AN ORDINANCE AMENDING ORDINANCE NO. 49, REVISED ORDINANCES
OF THE COUNTY OF HAWAII 1967, RESTRICTING ANIMALS AND LIVESTOCK
ON PUBLIC PLACES AND PRIVATE LANDS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 1 of Ordinance No. 49, Revised Ordinances
of the County of Hawaii 1967, is hereby amended to read as follows:
"SECTION 1. No person owning, controlling or having
the possession of any .livestock or anim<31s, such as cattle,
horses, mules, donkeys, swine, sheep or goats, shall,
knowingly or negligently, suffer or permit any such
livestock or animals to roam, graze or stray upon the
highways of the County of Hawaii known and identified
by Route designation numbers 11 and 19. Such action is
declared to be a nuisance and dangerous to the public
health and safety."
SECTION 2. Ordinance No. 49, Revised Ordinances of the
County of Hawaii 1967, is hereby amended by adding a new
Section 2 to read as follows:
"SECTION 2. In the event any person owning or having
in his possession any livestock or animals described in
Section 1 shall suffer or permit the same to roam, graze
or stray upon the highways of the County of Hawaii known
and identified by Route designation numbers 11 and 19, and
in the event the fence bounding the premises of such owner
or possessor is not in good repair or maintenance, it shall
be prima facie evidence that such owner or possessor
knowingly or negligently suffered or permitted such
livestock or animals to roam, graze or stray upon the
said prohibited places."
SECTION 3. Section 2 of Ordinance No. 49, Revised
Ordinances of the County of Hawaii 1967, is hereby renumbered
as "Section 3."
SECTION 4. Section 3 of Ordinance No. 49, Revised
Ordinances of the County of Hawaii 196'1, is hereby renumbered
as "Section 4."
SECTION 5. This Ordinance shall take effect upon its
approval.
