ROADWAYS CLOSED TO CERTAIN CLASSES OF VEHICLES 17. PARKING METER ZONES WITHIN THE COUNTY OF HAWAII, STATE OF HAWAII, BY AMENDING ORDINANCE N0. 39 (TRAFFIC CODE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AND REPEALING ALL RESOLUTIONS AND ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 2-1 (Board of Supervisors to Exercise Certain Administrative Functions by Resolution) of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby repealed and Sections 2-2 and 2-3 renumbered to read 2-1 and 2-2, respectively. SECTION 2. Article 5 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended by the addition of a new section thereto to read as follows: "SECTION 5-7 TRAFFIC CONTROL DEVICES (a) The following are hereby established and designated as traffic-control devices: 1-REGULATORY SIGNS a) Stop - Stop signs shall be octagonal in shape, shall have a red background and shall carry the word STOP in ref lectorized white letters at least one-third the height of the sign. Its dimensions shall be not less than 24 inches by 24 inches. b) Yield - The yield sign shall be an equilateral triangle with one point downward, having a black legend on a ref lectorized yellow background. The sides of the triangle shall have a standard and minimum length of 30 inches. c) Parking and Stopping - Signs governing parking, bus stops, passenger and freight loading, etc., shall be rectangular in shape and mounted vertically, and not less than 12 inches by 18 inches. Prohibitive signs shall contain a red legend not less than 1 1/2 inches in height on a white background and permissive signs shall contain a green legend not less than 1 1/2 inches in height on a white back- ground. d) Speed limit, minimum speed, speed zone ahead, speed zone, turn prohibition, lane use control, do not pass, pass with care, slower traffic keep right, keep right, one way, reversible flow, periodic one way, walk on left, do not cross, keep off median, road closed, local traffic only, weight limit, and all other regulatory signs shall be rectangular in shape with black and/or red lettering on a white background. 2-WARNING SIGNS a) Advisory speed limit signs shall be square, not less than 18 inches by 18 inches, with black lettering on a yellow ref lectorized background. -2- b) Turn, curve, reverse turn, reverse curve, winding road, large arrow, cross road, side road, T symbol, Y symbol, stop ahead, yield ahead, signal ahead, merging traffic, pavement-width transition, road narrows, narrow bridge, divided highway, hill, bump, dip, pavement ends, soft shoulder, slippery when wet, school, crossings, double arrow, low clearance, and all other warning signs shall be diamond shaped and not less than 24 inches by 24 inches with black lettering on a yellow background. 3-MARKINGS a) Center, no passing, double, safety zone, pavement- width transition, parking space, and all lines running parallel to the pavement edge shall be at least 4 inches in width. Safety zones shall be designated by a line running parallel to the pavement edge and said line shall be at least 8 inches in width. b) Channelizing, turn symbol, stop, crosswalk, word and symbol, and all other lines running at right angles to the pavement edge shall be at least 8 inches in width. c) Curb markings shall cover the face and top of curbs. d) All lines and markings shall be white in color except for the following which shall be in yellow: (1) Double center lines on mzlti-laned pavements. (2) No passing barrier lines at: a) No passing zones on two- and three-lane roads b) Pavement-width transitions c) Approaches to obstructions which must be passed on the right d) Approaches to railroad crossings -3- (3) Curb markings: a) To show parking prohibitions b) On islands in the line of traffic." SECTION 3. Section 14-7 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 14-7 DRIVING THROUGH SAFETY ZONE PROHIBITED (a) No vehicle shall at any time be driven through or within a safety zone. (b) The following are hereby established and designated as safety zones and shall be effective when appropriate lines or other markings on the surface of the roadway giving notice thereof are painted: 1-HAMAKUA a) On the makai side of Mamalahoa Highway from the Paauilo Garage to the Paauilo School Road. b) On the mauka side of Mamalahoa Highway, from the Paauilo School Road to the Hawaii Belt Road, Project DF-019-2(5). c) On the waipio side of Pakalana Street from Mamane Street to Kukui Street. 2-NORTH HILO a) On the makai side of Mamalahoa Highway in Laupahoehoe from the Honokaa intersection with the Hawaii Belt Road to the Kihalani Homestead Road. b) On the mauka side of Mamalahoa Highway in Laupahoehoe from the Kihalani Homestead Road to the Hilo side of the cutoff road to the Hawaii Belt Road. -4 - 3-SOUTH HILO a) On the makai side of Mamalahoa Highway from the Spanish Camp Road to the Hakalau Store in Hakalau. b) On the makai side of Mamalahoa Highway from Pua Lane to the Haaheo School Road. c) On the makai side of Mamalahoa Highway from a point 200 feet on the Hamakua side of the Onomea Sugar Company Office to the Hamakua entrance to Moirton Camp in Papaikou. d) On the Puna side of Kukuau Street from Kilauea Avenue to I{inoole Street. e) On the north side of Puainako Street from Kinoole Street to Komohana Street. f) On the Hamakua side of Ainako Avenue between Kaumana Drive and the Ernest B. De Silva School entrance. g) On the south side of Kawailani Street from Kinoole Street to Komohana Street. h) On the east side of Kaumana Drive from Iiwipolena Street to Ainako Avenue. 4 -I{AU a) On the makai side of Mamalahoa Highway in Naalehu from the Naalehu Trailer Camp site to the Naalehu School. b) On the south side of Kamani Street between Pikake Street and Puahale Street in Pahala. 5-KOHALA a) On the north side of Niulii-Mahukona Road from the center of Hawi Village to the Bank of Hawaii in Kapaau traveling in an easterly direction. 6-KONA a) On the makai side of Mamalahoa Highway from the Konawaena School Road traveling in a northerly direction for a distance of 2 miles. -5 - b) On the mauka side of Mamalahoa Highway from the Konawaena School Road traveling in a southerly direction for a distance of 1.9 miles. c) On the makai side of Mamalahoa Highway from Holualoa School traveling in a northerly direction for a distance o£ 2 miles. d) On the mauka side of Mamalahoa Highway from Holualoa School traveling in a southerly direction for a distance of 1.2 miles. e) On the mauka side of Mamalahoa Highway from the new Honaunau School traveling in a southerly direction for a distance of 1 mile and traveling in a northerly direction for a distance of 1 mile. 7-PUMA a) On the makai side of Mamalahoa Highway in Olaa from the Old Slaughterhouse Road (Old Volcano Road) to Milo Street. b) On the mauka side of the Olaa-Kapoho Road, from the Pahoa School (Homestead) Road, to a point on the Kapoho end of the Pahoa Village." SECTION 4. Section 14-2 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 14-2 PEDESTRIANS' RIGHT-OF-WAY IN CROSSWALKS (a) The driver of a vehicle shall yield the right- of-way, slowing down or stopping if need be, to so yield to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger, but no pedestrian shall enter any crosswalk or part of a crosswalk when vehicular traffic is so close thereto as to constitute an immediate hazard. -6- (b) Pedestrians shall walk briskly within a crosswalk so as not to impede the flow of vehicular traffic. (c) The following are hereby established and designated as crosswalks and shall be effective when appropriate lines or other markings on the surface of the roadway giving notice thereof are painted: 1-HAMAKUA a) Mamane Street, in front of the People's Theater in Honokaa. b) On Pakalana Street, 145 feet mauka of Mamane Street intersection near the Honokaa Swimming Pool. c) Pakalana Street, makai of Kukui Street at the Honokaa School entrance road. d) Hawaii Belt Road LProj. Article 18 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 18-1. STANDING IN PASSENGER LOADING AND UNLOADING ZONES (a) No person shall stop, stand, or park a vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers in any place marked as a passenger curb loading and unloading zone during hours when the regulations applicable to such curb loading and unloading zone are effective, and then only for a period not to exceed three minutes. "SECTION 18-2 STANDING IN FREIGHT LOADING ZONES (a) No person shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pick-up and loading of materials in any place marked as a freight curb loading zone during hours when the provisions applicable to such zones are in effect. In no case shall the stop for loading and unloading of materials exceed 30 minutes. (b) The driver of a passenger vehicle may stop temporarily at a place marked as a freight curb loading zone for the purpose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any motor vehicle used for the transportation of materials which is waiting to enter or about to enter such zone. (c) The foregoing provisions regarding freight curx loading zones shall be applicable only between the hours of 8:00 A.M. to 4:00 P.M. of any day except Sundays and public holidays. When said provisions are not in effect, vehicles may park in freight curb loading zones unless otherwise prohibited by this ordinance. SECTION 6. Section 17-8 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 17-8 NO PARKING ZONES (a) When official signs or markings give notice thereof, no person shall stop, stand or park a vehicle any longer than is reasonably necessary to take on or discharge passengers or freight upon any street or portions thereof within the County of Hawaii. (b) The following are hereby established and designated as no-parking zones and shall be effective when appropriate signs or markings giving notice thereof are erected or placed: 1-HAMAKUA a) The Hilo side of Lehua Street in Honokaa from Mamane Street to the Catholic Church. b) The Waipio side of Kika Street in Honokaa. c) The makai side of Koa Street in Honokaa. d) The mauka side of Mamane Street in Honokaa for a distance of 600 feet Waipio from culvert 230-C. e) On the Waipio side of Plumeria Street in Honokaa. f) On the mauka side of Mamalahoa Highway from the Paauilo School Road to the Hawaii Belt Road LProj. DF-019-2 (5f in Paauilo. -17- i) On the Hilo-bound portion of the Hawaii Belt Road from the Hilo-Puna boundary to Makalika Street. g) On the makai side of Mamane Street in Honokaa from the culvert 230-C for a distance of 200 feet in the waipio direction. h) On the Waipio side of Pakalana Street from Mamane Street to a distance of 100 feet mauka of Kukui Street. 2-NORTH HILO a) Mauka side of old Mamalahoa Highway at Papaaloa beginning at a point 233 feet on the Hilo side of Kaiwilahilahi Bridge for a distance of 154 feet in the Hilo direction from 7:00 AM to 5:00 PM. b) On Puualaoa Subdivision Road from the Belt Highway for a distance of approximately 220 feet. 3-SOUTH HILO a) On the Hamakua side of Ainako Avenue between Kaumana Drive and the Ernest B. Section 8-2 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 8-2 LIMITATIONS ON TURNING AROUND (a) The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction (make a U-turn) upon any street in the business district, or at any intersection where traffic is controlled by traffic signal lights during the hours between 6:00 a.m. to midnight of each day. However, when official signs or markings are installed giving notice thereof, U-turns shall be allowed in areas designated by an ordinance of the County Council. (b) The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction unless such movement can be made in safety and without interfering with other traffic. (c) The driver of any vehicle shall not turn so as to proceed in the opposite direction upon any curve, or upon the approach to or near the crest of a grade, where such vehicle cannot be seen by the driver of any other vehicle approaching from either direction within five hundred feet. (d) The following are hereby established and designated as U-turn areas and shall be effective when appropriate signs giving notice thereof are erected: 1- U-TURN AREAS a) Intersection of Kamehameha Avenue and Shipman Street. b) Intersection of Mamane Street and Lehua Street in Honokaa. c) Intersection of Lihiwai Street and Liholiho Street. d) Mamalahoa Highway in the vicinity of the Aloha Theater in Kainaliu, Kona. _Zg_ e) Within Kaahumanu Square, Kailua-Kona, Hawaii. f) In front of the Keaau Police Station. SECTION 9. Section 8-7 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 8-7 PROHIBITED LEFT AND RIGHT TURNS (a) When official traffic signs are posted giving notice thereof, no driver of a vehicle shall make a left or right turn. For the provisions of this paragraph, the Chief of Police may place or erect signs of a temporary nature during peak traffic hours at any intersection or driveway he may deem to be congested. Section 9-3 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 9-3 SIGNS REQUIRED AT THROUGH STREETS (a) Whenever any ordinance of this County designates and describes a through street or stop intersection, it shall be the duty of the County and/or Chief Engineer to place and maintain stop and/or yield signs on each and every street intersecting such through street and at every stop intersection unless traffic at any such intersection is controlled at all times by traffic- controlled signals. The Highway Safety Council may recommend when said yield signs may be substituted for stop signs. Section 9-1 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 9-1 STOP SIGNS AND YIELD SIGNS (a) Except when directed to proceed by a police officer or traffic-control signal, every driver of a vehicle approaching a stop intersection indicated by a stop sign shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no crosswalk, shall stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection. (b) The driver of a vehicle approaching a yield sign if required for safety to stop shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no crosswalk, at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection. Section 14-3 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 14-3 CROSSING AT OTHER THAN CROSSWALKS (a) Every pedestrian crossing a roadway at any -40- point other than within a marked crosswalk or within are unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway. (b) No pedestrian shall enter upon or cross any roadway or portion of any roadway designated by ordinance of the County Council as closed to pedestrian traffic, except within an authorized marked crosswalk, or upon a pedestrian overpass, or through a pedestrian tunnel. (c) The following are hereby established and designated as roads closed to pedestrian traffic: (1) Hawaii Belt Road in South Hilo, from the south end of Hakalau Bridge to a point one-half mile south from the Chin Chuck Road- Mamalahoa Highway intersection. (2) Hawaii Belt Road in South Hilo from the Kaieie Homestead Road south to the Onomea Sugar Mill Cane Haul Road in Papaikou. (3) Hawaii Belt Road in North Hilo from the northeast (Hamakua) end of Kaiwilahilahi Bridge northeasterly to the southeast (Hilo) end of Kawaikahi Bridge. Section 13-14 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 13-14 RESTRICTED USE OF HIGI-IV~AYS BY CERTAIN VEHICLES (a) The use of certain streets by certain classes of vehicles may be restricted as designated by ordinance of the County Council, and appropriate signs shall be posted giving notice thereof. (b) The following classes of vehicles are hereby precluded from the use of the streets designated thereunder when appropriate signs giving notice thereof are erected: -41- VEHICLE WITH A CAPACITY OF THREE-QUARTERS OF A TON OR OVER Pakalana Street between Lehua Street and K~akui Street in a northerly direction except that any vehicle equipped with safety brakes consisting of an automatic spring that will actuate the brakes when the air pressure drops below 60 pounds per square inch may be operated during the hours when Honokaa High and Elementary School is not in session. All vehicles equipped with safety brakes shall first be checked and approved by the Chief Engineer of the Department of Public Works before they are operated on said street. The approval of the Chief Engineer shall be valid for a period of three months. Waipio Valley Road in Hamakua from the top of the lookout to the bottom of the valley, restricted to four-wheel drive vehicles only." SECTION 15. Section 19-1 of Ordinance No. 39, Revised Ordinances of the County of Hawaii 1967, is hereby amended to read as follows: "SECTION 19-1 PARKING METER ZONES (a) All parking meter zones shall be designated by an ordinance adopted upon two readings by the County Council of the County of Hawaii.
