contractor, and motion picture operator shall apply for re-registration with the department during the month of June of each year. Re-registration shall be granted by the Administrative Authority if the applicant meets the requirements applicable to the class in which he seeks to be registered. Any applicant ~n~ho is denied re-registration may appeal to the Board. D. Fee. Every electrical contractor, electrical specialty contractor, shall pay a fee of $15.00 for each registration after the initial registr<aion. Every other registrant shall pay an initial registration fee of 82.00 and a registration fee of $2.00 for each registration thereafter. Initial registration fees shall be due and payable upon the issuance of the initial registration card. Re-registration fees shall be due on July .1 and payable by June 30 of each year. Payment shall be made to the County Treasurer. Any person to be registered as a supervi,;iiig electrician, supervising specialty electrician, and as an electr`cal contractor or electrical specialty contractor shall secure separate registration cards and pay separate fees for each. -'~i- E. Failure to re-register. 1. Any journeyman electrician, journeyman specialty electrician, supervising electrician, supervising specialty electrician, or motion picture operator, other than one initially receiving a certificate of qualii-ication, who fails to apply for re-registration on or before June 30 of each year shall submit to a re-examination, and be required to pay the examination fee therefor, except where the Administrative Authority grants ari extension of time to re-register, based on good cause. 2. Any electrical contractor or elect:rical specialty contractor who fails to apply for re-registration on or before July 30 of each year shall resubmit an application for a certificate as an electrical contractor or electrical specialty contractor to the Departcr~ent and be required to pay a fee of $25.00 therefor, except where the Administrative Authority grants an extension of time to re-register, based on good cause. SECTION 22. Transferability. All certificates and :registra- tions under this Code shall be non-transferable. SECTION 23. Appeals. A. Appeals. Any person aggrieved by an action of the Examining Board may appeal to the Board of Supervisors by filing a notice of appeal with the County Clerk within thirty (30) days after notice of the action has been sent to the applicant, together with a statement of facts relating to the controversy and the reasons for the appeal. Within thirty (30) days after the filing of the notice of appeal, the Examining Board shall submit a statement of the facts and reasons on which the action was based. B. Hearing. The Board of Supervisors shall hold a hearing on all appeals. C. Decision. The Board of Supervisors shall reverse the action from which the appeal was taken if it finds that the reasons for the action of the Board are not substantially supported by the evidence. SECTION 24. Penalty, Any person, firm or corporation violating, or failing to comply ~,nrith any of the provisions of Lhis Code, shall upon conviction thereto be unished by a fine not exceeding Five Hundred Dollars ($500.0 0, Each separate day or any portion thereof during which any violation of this Code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. SECTION 25. Offenses under former ordinances saved. Nothing contained in any provision of this ordinance shall apply to an act done or omitted, or to an offense committed at ar~y time before the enactment of this ordinance. Such act or omissicn shall be governed by, and any such offense shall be punished according to the provisions of the ordinances existing when such act, omissicn or offense, occurred in the same manner as if this ordinance had not been enacted. -22- SECTION 26. Repeal of prior ordinance, preservation of rights and liabilities, construction of revised ordinance. A. Repeal of prior ordinance; what not repealed. A.11 ordinances, sections and parts of sections of Ordinances of the County of Hawaii, in conflict herewith, be and the same is hereby repealed. B. Preservation of rights and liabilities. Said repeal shall not affect any act done, ratified or confirmed, or any right accruing or accrued or established, er any action, suit or proceeding had or commenced in any civil cause, prior to said repeal, but all rights and liabilities under any ordinance embraced in the said ordinance or so repealed shall continue, and may be enforced in the same manner and with the same effect as if said repeal had not been made. C. Construction of Revised Ordinances. Provisions in said ordinance shall be construed as continuations or amendments of applicable or corresponding provisions of previously existing laws and not as new enactments. In case :~f a conflict: between said and other ordinances, or in case of latent and patent: ambiguity or obvious clerical error in said ordinance, reference may be made to the previously existing ordinances for the purpo=.e of applying the rules of construction relating to repeal by implication or for the purpose of resolving the ambiguity or correcting the error, _~~_
