ORDINANCE NO, ~~~
AN ORDINANCE AMENDING ARTICLE 19 (PARKING METER ZONES) OF
ORDINANCE NO, 39 (TRAFFIC ORDINANCE), REVISED ORDINANCES OF
THE COUNTY OF HAWAII 1967, BY ADDING A NEW SECTION PROVIDING
FOR THE "BUYING OUT" OF PARKING METER STALLS,
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Article 19 of Ordinance No, 39 (Traffic
Ordinance), Revised Ordinances of the County of Hawaii 1967,
is hereby amended by adding a new section thereto to read as
follows:
"19-9, `BUYING OUT' OF PARKING METER STALLS
(a) Definitions, As used in this section, the
following definitions shall apply in its interpretation
and enforcement;
1, 'Person' shall mean any person, firm, partnership,
association, corporation, company or organization
of any kind,
2, 'Occupation' shall mean the enclosure or
obstruction of parking meter stalls,
3, 'Department' shall mean the Department of
Public Works,
(b) Unlawful to Occupy Parking Meter Stalls Without
First Obtaining Permit, It shall be unlawful for any
person to occupy any parking meter stall or portion
thereof, incidental to erecting, constructing, enlarging,
altering, repairing, moving, improving, removing,
converting or demolishing any building or structure
or fixture attached thereto without first obtaining
a permit from the Department of Pub:Lic Works of the
County ~ Hawaii authorizing said occupation,

(c) Fees, The Department of Public Works shall
require the payment of a fee calculated at the rate of
one dollar ($1,00) per day or fraction thereof, exclusive
of Sundays and public holidays, for each parking meter
stall so occupied, before issuing the above-mentioned
permit,
(d) Application for Permit; Required Information;
Department of Public Works to Exercise Its Discretion,
In all applications for the occupation of parking meter
stalls, the Department of Public Works shall require
information regarding the nature of the proposed activity,
the number and location of the affected stalls, the
duration of occupation, and all other information
deemed relevant and reasonable in aiding the Department
to evaluate the necessity of imposing conditions upon
the occupation of the said stalls, or to prohibit its
occupation entirely, if such occupation would endanger
the health, safety and welfare of the general public,
(e) Responsibility for Keeping Permit at Job Site;
Inspection by Authorized Personnel, Any person who has
been issued a permit shall be responsible for keeping
the permit at the job site at all times, and shall
present the permit, upon demand, to any officer of the
law or employee of the Department f'or his inspection,
(f) Unlawful to Violate Terms of Permit, It shall
be unlawful for any person who has been granted a permit
to violate any of the terms or conditions of the permit,
(g) Penalties, Any person found guilty of
violating any provision of the above sections shall be
guilty of a misdemeanor and shall be subject to a fine

not exceeding Twenty-Five Dollars ($25,00),
SECTION 2, This ordinance shall take effect upon its
approval,
