ORDINANCE N0. '~~3
AN ORDINANCE ESTABLISHING A CURFEW ON MINORS; IMPOSING PENALTIES
FOR THE VIOLATION THEREOF; AND REPEALING ~?DINANCE N0. 24, REVISED
ORDINANCES OF THE COUNTY OF HAWAII 1967.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. No person under the age of fifteen (15) years
shall remain or loiter on any public street, highway, park or
any other public place, including any establishment catering to
the public wherein food, drink, entertainment, or recreational
activities are provided, between the hours of 10:00 P.M. and
4:00 A. M. except in case of necessity or unless accompanied by
his or her parent, legal guardian, or an authorized person 18
years or older.
SECTION 2. No person under the age of eighteen (18) years
shall remain or loiter on any public street, highway, park or
any other public place, including any establishment catering to
the public wherein food, drink, entertainment, or recreational
activities are provided, between the hours of 12:30 A. M. and
4:00 A. M. unless accompanied by his or her parent, legal guardian,
or an authorized person 18 years or older.
SECTION 3. Any minor violating this ordinance shall be
dealt with as prescribed by law.
SECTION 4. Any parent or legal guardian of a person under
the age of eighteen (18) years who knowingly permits him or her
to violate either Section 1 or Section 2 hereof shall be fined
not more than $500.00.
SECTION 5. Any keeper of an establishment catering to the
public wherein food, drink, entertainment, or recreational
activities are provided who knowingly permits any child under
the age of fifteen (15) years to remain or loiter upon the
premises between the hours of 10:00 P.M. and 4:00 A.M., unless
the child is accompanied by his or her parent, legal guardian,
or an authorized person eighteen (18) years or older, or who
knowingly permits a child between the ages of fifteen (15) and
eighteen (18) years to remain or loiter upon said premises
between the hours of 12:30 A. M. and 4:00 A.M. unless accompanied
by his or her parent, legal guardian, or an authorized person
18 years or older shall be fined not more than $25.00.
SECTION 6. Ordinance No. 24, Revised Ordinances of the
County of Hawaii 1967, is hereby repealed.
SECTION 7. This ordinance shall take effect upon its
approval.
