HomeMy WebLinkAboutORD 1970-306BILL N0. 695 COUNTY OF HAWAII -STATE OF HAWAII ORDINANCE N0, ~~ AN ~tDINANCE AMENDING ARTICLE 1 (DEFINITION) AND 3ECTION 13-T (FOLLOYiING FIRS APPARATUS PROHIBITED), ARTICLE 13 (MISCELL-NEOUS RDILS) OF ORDINANCE N0. 39 (TRAFFIC CODE), REVISED ORDINANCES OF TiD;' COiJNTY OF HAWAII 1967. BE IT ORDAINED BY THE COUNCIL OF TiiE COUNTY OF HAWAIIs SECTION 1. Article 1 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended by the addition of taro definitions to read as follows: "Section 1-12.5. Emergency "A situation where unforeseen, unexpected or sudden occurrences call for immediate action by the responsible public officers, employees or agents in order to preserve the public peace, health or safety. "Section 1-17.5. Official Act "An act by a public officer, employee, or agent of the County or State of Hawaii in his official capacity, under color of his title and by virtue of his office or position as prescribed or authorised by law." SECTION 2. Section 13-7, of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as folloxa: "Section 13-7. Following or Interfering With Emergency Vehicles Prohibited. "A. No vehicle, other than one operated by a person engaged in the performance of an official act, shall follow any authorised emergency vehicle closer than 500 feet when said authorized emergency vehicle i.s traveling in response to an emergency, as evidenced by its use of audible or visual signals; nor shall any vehicle, other than one operated by a person engaged in the performance of an official act, be driven, parked or operated within 400 feet from the place at which an authorized emergency vehicle has stopped in answer to an emergency, except when the driver of the vehicle is otherwise directed to do so by a police officer. "B. If the presence of a vehicle situated at a distance of lt00 feet or more from an authorized emergency vehicle responding to an emergency may interfere with the on-going emergency operations, or if the operator or occupants of said vehicle are or may be ezposed to the hazards of the emergency condition, the driver or owner of the vehicle shall, upon demand oY a police officer, fireman, or other duly authorised public official, remove the vehicle to the distance or location to which he has been directed. "C. Paragraph A shall not apply to any vehicle already parked within 1100 feet of an authorised emergency vehicle which has stopped in response to an emergency, nor shall any vehicle be found guilty of following an authorised emergency vehicle closer than 500 feet if said vehicle has bees over- taken by an authorised emergency vehicle and adequate time has not been allowed for the vehicle to safely decelerate and thereby comply with the provisions of Paragraph A." SFsCTION 3. This ordinance shall take effect upon its approval.
