HomeMy WebLinkAboutORD 1967-067 BILL N0. 414 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO, 67 AN ORDINANCE PERTAINING TO THE ESTABLISHMENT OF GATE OVER COUNTY HIGHWAYS, AND PROVIDING PUNISHMENT FOR ITS VIOLATION. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: SECTION 1, Any person having interest in land adjoining both sides of a county-maintained or owned highway and desiring to establish a gate over said highway in order to fence in cattle or other livestock shall first apply for a permit from the Board of Supervisors. SECTION 2, Such application shall contain the following information: A. The exact location of the highway where said gate is to be constructed. B. The manner of construction, operation and description of said gate. C. The reason for said construction. SECTION 3. The Board, in its discretion, may permit, by adoption of a motion, construction of said gate over the highway where it finds that the construction of fences on both sides of the highway is not economicallq advisable and when public use of the highway will not be appreciably impeded or delayed. SECTION 4. Any permit for any gate allowed or permitted under this ordinance may be rescinded or repealed at any time by an adoption of a motion by the Board of Supervisors. Thereupon, the person granted said permission shall forthwith remove said gate, at his own expense, without damaging the County highway. SECTION 5, All gates permitted under this ordinance shall be constructed by the person desiring the establishment of said _, Ord. The gate shall be constructed so that it may be readily swung open at any time and shall not be locked or barred in any fashion as to prevent it from being readily opened. SECTION 6. All users of the gate shall secure the gate in the manner found immediately after usage. SECTION 7. Every gate shall have a clearly visible and legible sign for users of the highway reading as follows: "This is a public highway. "This gate is constructed pursuant to Section 142-52, Revised Laws of Hawaii 1955, and Ordinance No. 67 , of the Revised Ordinances of the County of Hawaii 1967. "This gate may be opened for passage. "You are to secure the gate in the manner found immediately after usage." SECTION 8. Any person violating any provision of this ordinance may be penalized by a fine not exceeding $100.00. SECTION 9. approval. This Bill allows the construction of gates over county-maintained or owned highways in order to fence in cattle or other livestock by first applying for a permit from the Board of Supervisors.
