AN ORDINANCE AMENDING SUBSECTION C OF SECTION 11 RELATING
TO HEIGHT LIMITS IN THE MULTIPLE FAMILY RESIDENTIAL DISTRICTS
(RM) AND SUBSECTION C OF SECTION 15 RELATING TO HEIGHT LIMITS
IN THE RESORT-HOTEL DISTRICTS (V), AND AMENDING SECTION 7.04,
AS AMENDED, OF ORDINANCE NO. 63 (ZONING ORDINANCE), REVISED
ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Legislative Intent. It is the intent of
the Council of the County of Hawaii to reduce the height
limits in Kailua-Kona. It is the further intent of the
Council that the amendments to the Zoning Ordinance be
enacted to promote and protect the health, safety and general
welfare of the people of the County of Hawaii. It is the
intention of the County Council that these amendments will
implement the purpose and intent of the General Plan of the
County of Hawaii by providing a reasonable standard with
respect to height limits.
SECTION 2. Subsection C of Section 11 of Ordinance
No. 63 (Zoning Ordinance), Revised Ordinances of the County
of Hawaii 1967, as amended, is hereby amended to read as
follows:
"C. HEIGHT LIMITS: Three (3) stories but not
higher than forty-five (45) feet except that a 'use
permit' may be granted for a four (4) story building
with a maximum height of sixty (60) feet if the
Planning Commission finds, in addition to the
requirements contained in Section 35, that the
taller building will not dominate the landscape;
and in the City of Hilo, ten (10) story but not
higher than one hundred twenty (120) feet:'
SECTION 3. Subsection C of Section 15 of Ordinance
No. 63 (Zoning Ordinance), Revised Ordinances of the County
of Hawaii 1967, as amended, is hereby amended to read as
follows:
"C. HEIGHT LIMITS: No building or structure
shall exceed a height of forty-five (45) feet or
contain more than three (3) stories except that a
'variance' may be granted for a four (4) story
building with height limits of fifty-five (55) feet,
if the Planning Commission finds that the additional
height will not render the building conspicuous in
relation to its natural surroundings; and in the
City of Hilo, ten (10) stories but not higher than
one hundred twenty (120) feet; Keauhou Bay and Kahaluu
Bay, seven (7) stories but not higher than ninety (90)
feet; and said areas have been delineated and designated
on the 'Zoning Map' by an alphabet H after V (VH .75)."
SECTION 4. Section 7.04, as amended, of Ordinance 63
(Zoning Ordinance), Revised Ordinances of the County of
Hawaii 1967, as amended, is hereby amended by deleting the
letter (H) from the(VH) designations.
SECTION 5. This ordinance shall take effect upon its
approval.
