This letter is to inform you of the satisfaction of the requirements of Condition I of Change of
Zone Ordinance No. 00-53, which reclassified the subject property from anAgricultural-5 acre
(A-Sa) to a Single Family Residential-15,000 squaze foot minimum lot size (RS-15) zoned
district. Effective May 17, 2000, Ordinance No.00-53 required, in part, that the applicant
comply with the following Condition I:
"I. An azchaeological Date Recovery Plan and Preservation Plan shall be submitted
for the review and approval by the Planning Director, in consultation with the
Department of Land and Natural Resources-Historic Preservation Division
(DLNR-HPD). Proposed mitigation treatment (preservation in place or
disintelnment/reintelnment) for burial sites within the subject property shall be
approved by the Historic Preservation Division's Hawaii Island Burial Council
before detailed mitigation plans are finalized for these sites. A copy of the
approval Final Archaeological Data Recovery Plan and Preservation Plan shall be
submitted to the Planning Director for its files prior to submitting plans for
subdivision review and prior to any land alteration permits. An
interpretive/mitigation plan which shall include buffer zones, signage and long-
range preservation concerns shall be submitted to the Planning Director prior to
Final Subdivision Approval."
An Archaeological Inventory Survey dated April 1995 and its addendum dated December 1999
and May 2000 were approved by the DLNR-HPD by letter dated May 18, 2000. According to
the DLNR-HPD letter, the 12 sites located within the project site has been adequately
documented. 11 of these sites were found to be "no longer significant". A Burial Treatment
Plan dated June 2000 was prepazed for the remaining burial site and approved by the Hawaii
Island Burial Council during its meeting of August 24, 2000. Therefore, mitigative actions•h~ave

already taken place with the completion of data recovery for the 11 sites deemed no longer
significant and the preservation-in-place with buffers for the burial site.
