HomeMy WebLinkAboutORD 1970-310BILL N0. 693 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO,,, ~lO AN ORDINANCE REQUIRING THE MARKING OF OBSTRUCTIONS PROTRUDING UPON OR OVER A ROADWAY. BE IT ORDAINED BY THE COUNCSf~ OF THE COUNTY OF HAWAII: SEC'T'ION 1. Definitions. For the purposes of this Ordinance, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number. (a) "Person" is any person, firm, corporation, partner- ship, association, company or organization of any kind. (b) "Roadway" shall mean any public o:r private street, avenue, road, alley, highway, lane, path or other place located in the County and established for the use of vehicle and/or pedestrian traffic. SECTION 2. Obstruction Across Roadways To Be Clearly Visible. No person shall install or place anything which protrudes upon, over or across a ro adway so as to obstruct, in any way, the passage of vehicular or pedestrian traffic, unless such obstruction is clearly visible so as to give reasonable warning to all travelers that the course of their travel is obstructed. SECTION 3. Violation; Penalties. Any person who violates this ordinance shall be guilty of a misdemeanor and shall be subject to a fine not to exceed $500.00. SECTION 4. Effective Date. This ordinance shall take effect upon its approval. Dated at Hilo, Hawaii, this 25e6 day of March 1970.
