THE INSTALLATION, CARE, AND i:IAIPITENANCE OF ELECTRICAL 4dORK AND
EQUIPLffiNT IN THE COUNTY OF HA[JAII, APID REPEALING ALL SECTIONS AND
PARTS OF SECTIONS OF ORDINANCE OF THE COUPITY OF HAPdAII IN CONFLICT

BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF HAL9AII:
SECTION 1. Title and Purpo:;e.
A, Title. `Phis Ordinance :shall be known as the "Electrical
Code," may be cited as such, and i.s referred to herein as "this Code."
B. Purpose. The purpose of this Code is to reduce the
hazards to persons and property from electrical causes. 'Po
accomplish this, the requirements set fortYl herein are intended to
provide a minimum standard for electrical installations in the
County of Hawaii.
SECTION 2. Scope,
A. Scope. The provisions of this Code shall apply to all
electrical work and installations in the County except the following:
1, Electrical work on buildings or premises owned by
or under the direct control of the United States or the State
of Hawaii.
2. Electrical work by an electrical utility or serving
agency supplying electricity, operating under a franchise or
charter granted by the State of Hawaii on the following:
a. Any generating plant, receiving statiorl,
switching station or distributing station, under the
control of such utility or serving agency;
b. Any electrical wiring for supply lines or mains
under the control of such utility or serving agency; and
c. Any electrical ~~airing for overhead service drops,
or underground or station service supply conductors under
the control of such utility or serving agency,
3. Electric wiring by a public telephone or telegraph
communication utility subject to regulation by the Public
Utilities Commission of the State of Hawaii for the following:
a, Is used solely :Eor communication purposes between
premises;
b. Does not constitute part of the electric supply
for communication appar~stus;
c, Is not located :in a "hazardous location" as
defined in THE NATIONAL ELECTRICAL CODE. 1965 EDITION.
4. The 'provisions of~ this Code shall not apply to a
Municipal. System for street lighting, traffio- signal or police

and fire alarm where installed outside of buildings on
public property,
5, The physical placement and reassembly of an electric
sign, x-ray equipment or household appliance,
6. Existing electrica: installations which complied
with the laws, ordinances and regulations in effect when the
electrical wcrk thereon was performed, provided that such
installations shall be subject to the provisions of
Subsection C of Section 4 hereof.
7, Electrical work in accordance with the laws,
ordinances and regulations i.n effect prior to the effective
date of this Code under a permit therefor issued prior to
such date.
8, All buildings moved into or relocated within the
County shall comply with all. requirements of this Code for
new buildings,
9, Electrical work related to work regulated by
Chapter 22 of Rule X"~ of the Department of Labor and Industrial
Relations of the State of Hawaii, relating to the Elevator Code,
but not including electrical work for the supply of power to
the control panels of elevators, dumb-waiters, escalators,
moving walks and manlifts.
10. Replacement or repair of devices and apparatus of
air conditioning and refrigeration systems, except Electrical
work on overcurrent devices which are not physically attached
to, or physically mounted on, such systems,
B. Interpretation - Sams Subiect P-fatter, If there are two or
more provisions in this Code or an.y other ordinance or statutes,
covering the same subject matter, the provisions which provide the
greator safety to life or limb, property or public welfare shall
prevail.
SECTION 3, Definitions. The following words and phrases
when used in this Code shall have -the meaning respectively ascribed
to them in this section, unless it is apparent from the context
that a different meaning is intended:
A, Administrative Authority, Whenever the term "Administra-
tive Authority" is used in this Code, it shall be construed to mean
the Chief Engineer of Hawaii County Department of Public Vdorks or
his authorized representative,
B. Assistants. Whenever the; term "assistants" is used in
this Code, it shall be construed to mean the authorized representa-
tives of the Administrative Authority.
C, Apprentice, A person who performs electrical work under
the direct supervision and in the x>resence of a supervising electri-
cian, supervising specialty electrician, journeyman electrician or
journeyman specialty electricians
D. Board, The Board of Electrical Examiners.
E, Department. The Department of Public Vlorks of the County
of Hawaii,

F, Electrical Contractor. Any person who has been certified
by the Exaiin>nc,Board and is registered with the Department to do
business as an electrical contractor and enters into contracts with
property owners or contractors for the performance of electrical
work.
G. Electrical Specialty Contractor, tiny person who has been
certified by the ;ra o,--~ir._: Board and is registered with the Department
to do business as an electrical specialty contractor and enters
into contracts with ;oroperty owners or contractors for the performance
of electrical work related to installing, repairing, altering and
maintaining, but not the attachment or lighting and power circuits
to, the following: (1) electronic equipment, sound public address
systems and communication systems, other tY:an equipment and systems
for a single family or two-family dwelling; (2) master or community
radio and television receiving antenna systems; (3) sound recording
systems, other than systems for a single family or two-family dwelling;
(4) burglar and fire alarm systems; (5) lo~a voltage remote control,
other than a control for a single family or two-family dwelling;
and (6) low voltage communication signal systems.
H. Electrical Mork. The installation, alteration,
reconstruction, or repair of electrical wiring.
I, Electrical t.lirina. Any conductor, material, device,
fitting, apparatus, appliance, fixture or equipment, constituting
a part of or connected to any electrical installation, attached or
fastened to any building, structure or premises and which
installation or portion thereof is designed, intended or used to
generate, transmit, transform or utilize electrical energy within
the scope and purpose of the DT at ion al Electrical Code referred to
in Section 16 of this Code.
7. Emeraencv Electrical '~?ork. Repair of electrical wiring
to restore electrical service to a building following a fire, remedy
a power failure and protect persons and property against short
circuiting and open circuits.
K, .7ournevman Electrician. tiny person who has been certified
by the Examining 3oard and is registered with the Department as a
journeyman electrician to perform electrical work under the
supervision of a supervising electrician.
L.. 7ournevman Specialty Electrician, Any person who has
been certified by the Examining Board and is registered with the
Department as a journeyman specialty electrician to perform
electrical caork related to installing, repairing, altering and
maintaining, but not the attachment of lighting and power circuits
to, the following: electronic equipment, sound public address
systems and communication systems, other than equipment and systems
for a single family or two-family dwelling; master or community
radio and television receiving antenna systems; sound recording
systems, other than systems for a single family or two-fancily
dwelling; burglar and fire alarm systems; love voltage remote control,
other than a control for a single f<smily or two-family dwea ling; and
low voltage communication signal systems.

any electrical installation, apparatus, fixtures, appliance or
equipment.

Department for the purpose of operating a movie projector using
35 mm film or larger for commercial purposes,
C. Person„ :4ny individual, firm partnership, association
or corporation, provided that a fi.rrn, partnership, association or
corporation are not included within the, meaning of person found in
tYie definitions for journeyman electrician., journeyman specialty
electrician, supervising electrician, supervising specialty electri-
cian, and motion picture operator.
P, Supervisina Electrician, Any person who has been
certified by the Examining Board a.nd is registered with the
Department as a supervising electrician to direct and supervise
the performance of electrical work and to perform electrical work,
~. Supervising Specialty Electrician, Any person who has
been certified by the Examining Hoard and is registered with the
Department as a supervising specialty electrician to direct and
supervise-the performance of electrical work related to installing,
repairing, altering and maintaining, but not the attachment of
lighting and power circuits, to the folloering; electronic equipment,
sound public address systems and communication systems, other than
equipment and systems for a single family or two-family dwelling;
master or community radio and television receiving antenna systems;
sound recording systems, other than systems for a single family
or two-family dwelling; burglar and fire alarm systems; low voltage
remote control, other than a control for a single family cr two-
family dwelling; and loin voltage communication signal systems.
SECTICP? 4. Administration a;1d Enforcement,

1. All electrical pairing, for which a permit is required,
shall be inspected and approved by the Administrative Authority
before being concealed, energized or used. All fees required
by this Code shall be paid by the permittee prior to the
energizing or use of such wiring.
2. TQo person shall use, operate or maintain, or cause or
permit to be used, operated or maintained, any electric
wiring until it is inspected and approved.
3. T1o serving agency shall supply, or cause or permit
to be supplied, electric energy to any electric wiring until
the wiring has been :inspected and approved,

under this Code.

4. No person shall conceal, enclose or cover, or cause
or permit to be concealed, enclosed or covered, any portion of
any electric wiring or equipment in any manner which will
interfere with or prevent the inspection and approval thereof.
5. Fixtures, appliances, devices or equipment shall not
be connected to any electric ;airing until the rough electric
wiring, including conductors hdv2 been inspected and approved,
except as otherwise satisfactory to the department.
6. All obstructions, covers, plates, tapes, etc.,
which makes impracticable the making of a thorough inspection
of electric wiring shall be removed upon notice (either verbal
or in writing) to do so, and shall be kept removed until the
electric wiring has been inspected and approved.
D. Defective Electrical Installations. Vhenever any
electrical installation is found t:o have been installed, altered,
changed or reconstructed contrary to the provisions of this Code or
any other law, whenever any electrical installation is found to be
in use contrary to the provisions of this Code or any other law, or
whenever any electrical installation, which complied with the
existing laws, ordinances and regulations in effect when the
electrical work thereon was performed, is found to be unsafe or
dangerous to persons or property, the Administrative Authority shall
give the ooaner or the person in control of such installation a
written notice stating the findings with respect to such installation
and order the owner or such other person to make the corrections to
be set forth in such written notice within ten (10) days from the
date of service of such notice or within such further time as the
Administrative Authority may allotir.
In addition, the Administrative Authority may disconnect such
installation from its source of electrical energy and order the
supplying of electrical energy to such installation to be stopped.
Thereafter, no person shall use or supply electrical energy to such
installation before the corrections set forth in the notice have
been made.
E. Request for inspection. Phenever any work regulated by
this Code, or any portion thereof, is ready for inspection, the
Administrative Authority shall be notified by the person that same
is ready for inspection. The notice shall be in writing on forms
furnished by the Administrative Authority, or may be by telephone
at the option of the Administrative Authority, The notice shall be
filed with the Department not less than 24 hours and not more than
72 hours before any such inspection is desired.
1. The Administrative Authority shall proceed to inspect
the same within 48 hours, not including Sundays or holidays,
after receipt of such notice, and if said work conforms in all
respects with the provisions of this Code, he shall attach a
notice granting authority to proceed with install ati_ons.
2. No electrical wiring shall be covered or concealed
until the said 48 hours have expired after notice to the
Administrative Authority has been received in his department,
or until the Administrative Authority has approved the
installation and given permission to cover or conceal the
same. Should the Administrative Authority condemn any of said
work or equipment as not being in accordance with t11e provisions

of this Code, notice ir.tiariting to that effect shall be given
by him to the person engaged in the work,

equipment may Fully comply with the provisions of this Code
before further work is connected on or with such condemned

any and every owner, contractor or other person engaged in
construction of the building or structure, or others/ise,
covering or allowing to be covered such portion of work or
equipment, or removing any notice not to cover same placed
thereon by the Administrative Authority shall likewise be
liable to the penalties ir, this Code provided,

1, T?o person shall use or supply electrical energy to any
electrical installation on which electrical oaork was or is
being performed under a permit issued pursuant to the
provisions of this Code before the Administrative Authority
has approved such installation.
2. ~il,enever electric wiring has been approved, a
certificate of inspection therefor shall be issued on demand,
provided all fees required b_y this Code have been paid,

altering, repairing, using or maintaining electric wiring shall be
responsible for compliance with this Code,
H. Liability of Persons. T:ais Code shall not he construed
to relieve from or lessen the responsibility of such person owning,
operating or installing any electrical o~ires, appliances, apparatus,
construction or equipment for damages to any one injured by any
defect therein,
I. I~Ion-responsibility of County, Dleither the County of
I3awaii, nor any department, board, commission, officer, employee,
or the Administrative Authority thereof shall be held liable or
responsible for any damage or injury caused by or resulting from
the issuance of any permit issued, or any inspection or approval or
issuance of a certificate of inspecrtion, made under the provisions
of this Code.
SECTIODI 5. Permits Required: hxceptions,
A. Permit Required and hxceptions. PIo person shall perform
any electrical work or cause or pex-mit the same to be done, unless
a permit therefor has been obtained from the Administrative Authority
with the following exceptions:
1, Tslectric work and installations to which the
provisions of this Code are expressly declared to be not
applicable.
2. Installation of any portable motor or other portable
appliance energized by means of a cord or cable having an
attachment plug and, if such cord or cable is permitted by
this Code.

3, Repair of any fixed motor or other appliance, or
replacement of any Eixed motor with another having the same
horsepower rating and situated at the same location,
4. Replacement of attaclmient plug receptacles, but not
the outlet therefor.

supervising specialty electr'iciano iourneyman electrician or
journeyman specialty electrician employed as a maintenance
electrician by someone other than ar, electrical contractor
or electrical specialty contractor.

11. The provisions of t:he foregoing exceptions shall not
apply to any repairs or replacements of- electrical devices,
apparatus, or appliances which were originally installed
without a permit when such Hermit is :required for the original
installation, or when energi;aed by, o:r which is a part of any
hazardous or illegal wiring system.
12. The foregoing excep`~ions from permit requirements
shall not be deemed to allow any electric wiring to be done
in a manner contrary to other: provisions of this Code.
I3. Sco~~e of- Permit.
1. The issuance cf a permit is not an approval or an
authorization of work specif-_ed therein. A permit is merely
an application for inspection, the issuance of which entitles
the permittee to inspection of the wort. which is prescribed
therein.
2. Dleither the issuance; of- a permit nor the approval
by the Administrative Authority of any document shall constitute
an approval of any violation of any provision of this Code or
of any other law or ordinance, and a permit or other document
purporting to give authority to violate any law shall not be
valid with respect thereto.
C. Emeraencv laork. i/hen emergency electrical work is
commenced without a pe nnit, an application for a permit for the work
shall be made pursuant to the provisions of Section 7 hereof as soon
as possible after the work is commnenced.

application on forms furnished by the Administrative Authority The
application shall contain all information necessary to the. lawful
enforcement of- the provisions of this Code,

C. Issuance of Permit. Pi hen the Administrative Authority
determines that the information on the application and plans is in
conformance o~ith this Code, the Administrative Authority shall issue
a permit upon receipt of the total fees.
D. Exceptions. Nothing contained in this Code shall be
construed to require the Administrative Authority to immediately
accept or reject any application, ~aahenever it is necessary to
investigate the proposed rM1-firing anal premises as to its compliance
with this Code, or it is necessary to checY_ plans and specifications
accompanying the application,
SECTIOI~I B. Plans and Specifications, Plans and specifications
giving such details of the proposed installation as may be required
by the Administrative Authority shall be filed with the application.
Such plans and specifications shaLL bear the approval of either a
professional engineer. registered in the State of Hawaii as especially
qualified fir, the electrical branch of engineering, or a professional
architect or other. engineer registered in the State of Hawaii and
qualified in such ~~~ork by e;cperience, _~rovided that if the demand
load of the proposed installation is less than thirty (30) kilo-volt-
ampers, this requirement shall be applicable only if the Adminis-
trative Authority so directs.
SEC'TIOPd 9. Issuance. If 'the Administrative Authority is
satisfied that the installation described in the application will
conform to the provisions of this Code and all pertinent laws, and
the fee prescribed in Section 14 hereof has been paid, he :may issue
a permit to the persons specified i.n Section 10 hereof.
SEC1I01`! 10. Persons to 1,'hom Permits i.Iav De Issued. A permit
may be issued only to a supervising electrician or supervising
specialty electrician:
A. ?9ho is an electrical contractor or electrical specialty
contractor; or
B. Plho is employed by an electrical contractor or electrical
specialty contractor for work of th.e electrical contractor or
electrical specialty contractor; or
C. ~Tho is employed as a maintenance electrician by someone
other than an electrical contractor or electrical specialty
contractor; or

D. ~Iho is donating iris services as an electrician to an
eleemosynary insi:itution in connection with electrical installations
of a temporary nature; or
Mho is applying for a permit for electrical work for his
own dwelling.

SECTIOPI 11, Content; Postin_q: t71,en I1u11 and Void. Every
permit shall be issued in such form and detail as shall be prescribed
by the Administrative uthority, shall specify the geographical
location of the premises ~:rhereon the caorl: autiorized thereby is to
be done, shall be valid only for the location so specified, and
shall be conspicuously posted by the holder thereof on the premises.
If the work authorized lay any permit shall b e continuously suspended
for a period of ninety days, such permit shall thereupon, and there-
after, be null and void.
SECTIOPI 12. Transferability. No Hermit shall be assigned,
transferred or loaned to another by the person to whom it was issued.
SEC TIOPd 13. Suspension or Pevocation. The Administrative
Authority may, in writing, suspend or revoke a permit issued under
provisions of this Code whenever the permit has been issued in error
or on the basis of- incorrect info nnation supplied, or in violation
of any ordinance, regulation or provision of this Code, In such
event, the permit fee sna11 not he refunded.
SECTIOPI 14. Permit Fees.
A. To tlhom Paid, h fee in accordance with the schedule set
forth hereinafter shall be paid to the County Treasurer for each
permit.
3, Schedule.

location thereof, and which is not attached or

C. [9ork without a permit, Except when electrical work may be
commenced without a permit, the fees for a permit for work commenced
without a permit shall be twenty-fi.ve dollars ($25.00) plus the fee
specified by subsection B above,
D, Exemptions. The County of Hawaii and all contractors
performing work under authority of said County shall be exempt from
the requirement to pay permit fees.
SECTION 15, Charges for Extra and D4iscellaneous Inspection,
A. Extra Inspections. If, after notice to a permit holder,
more than one inspection is necessary to insure that deficient or
defective electrical work under the permit has been corrected, the
holder of the permit shall pay the County Treasurer three dollars
($3,00) for each additional inspection.
B. 1:Iiscellaneous Inspections. For the inspection of any
electrical installation, not covered by a fee specified in this code,
the person requesting the inspection shall pay the County Treasurer
three dollars ($3.00) for each hour or portion thereof that is
required to make the inspection and travel to and from the installa-
tion.
SECTION 16. Standards for Electrical Glork,
A. Adoption of the National llectrical Code. THE NATIONAL
i;LECTRICAL CODE. 1965 EDITION, adopted 1.1ay, 1965, and published by
the National Fire Protection Association, is hereby adopted by
reference and made a part hereof, Three copies of said Code shall
be kept on file and be available for public inspection in the County
Clerk's Office. The scope, technical specifications and exemptions
set forth in said Code are hereby adopted as the standard for
ele ctrical work covered by the Code,. if there are no specific
provisions in another section of this Code covering the particular
matter.
B. Adoption of the Pamphlets 72 and 74ii of National Board of
Fire Underwriters, Pamphlets 72 and 741.1 of the National Board of
Fire Unde nariters, dated P:Iay, 1962, is hereby adopted by reference
and made a part hereof. Three copiers of said pamphlets shall be
kept on file and be available for public inspection in the County
Clerk's Office. The standards set forth in Pamphlet 72 for the
electrical work covered by said pamphlet are hereby adopted as the
standard for electrical work covered. by said pamphlet and P+mnphlet
74141.
C, Compliance Recruired. No person shall do or cause to be
done any electrical work oahich does not comply with the provisions
of this Code.
SECTION 17. Standards for Performance of Electrical [lork.
Except as othenaise provided herein, no electrical work for which a
permit is required shall be performed by any person who is not a
duly certified and registered supervising electrician, supervising
specialty electrician, journeyman electrician or journeyman specialty

electrician, provided that each supervising electrician, supervising
specialty electrician, journeyman Electrician, or journeyman specialty
electrician, may be assisted in the performance of such work by an
electrician's helper or an apprentice in an electrical apprenticeship
program under Chapter 89, 12evised i,aws of Hawaii 1955, and provided
further that pole and linemen employed by the County shall not be
prohibited by the provisions hereof from performing electrical work
within the scope of their employment.
SECTIOPI 18, Examining Board,
A. Composition. There is hereby created a Board of Electrical
Examiners, hereinafter referred to as the Board, consisting of two
supervising electricians, one motion picture operator, one supervising
specialty electrician, one person who is not in any of the foregoing
classes, the Administrative Authority, and a senior member electrical
inspector, The members of- the Board other than the Administrative
Authority and the senior member electrical inspector shall not be
government employees and shall be appointed by the Chairman and
Executive Officer of the County with the approval of the Board of
Supervisors. The Administrative Authority and the inspector shall
have a voice but no vote in the proceedings of the Board,
The Board shall elect a chairman and a vice-chairman. The
vice-chairman shall act as the chairman in the temporary absence or
disability of the chairman, The Administrative Authority ;>hall
provide a secretary for the Board,
B, Term of Office, Each member shall serve for a term
coterminous with the term of the Chairman and Executive Officer, and
any member may be removed from office sooner, for cause, by the
Chairman and Executive Officer with the approval of the Board of
Supervisors of the County,
C. Compensation, The members of the Board, other tktan the
Administrative Authority and inspector, shall be paid $ 1.00 for
each meeting attended, but not more than X100.00 in any one month,
D, Expenses. The Board may incur such expenses as may be
necessary and proper in the performance of its duties and functions,
for which appropriations have been :made by the Board of Supervisors
of the County. Disbursements therefor shall be made by warrants
issued on vouchers signed by the chairman or acting chairman of the
Board.
E, Rules, 'Phe Board shall adopt reasonable rules fcr the
performance of its duties, provided that no action shall be taken
by the Board unless the action receives three or more votes,
F. Duties and Powers.
1. Appeal. The Board small hear any appeal by any person
aggrieved by a decision of the Administrative Authority.
2. Examinations, The Board shall examine applicants
for certification as supervising electrician, supervising
specialty electrician, journeyman electrician, journeyman
specialty electrician and motion picture operator and shall
submit to the department the names of applicants who have
qualified fo.r certification ass supervising electrician,
supervising specialty electrician, journeyman electrician,
journeyman specialty electrician and motion picture operator
by passing the examination therefor prescribed by the Board

with a grade of seventy (70) or more. Provided, however,
that, if any applicant for certification as supervising
electrician, supervising specialty electrician, journeyman
electrician, journeyman specialty electrician and motion
picture operator was in bona fide, full-time employment as
supervising electrician, supervising specialty electrician,
journeyman electrician, journeyman specialty electrician and
motion picture operator onl~ril 1, 1966, in the County of
Hawaii and has been so engaged since that date, the Board shall
issue such certification without examination, if application
for such certification is made to the Board as provided under
this Code and urithin ninety (90) days after this Code shall
take effect. Otherwise the application for such certification
shall be decided in accordance=_ Laith the procedure provided in
this Code and such certif-icat:ion shall be issued or denied
accordingly. Pending the determination of such application,
the continuance of employment in the several specialties
concerned shall be lawful.
3. Determination on Compliance with Subsection D of
Section 19. The Boar s all ce ermine w e er or no applicants
for certification as electrical contractor or electrical
specialty contractor meet the requirements therefor in
Subsection D of Section 19 hereof and shall submit to the
department the names of applicants who meet said requirements.
4. Ap,~eal from a Denial of Re-registration. The Board
shall hear all appeals from any denial of re-registration by
the Administrative Authority under the provisions of Section
21-C hereof, Pending and subject to the determination of an
appeal, the Board may authorise the appellant to be reregis-
tered with the department. A denial of re-registration shall
be reversed on appeal only ii= the Board finds that the
appellant meets the requirements applicable to the class in
which he has applied for re-registration, Dlhen a denial of
re-registration is sustained, any re-registration granted
pending the deternu.nation of t:he appeal. shall be cancelled.
Revocation or Suspension,
a, Revocation of- Certif-S.cate. The Board shall
revoke the certificate anal registration of any person
whenever it finds that the certificate has been obtained
by fraud or misrepresente,tion. Upon such revocation,
no certification and registration of such person shall
be allowed for a period of six months thereafter,
b. Suspension of Reaistration, The Board shall
suspend the registration of any supervising electrician,
supervising specialty electrician, electrical contractor
or electrical specialty contractor who allows his
certification or registration card to be used directly
or indirectly for obtaining a permit for the performance
of electrical work which is not under his supervision or
connected with his electrical business. Such suspension
shall be for a period of not more than six months.
c, Permissive Suspension or Revocation. The Board
may suspend for such period as it deems advisable or
revoke the certificate and registration of any person
for being principally engaged in a vocation or business
other than, that for which. the certificate or registration
were issued, failing to comply with the applicable

provisions of this Code after having received written
notice of violation thereof fx.om the Administrative
Authority, making a misrepresentation in an application
for a permit or obtaining tl:e registration by fraud or
misrepresentation, lipor: such revocation or suspension,
no certification and registration of such person shall
be allowed for a period of six months thereafter,
d, Hearing before F'.evocation or Suspension of
Certificate or IZeaistrat:ion. Before any such certificate
or registration is revoked or suspended, the Board shall
hold a hearing, at which time the person may appear
before the Board in defense of his certificate or
registration. IIe shall be given at least ten (10) days'
written notice of such hearing, If after careful
consideration of all the: facts in the case the Board
finds that the certificate or registration must be
revoked or suspended or that it may revoke or suspend
the certificate or registration and the certificate or
registration should be revoked or suspended, the Board
shall so order and such order shall take effect
immediately thereafter,
G. Administration of Oaths and Issuance of Subpoenas, The
Board shall have the power to administer oaths and issue subpoenas,
as prescribed in Section 7-27, Revised Laws of Hawaii 1955.
SECTION 19. Electrir_a1 Contractor and hlectrical Specialty
Contractor.
A, Certification and Registration Regained. No person shall
engage in a business involving the performance of electrical work,
or represent to be an "electrical contractor" or "electrical
specialty contractor" unless he has an electrical contractor's or
electrical specialty contractor's certificate from the Administrative
Authority and is registered with the department as an electrical
contractor or electrical specialty contractor,
B. Application. Any person desiring to have a certificate
as an electrical contractor or electrical specialty contractor shall
file a written application therefor witY~, try Department on forms
furnished by the department, The forms may require a financial
statement and a statement of experience,
C, Fee. Any person who applies for an electrical contractor's
or electrical specialty contractor's certificate shall pay a fee of
$25.00 to the County Treasurer,
D. D4inimum Requirements.
1. An electrical contractor shall;
a. Maintain a place: of business in a business or
industrial district in the County with a listed telephone
number and be pr.incipall.y engaged in the business of an
electrical contractor during normal business hours from
said place of business.
b. Have a Mate Contractor's license, pursuant to
Chapter 16GA, Revised Laws of Hawaii 1955, as amended; and

c, Fie a supervising electrician, or employ a
supc-rvising electrician, principally engaged in the
business of the electrical contractor, provided that this
requirement shall be considered satisfied in the case of
a partnership or corporation if one of its members or
employees is a supervis:i.ng electrician principally engaged
in the business of the electrical contractor.
d. Give a bond, to the County of Hawaii, executed
by him, it or them, as principal, and by a surety company
authorized to do business in the State of Hawaii and
approved by the County `Treasurer, in the penal sum of
$1,000.00, conditioned on the principal complying with
any provisions of this Code that may be cited to him in
orriting by the Administrative Authority and conditioned
further on the surety giving the County Treasurer not
less than thirty (30) days' written notice before any
cancellation, of the bond,
2, An electrical specialty contractor shall:
a. D'taintain a place; of business in a business or
industrial district in i:he County with a listed telephone
number and be principally engaged in the business of an
electrical specialty contractor during normal business
hours from said place of= business.
b. Have a State Contractor's License, pursuant to
Chapter 166A, Revised Laws of Hawaii 1955, as anended; and
c. Be a supervising specialty electrician, or employ
a supervising specialty electrician, principally engaged
in the business of the electrical specialty contractor,
provided that this requirement sF:al1 be considered
satisfied in the case of a ,partnership or corporation
if one of its members or employees is a supervising
specialty electrician principally engaged in the business
of the electrical specialty contractor.
d. Give a bond, to the County of Hawaii, executed
by him, it or them, as principal, and by a surety company
authorized to do business in the State of Hawaii and
approved by the County Treasurer, in the penal sum of
~i1,000.00, conditioned on the principal complying with
any provisions of this Code that may be cited to him in
writing by the Administrative Authority and conditioned
furl=her on the surei_y giving the County Treasurer not
less than thirty (30) days' written notice before any
concellation of the bond..
E. Cancellation of certification and registration. If an
electrical contractor or electrical specialty contractor should at
any time become an employee of anotrP r electrical contractor or
electrical specialty contractor, he shall submit his certification
and registration as an electrical contractor or electrical specialty
contractor to the department for cancellation.
SECTION 20. Electrician and D4otion Picture Operator.
A. Certi_fi_ration and Registration Required. No person shall
act in the capacity of a supervising electrician, supervising
specialty electrician, journeyman electricia.r., journeyman specialty

electrician, or motion picture operator unless he has a certificate
therefor from the Administrative Authority and is registered with the
department to act in such capacity.
No person shall enter a projection booth of a theater as
apprentice to learn the trade without first obtaining an "apprentice
motion picture operator's" permit from the department,
B, Application. Any person desiring to have a certificate as
supervising electrician, supervising specialty electrician, journey-
man electrician, journeyman specialty electrician, or motion picture
operator shall file a written application therefor with the
department on forms furnished by tl~~e department,
C, Fees. An applicant for a supervising electrician or
supervising specialty electrician's certificate shall pay a fee of
$20.00 to the County Treasurer, An applicant for a journeyman
electrician or journeyman specialty electrician's or a motion
picture operator's certificate sha7.l pay a i=ee of $5,00 to the
County Treasurer,
D. P:linimum Requirements,
1, Tournevman Electrician, Every applicant to be
eligible for. the journeyman electrician examination shall be
at least 20 years of age and must have had at least four years
experience in the trade.
2. Tournevman Specialty Electrician, Every applicant
to be eligible for the journeyman specialty electrician
examination shall be at least: 20 ;rears of age and must have
had at least four years experience in the trade.
3, Supervisina Electrician, Every applicant to be
eligible for' the supervising electrician examination shall
have been registered with the: department as a journeyman
electrician for at least a period of two years in the trade.
4. Supervisina Specialty Electrician. Every applicant
to be eligible for the supervising specialty electrician
examination shall have been registered with the department as
journeyman specialty electrician for at least a period of two
years in the trade, provided that for a period of one hundred..,
eighty (180) days after the effective date of this Code, any
person who has not less than six years in the trade as a
specialty electrician shall be considered eligible for the
supervising specialty electrician examination,
5, Motion Picture Operator, Every applicant to be
eligible for the motion picture operator examination shall be
not less than 18 years of age and shall have had not less than
cne }=ear of experience under supervision of a registered motion
picture operator in the operation of machines for the projection
of motion pictures for commercial purposes in the trade,
E, Apprentice, Apprentice motion picture operator shall
be at least 17 years of age, and shall apply for an apprentice
permit to be permitted to enter the projection booth to learn
the trade. An apprentice permit shall be for a period of one
year and the permittee must apply for an examination, Upon
failure he shall not be eligible to take another suc11 examina-
tion until at least one year after date of taking 'the previous
examination,

SECTION 21, Registration.
A, Required, Every certified journeyman electrician,
journeyman specialty electrician, supervising electrician, supervising
specialty electrician, electrical contractor, electrical specialty
contractor, or motion picture operator shall. register with the
department, at which time he shall be issued a registration card,
B, Term of Registration. Every registration, whenever entered,
shall expire on June 30 of each year.
C. Annual eaistration. Every registered electrician,
electrical contractor, electrical specialty contractor, and motion
picture operator shall apply for re-registration with the department
during the month of June of- each year. Re-registration shall be
granted by the Administrative Authority if the applicant meets the
requirements applicable to the class in which he seeks to be
registered. Any applicant who is denied re-registration may appeal
to the Board,
D, Fee. Every electrical contractor, electrical specialty
contractor, shall pay a fee of $15,00 for each registration after
the initial registration. Every other registrant shall pay an
initial registration fee of $2.00 and a registration fee of $2,00
for each registration thereafter,
Initial registration fees shall be due and payable upon the
issuance of the initial registration card. Re-registration fees
shall be due on July 1 and payable by June 30 of each year.
Payment shall be made to the County Treasurer. Any person
to be registered as a supervising electrician, supervising specialty
electrician, and as an electrical contractor or electrical specialty
contractor shall secure separate registration cards and pay separate
fees for each.
E, Failure to re-register,
1, Any journeyman electrician, journeyman specialty
electrician, supervising electrician, supervising specialty
electrician, or motion picture operator, other than one
initially receiving a certificate of qualification, who
fails to apply for re-registration on or before June 30 of
each year shall submit to a re-examination, and be required
to pay the examination fee therefor, except where the
Administrative Authority grants an extension of time to
re-register, based on good cause.
2, Any electrical contractor or electrical specialty
contractor who fails to apply for re-registration Ori or
before July 30 of each year shall resubmit an application
for a certificate as an electrical contractor or electrical
specialty contractor to the Department and be required to
pay a fee of $25.00 therefor, except where the Administrative
Authority grants an extension of time to re-register, based
on good cause,
SECTION 22. Transferability, All certificates and registra-
tions under this Code shalllbe non-transferable.

SECTION 23, Appeals.
A, Appeals. Any person aggrieved by an action of 1:he
Examining Board may appeal to the Board of Supervisors by filing
a notice of appeal with the County Clerk within thirty (30) days
after notice of the action has been sent to the applicant, together
with a statement of facts relating to the controversy and the reasons
for the appeal. ~,~ithin thirty (30) days after the filing of the
notice of appeal, the Examining Board shall submit a statement of
the facts and reasons on which the action was based.
B. Hearina. The Board of Supervisors shall hold a hearing
on all appeals.
C. Decision. The Board of 1upervisors shall reverse the
action from which the appeal was taken if it finds that the reasons
for the action of the Board are not substantially supported by the
evidence.
SECTION 24. Penalty. Any person, firm or corporation
violating, or failing to comply with any of the provisions of this
Code, shall upon conviction thereto be punished by a fine not
exceeding Five Hundred Dollars ($500.00). Each separate day or
any portion thereof during which any violation of this Code occurs
or continues shall be deemed to constitute a separate offense, and
upon conviction thereof shall be punishable as herein provided.
SECTION 25. Repeal.
A. Repeal. County of Hawaii Ordinance No. 41 is hereby
repealed.
B. Conflict. All sections and parts of sections of ordinances
of the County of Haeaaii in conflict with the provisions of this Code
be and the same are hereby repealed.
