ORDINANCE NO, ~~
AN ORDINANCE AMENDING ORDINANCE NO, 38 OF THE REVISED ORDINANCES
OF THE COUNTY OF HAWAII 1967, AS AMENDED, PROVIDING FOR THE
REGULATION AND CONTROL OF TAXICAB DRIVERS AND TAXIMETERS,
ESTABLISHING TAXICAB RATES AND FARES, AND PROVIDING PENALTIES
FOR THE VIOLATION THEREOF,
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAIIs
SECTION 1, Section 1 of Ordinance No. 38, Revised Ordinances
of the County of Hawaii 1967, as amended, is hereby further amended
by addition of a new subsection (i) as followss
"(1) 'Time elapsed' shall mean the
time from the initial meter actuation to
of the trip, including any waiting time,
herein defined."
SECTION 2. Subsection (a) of Section S
38, Revised Ordinances of the County of Hawai
is hereby further amended to read as follows

"(a) Installation, Every taxicab while operating
within the County of Hawaii shall be equipped with a
taximeter so mounted in the taxicab that the reading
dial showing the amount of fare to be charged shall at
all times be plainly visible to the passenger. It should
also be so attached to the taxicab that it shall be
possible for a person standing outside the vehicle to
tell whether the taximeter is in use or not. Between
the hours of sunset and sunrise, the reading dial showing
the amount of fare to be charged shall be well lighted
and readily discernible by the passenger riding in such
taxicab. The taximeter shall be operated mechanically by
a mechanism of standard design and construction. Except

when a taximeter is being cleared, the primary indicating
element shall be susceptible of advancement only by motion
of the vehicle wheels or by time mechanism. The taximeter
shall have a position recording mileage only and another
positlon recording waiting time. The taximeter may also
have a position to calculate fares upon the basis of a
combination of mileage traveled and time elapsed, as
provided in subsection (b) of this Section. The taximeter
shall have thereon a flag or other convenient and effective
mans to denote when the taxicab is employed and when it
is aot employed. It shall be sealed at all points and
connections which, if manipulated, would affect its correct
reading and recording."
SECTION 3. Subsection (b) of Section 5 of Ordinance No.
38, Revised Ordinances of the County of Hawaii 1967, as amended,
is hereby further amended to read as followsa
"(b) Operation. When a taxicab equipped with a
taximeter is employed by a passenger, it shall be the
duty of the driver to throw the flag or other convenient
and effective means of the taximeter into the appropriate
employed position, so as to record mileage while the
taxicab ie in motion and to record waiting time while the
taxicab is standing at the direction of the passenger.
When a taximeter designed to calculate fares upon the
basis of a combination of mileage traveled and time elapsed
is operative with respect to fare indication, the fare-
indicating mechanism shall be actuated by the mileage
mechanism whenever the vehicle is in motion at such a
speed that the rate of mileage revenue equals or exceeds

the time rate, as determined by the Weights and
Measures Division of the State of Hawaii Department of
Agriculture, and may be actuated by the time mechanism
whenever the vehicle speed is less than this and when
the vehicle ie not in motion. Means shall be provided
for the vehicle operator to render the time mechanism
either operative or inoperative with respect to the fare-
indicating mechanism. The flag or other convenient and
effective means of the taximeter shall be kept in the
appropriate employed position until the termination of the
trip. At the termination of the trip, it shall be the
duty of the driver to throw the flag or other convenient and
effective means of such taximeter into the non-employed
position."
SECTION 4. Subsection (a) of Section 6 of Ordinance No.
38, Revised Ordinances of the County of Hawaii 1967, as amended,
is hereby further amended to read as followss
"(a) Rates of fare within the County of Hawaii.
No driver or owner of a taxicab while operating the same
within the County of Hawaii shall charge, demand, collect
or receive a fare other than that based on the following
schedules
"(1) Initial meter actuation shall
equal SOt and shall entitle
customer to 1/5 mile or less,
or ona minute waiting or elapsed
time or less.
"(2) Thereafter for each additional
1/5 mile or fraction thereof........10~
"(3) For each additional one minute of
waiting or elapsed time or fraction
thereof .............................10~
Nothing contained in this subsection shall be construed to
permit charging mileage or waiting time rates of fare which

are greater or less than or different from those established
and fixed by the above schedule. Where a taximeter is
designed to calculate fares upon the basis of a combination
of mileage traveled and time elapsed, as provided in
subsection (b) of Section 5 hereof, the rates of fare upon
such combination of mileage traveled and time elapsed shall
be the same as fixed by the above schedule."
SECTION 5. This ordinance shall take effect on April 1,
1969.
