HomeMy WebLinkAboutORD 1967-070/.. /~ BILL N0. 441 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. 70 AN ORDINANCE AMENDING ORDINANCE [vb. 39 (TRAFFIC CODE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, BY AMENDING SECTION 6-7, PERTAINING TO NO-PASSING ZONES; SECTION 20-16, PERTAINING TO LAMPS ON PARKED VEHICLES; AND SECTION 19-7, PERTAINING TO PARKING METER. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAWAII: SECTION 1. Section 6-7 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 6-7 NO-PASSING ZONES "(a) The County Engineer and District Engineer are hereby authorized to determine those portions of any highway where overtaking and passing or driving to the left of the roadway would be especially hazardous and may by appropriate signs or markings on the roadway indicate such zones and when signs or markings are in place and visible to an ordinarily observant person every driver of a vehicle shall obey the directions thereof. "(b) A no-passing zone shall be designated by a sign placed at the edge of the roadway at the beginning and at the end of such zone or by a solid yellow line placed as the right-hand element of a combination line along the center or lane line. "(c) Where such signs or markings are in place to define a no-passing zone, no driver shall at any time drive on the left side of any pavement striping designed to mark such no-passing zone throughout its length except when making a left turn." SECTION 2. Section 20-16 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 20-16 LAMPS ON PARKED VEHICLES "(a) Every vehicle shall be equipped with one or more lamps which, when lighted, shall display a white or amber light visible from a distance of 500 feet to the front of the vehicle, and a red light visible from a distance of 500 feet to the rear of the vehicle. The location of said lamp or lamps shall always be such that at least one lamp or combination of lamps meeting the U. d. No. ~` File No. ~,,., NAPR 51917 APR 19 1917 requirements of this section is installed as near as practicable to the side of the vehicle which is closest to passing traffic. The foregoing provisions shall not apply to a motor-driven cycle. "(b) Whenever a vehicle is lawfully parked upon a street or highway during the hours between a half hour after sunset and a half hour before sunrise and in the event there is sufficient light to reveal any person or object within a distance of 500 feet upon such street or highway, no lights need be displayed upon such parked vehicle. "(c) Whenever a vehicle is parked or stopped upon a roadway or shoulder adjacent thereto, whether attended or unattended, during the hours between a half hour after sunset and a half hour before sunrise and there is insufficient light to reveal any person or object within a distance of 500 feet upon such highway, such vehicle so parked or stopped shall be equipped with and shall display lamps meeting the requirements of subsection (a). "(d) Any lighted headlamps upon a parked vehicle shall be depressed or dimmed." SECTION 3. Section 19-7 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1067, is hereby amended to read as follows: "SECTION 19-7 APPLICATION OF PROCEEDS "It shall be the duty of the Chief Engineer to designate some member or members of his department to make regular collections of the money deposited in said meters and it shall be the duty of such person or persons so designated to remove from the parking meters the coins so deposited in said meters. Such person or persons shall make a record of the number shown registered on the coin counter of each parking meter, service the parking meters, count the coins from the parking meter, count the coins collected and deposit the same in a fund entitled 'Parking Meter Fund' to be created and held by the County Treasurer. "The County Auditor shall direct some member or members of his department to make periodic checks of the parking meters and collection procedure. "The coins required to be deposited in parking meters as provided herein are hereby levied and assessed as fees to provide for the purchase, rental, acquisition, supervision, collection, use, protection, inspection, installation, operation, maintenance, control and regulation of parking meters, of off street parking spaces, of the parking of vehicles, and of other facilities and properties incidental to the regulation and control of traffic and in promoting the safety and well being of the public in handling of traffic upon the streets." SECTION 4. This ordinance shall take effect upon its approval. This Bill authorizes the County Engineer and District Engineer to determine no-passing zones and to designate said zones by a sign or solid yellow lines; lists the requirements for lamps on parked vehicles and states when they need and need not be displayed; provides for the collection, deposit and assessing of the coins removed from the parking meters. This Bill amends Ordinance No. 363 by revising the estimated revenue for the fiscal year ending June 30, 1967.
