ORDINANCE N0. ~8~
AN ORDINANCE PROHIBITING THE USE OR CONSUMPTION OF INTOXICATING
LIQUORS IN CERTAIN PUBLIC PLACES AND PROHIBITING THE USE OR
CONSUMPTION OF INTOXICATING LIQUORS IN OTHER PUBLIC PLACES
WITHOUT PERMITS; REPEALING ORDINANCE N0. 26, REVISED ORDINANCES
OF THE COUNTY OF HAWAII 1967, AS AMENDED; AND PROVIDING PENALTIES
THEREFOR.
BE IT ORDAINED BY THE DJUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. It is hereby declared to bF the legislative
intent of the Council of the County of Hawaii to prohibit the open
indiscriminate and unrestricted use or consumption of intoxicating
liquors in certain public areas or buildings, and to prohibit
without first obtaining a permit the open indiscriminate and
unrestricted use or consumption of intoxicating liquors in other
public areas or buildings.
SECTION 2. No person shall drink, offer to drink, or
display to public view in the following public areas or buildings
located thereon, any intoxicating liquors, whether in a bottle,
demijohn, jug, container or otherwise:
A. All public school grounds and buildings;
B. Al.l public areas or bui]-dings contiguous to all public
school grounds and buildings;
C. All public parks, except parks enumerated in Section 3,
on which children's playground equipment, such as slides, jungle
jims, see-saws and swings, are located;
D. All the following public areas:
1. All public areas, except Coconut Island, located
on the Banyan Peninsula, being that area makai of
Kamehameha Avenue-Kalanianaole Avenue from the
Wai]oa River estuary to the Steak 'N Lobster
Restaurant.
2. Mooheau Park
3. Hilo Bayfront Park
4. Clem A. Akina Park and Pavilion
5. Kailua Playground
6. Kalakaua Park
7. Kaumana Caves
8. Lincoln Park and Tennis Court

SECTION 3. No person shall drink, offer to drink, or
display to public view in the following public areas or buildings
located thereon, any intoxicating liquors, whether in a bottle,
demijohn, jug, container or otherwise, without first obtaining
a permit from the Chief of Police or his authorized representative:
A. Honaunau (Old School site)
B. Hoolulu Park and Civic Auditorium Complex
C. Kaiwiki Park
D. Kamehameha park
E. Kurtistown Park
F. Papaikou Park and Gym
G. Piihonua Gym and Gilbert Carvalho Park
H. Waimea Park
I. Waipio Lookout
J. A. J. Wat± Park and Gym
K. Coconut Island including park and parking area on
mainland
L. Waiohinu Park
M. Hale Halawai
N. Honomu Gym
0. Waiakea Uka Park and Gym
P. Hilo Armory
Q. Arthur L. Greenwell Park and Hall
SECTION 4. Any person desiring to obtain a permit, as
described in Section 3, shall make application for a permit
therefor in writing to the Chief of Police or his authorized
representative. Said application shall be signed by the
applicant and the person who is to be responsible for the
conduct of all persons at the gathering or occasion, and
shal]. include:
A. The full name and address of the app.1_icant, if an
individual, and, if a firm, association, corporation or club,
the full names and addresses of the principal officers thereof;
B. The fu1.1 name and address of the person who is to be
responsible for the conduct of all persons at the occasion or

gathering. Such person shall. be of good moral character.
The Chief of Police or his authorized representative may, in
his discretion, require proof of good moral character in the
event he has any good reason to doubt the moral character of
said person. Such proof shall. be in the form of an affidavit
signed by two or more responsible persons stating the duration
and nature of their knowledge and acquaintance with such person
and that said person is of good moral character;
C. The place for which a permit is desired;
D. The date and time for which a permit is desired.
In no event shall said permit extend beyond the hours licensed
dispensers are permitted by law to serve intoxicating liquors;
E. The nature of the occasion or gathering;
F. The number of persons to be in attendance;
G. A statement that the permit is not for the purpose
of enabling habitual drunkards to consume intoxicating lia,uor.
SECTION 5. All permits shall. be subject to all applicable
laws and ordinances and to the following conditions which shall
be set forth in the permit:
A. No person under the influence of intoxicating liquor
shay be permitted to be or remain upon the premises;
B. No person shall wilfully or intentionally destroy,
damage or injure any property;
C. No person shall throw or dispose of any refuse, waste
materials, or bottles, except in receptacles placed therein;
D. The responsible person shall be present at all. times.
SECTION 6. The provisions of this ordinance shall not be
construed to permit any person to sell any intoxicating liquor by
obtaining a special. license or otherwise.
SECTION 7. Ordinance No. 26, Revised Ordinances of the
County of Hawaii 1967, as amended, is hereby repealed.
SECTION 8. Any person violating any provision of the
ordinance or any condition set forth in a permit issued herein
shall, upon conviction, be punished by a fine not exceeding
$500.00.
SECTION 9. This ordinance shall take effect upon its
approval.
